BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 16th day of August, 1988, with the following present: HONORABLE: Audwin Samuel Mayor Pro-Tem Councilman, Ward III Bob Lee, Jr. Councilman-At-Large Andrew P. Cokinos Councilman-At-Large Lulu L. Smith Councilman, Ward I Mike Brumley Councilman, Ward II David W. Moore Councilman, Ward IV Absent: Maurice Meyers Mayor Albert E. Haines City Manager Tyrone Cooper Assistant City Attorney Rosemarie Chiappetta City Clerk -000- The Invocation was given by the Reverend Rayfield Walker, West Tabernacle Baptist Church. The Pledge of Allegiance was led by Chad Hunter, a day-camper from the Downtown YMCA. -000- Mayor Pro-Tem Samuel welcomed Mr. Todd Rogers, Director of the Downtown YMCA Day Camp, along with Campers Heather Taylor, Eric Storic, Chad Hunter, and June Allen. These campers range in age from eleven to fifteen and are studying various careers and city government operation. -000- Twenty-five participants representing Beaumont in a Summer Olympics in Austin brought back eleven gold medals and a total of forty-five medals. Mayor Pro-Tem Samuel recognized and congratulated Michael McLin who qualified to compete in the National Track Meet in Hershey, Pennsylvania. Mr. Lou Cappi, Program Coordinator of the Recreation Division for the City of Beaumont, explained that the program serviced sixty children of our community during the summer. -000- One Proclamation was issued: "Third Annual Senior Games of Beaumont Day," Saturday, August 20, 1988. -213- August 16, 1988 Public comment was invited on Agenda items A through C. No one wished to address Council on these items. -000- Councilman Cokinos questioned not having copies of resolutions and ordinances included in Friday-packets prepared for Council. -000- The following Consent Agenda items were considered: Approval of the Minutes of the regular City Council session held August 9, 1988 and the special session of City Council held August 12, 1988; and Resolution No. 88-167 authorizing Texas Commerce Bank - Beaumont to pledge securities in the amount of $700,000. 00 in a U. S. Treasury Note @ 10. 500 due January 15, 1990 with Federal Reserve Bank - Dallas - Houston Branch, effective August 9, 1988; and Resolution No. 88-168 appointing Bill Matthews and Leo Lemell to the Airport Advisory Commission with terms expiring May 31, 1989; Nancy Fitzpatrick and Benjamin Booker to the Beaumont Advisory Commission for Prevention of Child Abuse with terms expiring June 30, 1990; Ric Warchol to the Convention and Tourism Advisory Commission for a term expiring July 31, 1990 and Delores R. Chevis to the Planning Advisory Commission for a term expiring July 31, 1990. The Consent Agenda was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Ordinance No. 88-74 abandoning Finis, from Carroll west to Wash Bayou, and Herring, between Buford and Finis and three alleys including the north- south alleys between Finis and Buford through the block east and west of Herring and an east-west alley between the alley west of Herring and Wash Bayou in Block 3 and 8 of the Neches River Park Addition (requested by the Port of Beaumont for future expansion) was considered: ORDINANCE NO. 88-74 ENTITLED AN ORDINANCE VACATING AND ABANDONING FINIS STREET ADJACENT TO BLOCKS 3 AND 8, NECHES RIVER PARK ADDITION, HERRING STREET NORTH OF BUFORD STREET, AND THE THREE ( 3) ALLEYS LOCATED WITHIN BLOCKS 3 AND 8, NECHES RIVER PARK ADDITION, BEAUMONT, JEFFERSON COUNTY, TEXAS. Ordinance No. 88-74 was approved on a motion made by Councilman Moore and seconded by Councilman Smith. Question: Ayes: All Nayes: None -214- August 16, 1988 Ordinance No. 88-75 amending the City Electrical Code to establish a procedure whereby plant electricians may qualify for limited master electrician certificates enabling them to obtain permits for electrical work in the plants where they are employed, provide that the same master electrician may not qualify more than one contractor, and add a requirement that plans for buildings of more than 5,000 square feet, based on exterior dimensions or more than two stories in height, shall bear the seal and signature of a professional electrical engineer licensed in the State of Texas was considered: ORDINANCE NO. 88-75 ENTITLED AN ORDINANCE AMENDING CHAPTER 6, ARTICLE IV, OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT CONCERNING THE ELECTRICAL CODE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Ordinance No. 88-75 was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Ordinance No. 88-76 amending the Historic Preservation Tax Abatement Ordinance to make tax abatement available for improvements to buildings in the Beaumont Commercial Historic District by accepting structures classified as "compatible" with the district to become eligible for tax relief now offered for improvements to structures classified as "contributing" to the district and by removing a restriction prohibiting historic preservation tax abatement from being granted initially for structures situated in a Tax Increment Financing Reinvestment Zone was considered: ORDINANCE NO. 88-76 ENTITLED AN ORDINANCE AMENDING CHAPTER 25, SECTION 25-57(A) AND SECTION 25-62 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT CONCERNING TAX EXEMPTION FOR HISTORICALLY SIGNIFICANT SITES; PROVIDING FOR SEVERABILITY AND PROVIDING FOR REPEAL. Ordinance No. 88-76 was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Resolution No. 88-169 approving historic preservation tax abatement over a ten-year period for restoration and renovation to the Bruce Irvine Building, formerly the Jacobs Building, at 446 Orleans to be used as a commercial building was approved on a motion made by Councilman Brumley and seconded by Councilman Smith. Question: Ayes: All Nayes: None -215- August 16, 1988 Ordinance No. 88-77 amending the budget of the City of Beaumont for the fiscal period commencing October 1, 1987 and ending September 30, 1988 to reflect the abolishment of Fire Protection Engineer/Training Coordinator, Grade 15, Number 1, in the Fire Department was considered: ORDINANCE NO. 88-77 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE PERIOD COMMENCING OCTOBER 1, 1987 AND ENDING SEPTEMBER 30, 2988 BY REDUCING THE NUMBER OF ALLOCATED POSITIONS IN THE EMERGENCY SERVICES DEPARTMENT, AND AMENDING THE FISCAL LINE ITEMS OF THE BUDGET; PROVIDING FOR SEVERABILITY AND REPEALING ORDINANCE IN CONFLICT HEREWITH. Ordinance No. 88-77 was approved on a motion made by Councilman Smith and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Councilman Moore expressed concern of open ditches on Lela at Blanchette School and asked they be checked for piping or depth for safety of children and questioned the School Crossing Guard Program and its readiness for the beginning of school. Councilman Cokinos requested that documents be placed in Council Packets rather than distributed at Council Meeting. (Councilman Brumley interjected that documents concerning pledging and releasing of securities should be exempt since the interest rates vary from day to day. ) Councilman Lee asked Staff to investigate the burned structure located on the Northwest corner of the intersection of Liberty and 2nd Street, announced that "Sunday in the Park" will be hosted by Channel 6-KFDM-TV on Sunday, August 21st; and requested information regarding the criteria used by Gulf States Utilities regarding intensity of illumination and commented that the light level is inadequate in some locations. Councilman Brumley commented on the great "Sunday in the Park" last week when he was the reader, Southwestern Bell was host and provided ice cream for everyone, and Jingles the clown entertained the children, and invited everyone to the next "Concert on the Move" Thursday at Magnolia Park. Councilman Samuel announced that Ward III will be hosting "Concert on the Move" which will provide Rhythm & Blues and Jazz music for entertainment; complained about the pothole on Fannin Street next to Butch Hoffer' s store; requested a status of improvements by the YMBL at Fair Park in preparation for the Fair in October; requested information of street lighting around Magnolia Gardens, especially on East Gill between Magnolia and Grand and Bean Court to aid the Task Force on Drugs in Public Housing; reported dilapidated structures on Bean Court; and asked that street lighting response be made to City Council and the Beaumont Housing Board. -216- August 16, 1988 Mr. Henry Dannenbaum, 1567 Wall, thanked Council for support of certification of McBride House by MHMR. Mr. Frank Kiefer, 3190 Willowood, addressed Council to pledge support of Lion' s Club members in assisting school crossing guard program for the first day of school; reported brush and high grass obscuring vision on the Northwest corner of Beard at Concord; spoke in opposition to the need of two Assistant City Managers; questioned use of the revenues generated by the additional 1/2 cent sales tax; requested Public Works enlarge trash pile size for pickup from the 41x4Ix4I before assessment of $15.00 charge stating that size is inadequate for cleaning average yards in Beaumont; and invited everyone to the "One-Five-Oh" reunion celebration Saturday, October 1st from 2: 00-5: 00 p.m. at Riverfront Park--bring your own lunches, cold drinks and enjoy the entertainment. Mr. C. L. Sherman, 585 Belvedere Drive, addressed Council to question delivery of second automated sanitation container and was told pilot program "black" cans would be collected and used in the commercial program. Mr. Fennis DuBose, 4010 Oak Grove Place, addressed Council to express his appreciation for adoption of the ordinance amending the City' s Electrical Code. -000- There being no further business, the meeting was adjourned. -000- I, Rosemarie Chiappetta, City Clerk of the City of Beaumont, Texas, certify that the above is a true copy of the Minutes of the regular City Council session held August 16, 1988.
