BE IT REMEMBERED that the City Council of the City of Beaumont, Texas, met in regular session this the 10th day of March, 1987, with the following present: HONORABLE: Maurice Meyers Mayor Bob Lee, Jr. Councilman At Large Andrew P. Haines City Manager C. Lane Nichols City Attorney -000- The Invocation was given by Pastor Delmar Dabney of Cathedral in the Pines Church. The Pledge of Allegiance was led by Councilman Samuel. -000- MAYOR MEYERS: We have two proclamations today which we will get to and present in just a moment but I think as is always the case when we have visitors away from our City as well as away from our Country who take time to visit us, we are honored by their presence and I think we have such an opportunity today with the presence of Mr. Mordechai Dolinsky. I'd like to ask Mr. Dolinsky to just for a moment to stand and be recognized so you will know of whom I am speaking. Mr. Dolinsky is in our City. He is with the Immigration and Assorption Department of the Jewish Agency in Israel and I think there is a unique story of friendship that I would ask some of the others with the Sabine Gospel Tabernacle Church to speak to in just a moment. Mr. Baxter, Reverend Hilton and Peter Hyman, the Rabbi of Temple Emanuel, is here as well as the guest but I would like to, before I ask Mr. Dolinsky or any others to come to the microphone, I will come down if I might and do what we think do well and that's show hospitality to our visitors and you commented earlier what you found about our City. We would like very much to let you consider yourself as an Honorary Citizen of our community and, in recognition of your visit, I'd like to present the "Key to our City" to you in hopes that one, you will keep it and cherish it; two, that you will use it and come back and visit us again. You might want to come forward first and kind of set the stage for how this relationship came about. I think it is most interesting and we'd appreciate hearing it. -69- March 10, 1987 THE REVEREND HEBERT HILTON, pastor of Sabine Tabernacle: Well, Mr. Mayor and members of the City Council. We consider it a real honor and a privilege to have Mordechai Dolinsky with us and we have been enjoying his speeches and it was my wife and I's privilege about two years ago to go to the land of Israel, especially Jerusalem and there, through a mutual friend of ours, we made the acquaintenance of Mr. Dolinsky. And, well, I don't know how he feels about us but we just sort of fell in love with him, his wife, and he was a very warm host and companion while we were there in Jerusalum showing us some places, taking us to some places that otherwise we would not have been permitted to have seen. So, as we started to leave, we invited him if he were ever back in the States again and, if possible, to visit in our City at our Church and so we hoped, we prayed, and we thought upon his coming and here a few weeks ago, we received a telephone call that he was in the States on official business and he thought perhaps he would have some time to visit Beaumont. So, that excited us and so, after several telephone calls and arrangements made, we picked him up in Houston yesterday afternoon. He spoke last night at our church and not only our local people but also visitors from our City and we would like to invite you, Mr. Mayor and all the City Council and everyone else to come be with us tonight. lie will be speaking and also in the morning and tomorrow night. He will be departing our City Thursday, so we are especially glad to have him here with us and we consider it a great honor and a great privilege. Thank you. MAYO ME,YERS: Thank you. Mr. Dolinsky . . . . . .? MR. MORDECHAI DOLINSKY: Just a few words. I've lived in Jerusalem for the last twenty-five years but I grew up in New York City and, as a young man, we heard frequently about Texas hospitality and most of the stories were just not believable. What I've experienced in the last day and a half goes so far beyond anything that I heard about as a young man that the essence that I will be speaking about in Jerusalem will be the hospitality of this City and the people of the church that is unbelievable. I have been . . . I am an Orthodox Jew and have constant difficulties with the food. I have a refrigerator stocked with food f ro-n the strangest places in the world, but all of it I can eat. I expected to be provided with a hotel or motel room. I was provided with my own motel, just for me alone. There's no one else in it. So, that I must tell you I expected a warm, gracious greeting but anything that has taken place is beyond anything one could possibly imagine. So, I thank all of you people in this City. Mr. Mayor, I brought you from Jerusalem an ancient glass bottle I guess you could call it which I did not expect this this morning. So, I thank you. I thank all of you for receiving me as I have been received. MAYOR MEYERS: Thank you. Well, I accept this very nice gift of thought on behalf of our Council and citizens and I would certainly appreciate you carrying back this message of friendship and if you encounter any people who are interested in starting up any new businesses in Israel - just to make sure that we don't pass up any opportunity - I was asked yesterday, you know, what else is important? And, I said you never know! -70- March 10, 1987 MAYOR MEYERS continued: And, so, maybe someone might appreciate the fact that we have an outstanding Foreign Trade Zone and the second largest port in the State of Texas and we are dying to keep it busy. So, take that along with the feeling of friendship and thank you very much for visiting with us. . . . . . We thank you, Jack, for bringing him and calling it to our attention. Peter, would you care to make any comment? RABBI PETER HYMAN, TEMPLE EMANUEL: I'm a Rabbi. Only that certainly for the entire community as has been expressed and as representative community, it is indeed a pleasure to have Mortique in our City and to again participate in bridge-building opportunities, not only with local churches and between the Jewish and Christian community, but also internationally and we are grateful for the opportunity and pleased that you have found us hospitable. That's all 1 have to say. MAYOR MEYERS: Thank you. -000- Two proclamations were issued: "American Red Cross Month in Beaumont" - March, 1987 and "Say No to Drugs Week in Beaumont" - week of March 9, 1987. -000- As a part of the Clean Community Commission's "Operation Clean Street" program, "Councilman Lee and Maree Calcote executed a contract between Mr. Larry Manley, representative of the Sertorna Club, and the City of Beaumont for his organization's volunteering to now, edge the curbs and sidewalks and clean the litter and trash from the right-of-way on Liberty Street between Willow and Magnolia Streets. --000- The follo,,iiiag items of the Consent Agenda were considered: Resolution 87-42 authorizing the pledge of $5,545,903.44 in securities and the 0 release of $5,576,190.92 in securities held as collateral for City deposits by Texas Commerce Bank of Beaumont; Resolution 87-43 appointing Bill Davis as Chairman of the Beaumont Advisory Commission for the Prevention of Child Abuse and Neglect; Resolution 87-44 authorizing the City to execute a quitclaim deed conveying Parcels 506, 507, 508, 509, 510 and 511 to the State of Texas for the Martin Luther King, Jr. Parkway/Spur 380 Project; and Resolution 87-45 authorizing a contract leasing a site on Interstate 10 just south of Laurel Avenue to Holland Advertising Company for a 'Lee of $200.00 per month. -71- March 10, 1987 Councilman Brumley made a motion, at the request of Councilman Lee, to vote on Resolution 87-45 separately; motion was seconded by Councilman Cokinos. I am, botwever, pleased to present to the City Council the City's first annual report, at least that we have record of. This is a report that differs from the Annual Financial Report that you received. It essentially highlights for our community, for oar Council, and for others, activities that have been underway in the City over the past year and particularly activities that have si.aalficant bearing as we deal with issues of debt management for ratings. And, I would like to personally commend Mrs. Dunkerley and her staff, particularly Sue Brubaker, for really having done this pretty much ins n house and wa are pleased to present that to yo,_i. It highlights again the activities of the year and then provides a su.-q-nary of the City's consolidated financial statement from the fiscal year ending September 30, 1936. We hope that we can make this a regular event. It's again a corporate report to its stock holders, so to speak. MAYOR MEYERS: Does Council have any co-,mments? COUNCILMAN LEE: Beautiful. COUNCILMAN WEISBACH: 1-m impressed. COUNCILIMCi MOORE: Really nice pictures. CITY MANASER: Betty, did you want to make any comments? -72- March 10, 1987 MRS. BETTY DUNKERLEY, Director of Finance: I will take the opportunity to say that as a department we really enjoyed working on this project and we hope that it really expresses the story of this City this year in a way that will convey to all the readers that we have our house in order and we are on our way up. MAYOR MEYERS: Well, on behalf of Council, we thank you all for your efforts and ability to come forward with a document like this. And, it's interesting. Yesterday, I received in the mail - I guess they sent it out as a promotion. I don't know if anyone else got it from Baltimore and my dream would be to see our report expand to the size of what that City has done. It would be clear evidence of matching kinds of successes. This is a beautiful piece and I think you all can be very proud of it. CITY MANAGER: I think for purposes of people gathered here, we identified some very remarkable achievements from last year. Volunteerism, the Hurricane, the financial ordering so to speak, and those are all focused on and certain themes of significance that have taken place this past year. We will make a general distribution of this to the public. We think it's important that they ,now. MAYOR-MEYERS: Thank you. -000- Ordinance No. 87-11 providing for establishment of a Marina Fund and authorizing an interfund loan in the amount of $500,000 from the General Fund and authorizing execution of a management and concession agreement with the Beaumont Yacht Club was considered: ORDINANCE NO. 87-11 ENTITLED AN ORDINANCE AUTHORIZING EXECUTION OF A MANAGEMENT AND CONCESSION AGREEMENT WITH THE BEAUMONT YACHT CLUB; AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COYMMENC- ING OCTOBER 1, 1986 AND ENDING SEPTEMBER 30, 1987 BY ESTABLISHING A NEW ENTERPRISE FUND CALLED TIRE "IV -AkINA FUND"; AUTHORIZING A LOAN OF FIVE HUINDRED THOUSAND DOLLARS ($500,000) FROM THE GENERAL FUND To THE MARINA FUND; AND AUTHORIZING THE TRANSFER OF THIRTY (30) ACRES OF REAL PROPERTY FROM THE LANDFILL FUND TO THE MARINA FUND; PROVIDING FOR SEVER&BILITY AND PROVIDING FOR REPEAL. -73- March 10, IX987 Ordinance No. 87-11 was approved on a motion made by Councilman Lee and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Ordinance No. 87-12 providing for reorganization of the Fire Department and the establishment of a new Department of Emergency Services was considered: ORDINANCE NO. 87-12 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT FOR THE FISCAL PERIOD COMMENCING OCTOBER 1 , 1986 AND ENDING SEPTEMBER 30, 1987 BY REDUCING THE NUMBER OF ALLOCATED POSITIONS IN THE FIRE DEPARTMENT, INCREASING THE NUMBER OF POSITIONS IN THE EMERGENCY SERVICES DEPARTMENT, AND AMENDING THE FISCAL LINE ITEMS OF THE BUDGET; PROVIDING -FOR SEVERABILITI AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Cokinos and seconded by Councilman Moore. Question: Ayes: All Nayes: None -000- Resolution 87-46 letting contracts with Texas Emulsions, Inc. , Port Neches, for -furnishing approximately 10,000 gallons of EA Open at $0.45 per gallon or total of $4,500.60 and with Texaco Refinery & Marketing, Inc. , Houston, for approximately 20,000 gallons MC-30 at $0. 47 per gallon or $9,400.00, 10,000 gallons RC-250 at $0.47 per gallon or $4,700.00, 500 gallons AC-5 for $0.3489 per gallon or $174.45, 500 gallons of AC-10 at $0.3447 per gallon or $172.35 and $1500 gallons of AC-20 at $0.3404 per gallon or $170. 20 (total expenditure to Texaco Refinery of $14,617.00) was approved on a motion made by Councilman Brumley and seconded by Councilman Moore. Question: Ayes: All Nayes: 'None -000- Resolution 87-47 authorizing six-month contracts with Tri Con of Beaumont for furnishing 8,000 gallons motor oil at $2.09 per gallon or $16,720.00 and 6,000 gallons at $1.80 per gallon or $10,800.00 for a total of $27,520.00 and with Martin-Matthews Oil Company of 3eaumont for 6,000 gallons automatic transmission fluid at $0.69 gallon or $4,140.00 was approved on a motion made by Councilman Moore and seconded by Councilman Weisbach. Question: Ayes: All Nayes: None -000- -74- March 10, 1987 Resolution 87-48 authorizing a project to improve drainage and sanitary sewer service by the installation of two (2) pump stations and a force main in the Westfield Terrace and Gulf Terrace Additions at an estimated cost of $130,000.00 was approved on a motion made by Councilman Brumley and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Resolution 87-49 accepting as completed the work performed under the contract with John Bankston Construction Company for the closure of the Pine Street Landfill and authorizing Change Order No. 1 at a net increase of $167,101.94 for additional cover material needed to cover the 80-acre area involved (it was determined that the landfill settled 1.5 feet after start of work on the contract May 12, 1986 - total contract to $1 ,590,098.93) and authorizing final payment to the contractor in the amount of $86,884.85 was approved on a motion made by Councilman Lee and seconded by Councilman Brumley. Question: Ayes: All Nayes: None -000- Ordinance No. 87-13 revising the schedule of fees charged for Health Department services was considered: ORDINANCE NO. 87-13 ENTITLED AN ORDINA'N'CE AMENDING CHAPTERS 11 AND 13 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT; PROVIDING FOR SEkfERABILITY AND PROVIDING FOR REPEAL. Section 11-3: health Certificates - A health certificate shall not ba required by the City of 'B2au4ant _ , ealth Departr�a�it. Any person may obtain a health certificate from the ,Health Department of the City on a voluntary basis . . . Section 13-17 : Waiver of Fee - The STD Treatment Fees and Pregnancy 77est Fees established in Section I3-17 herein may be waived by the Director of the Department of Health upon proof by the patient that such patient is unable to pay such fee. Such proof may be provided by execution of a sworn statement containing facts sufficient to establish that such patient is unable to pay such fee. -75- March 10, 1987 Councilman Weisbach expressed her concerns for the charge for STD (sexually transmitted diseases) saying that she doubted that those needing the test and treatment would seek help with a charge for the service. Ordinance No. 87-13 was approved on a motion made by Councilman Moore and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- An ordinance abandoning a portion of a 15-foot utility easement between Lots 14 and 15, Block 4, Westmont Addition, was considered: AN ORDINANCE ENTITLED Ali ORDINANCE VACATING AND ABANDONING THE NORIa 2-1/2 FEET OF A 15-FOOT UTILITY EASEMENT BETWEEN LOTS 14 AND 15, BLOCK 4, WESTMONT ADDITION AND LOCATED AT 3055 WESTMONT, BEA-TMONT, JEEFFE7(SON COUNTY, TEXAS, AND -P?,&11D- !NG FOR RETENTION OF A UTILITY EASEMENT. After a lengthy discussion by Council of staff's recommendation not to abandon the easement because of an 3-inch sanitary sewer line in the easement and the possibility of the City-s liability for any damaores to the residence that could result from maintenance work on the line and the opinion by the City Attorney unless Council de-larmi-ned there was no public need for the easement, it would be an illegal act to abandon City right-of-way for the benefit of one property owner, and that the Staff suggestion that a License to Encroach agreement be so-aght by the applicant if sufficient to clear title for refinancing of the property, it was decided to delay action on the ordinance for one week for staff to seek alternatives on a motion made by Council-iman Cokinos and seconded by Councilman Lee. Question: Ayes: Mayor Meyers Nayes : Co-uncil-an Lee Councilman Cokinos Councilman W`e[sbach Council.-man Brumley Councilman Samuel Councilman Moore -76- (larch 1 D, 1987 Ordinance No. 87-14 amending the Flood Hazard Areas Ordinance was considered: ORDINANCE NO. 87-14 ENTITLED AN ORDINANCE AMENDING CHAPTER 6, OF THE CODE OF ORDINANCES OF 'Ir'RE CITY OF BEAUMONT CONCERNING THE FLOOD HAZARD AREA; PROVIDING FOR SEIVIERkBILITY AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Samuel and seconded by Councilman Lee. Question: Ayes: All Nayes: None -000- Resolution 87-51 authorizing execution of an Interlocal Agreement with Jefferson County for participation in construction of Interstate 10 access roads between F.M. 364 and Brooks Road (provisions are that if County funds are used for construction of the access roads, the cost will be credited against the County's obligation to any Tax Increment Financing District created for the area served by the access roads until their total obligation to the fund exceed $1 .2 million was approved on a motion made by Councilman T and seconded by Councilimarn Brumley. Question: Ayes: All -Nayes: None -000- Councilman Cokinos asked the City Manager to send a letter of appreciation on behalf of the City of Beaumont to the Port Arthur, Nederland, Fort N--ches, Orange and Drainage District 10 Fire Departments for sending fire equipment to to assist the Beaumont Fire Department in extinguishing the 3-alarm fire March 9th in the Downtown Beau mont area. '.ee reported that all twenty-four (24) volunteer groups of the Operation Clean Street program would be working on Saturday, March 14th, from 9:00 a.m. to noon. He invited representatives of the News fedia to a briefing of locations - over coffee and donuts - at the Fire Museum of Texas at 9:30 a.m. on the 14th and a tour of work in progress by the various groups. Councilman Samuel reported to Mrs. Magee Calcote, Chairman of the Clean Community Corlmission, that he had received a call from a Mrs. Frazier, 2024 Glasshouse (832-3546) who said she has had a recurring problem with litter being placed in the ditch which causes drainage problems. Councilman Samuel said th9t. 74rs. Frazier and several of her neighbors have repeatedly cleaned the ditch but apparently need enforcement of the litter laws to help correct the problem. In addition, he asked that the Public Works Department look at the drainage situation. Councilman Moore requested that the canopy portion of a dilapidated structure scheduled for demolition that is located at De Villeneuve and Irving be removed by City crews because it is hanging over power lines and is a definite safety hazard to those in the area. -77- March 10, 1987 Councilman Cokinos questioned the status of the traffic signal light on Dowlen and Daisy. Mr. Tom Warner, Public Works Director, answered that the study should be completed and an answer to Council by the end of the week. Councilman Brumley reported that he and Councilman Lee, in attending the National League of Cities Conference held in Washington, D. C. last week., met 0 with extremely positive attitudes and enthusiasm and curiosity for the great success of Beaumont's LEconomic Summit No. 1 , saying that news had travelled before either he or Mr. Lee could mention the event and were asking how they could participate in Summit No. 2. 0 Mayor '4eyers questioned Mr. Warner about the status of the Gladys project from Dowlen to Major Drive. Mr. Warner said that the State opened the street yesterday and that the contractor is still in the process of moving some of the barricades, etc. , but that the permanent 35 mph signs would be installed soon. In addition, Mr. Warner told of contact with the School District concerning children who may be crossing the street to get to school buses or to the school itself. '11AYOR MEYERS: The second thing that I'd like to mention we are today going to discuss the question of the sales tax options in our Workshop and I thin',, it is appropriate that prior to that discussion that we take a "Look at what I think is yet another piece of our economic development efforts and a program that might offer us opportunity to look to the future in planning as it relates to our tax struct�:re and I sense that we should be the agressor and take the lead in trying to see how we might structure a phased-in reduction plan. I don't suggest anything coming in to it. I think we need to be as concerned with it as we would have to be but I think the -Message that we are getting back is all positive. I think as he is outlining it, I think our abatement program Speaks to that and I would ask that we take a look at something say over a five-year span. CITY MANAGER: I think it's appropriate that you mention it today, Mayor. We've, as I am sure that Council is aware, one of the new Charter provisions mandated a five- year budget and I think it is appropriate as we are getting close to presenting that five--year plan to Council, we'll certainly put that into the , formula and perhaps suggest some alternatives relative to a spending reduction program. MAZOR I think the second thing that you've discussed and mentioned which I think is scheduled and what you've had to do and all you've had to do hasn't really L been able to show through, but I think that the management programs that you are going to putting in place and the elevation of productivity throughout and that continuing desire for excellence I think can -easily balance some very conservative approach as we 'Improve productivity and levals of performance throughout and I think It is a good tiTie for us to begin that. And, I think as you mentioned, within that five-year plan, it's appropriate. -73- March 10, 1357 Councilman Moore asked the status of the speed limit and/or school crossing guard study being conducted on South 8th and Corley Streets. —000— Mr. C. L. Sherman, 585 Belvedere, addressed Council to say that after a year of being in the sanitation pilot program area, the program is working better than he expected. In addition, Mr. Sherman said that one question that should have been included in the questionnaire sent to those within the pilot program -area was whether citizens would prefer twice a week pickup from a private carrier at a cheaper price than the once a week pickup by the City. Mrs. Delia Harrington, 815 Willow, addressed Council to complain about the poor quality of the public address system in the City Council Chambers and to also suggest that low rent housing projects being constructed include areas for community gardens. Mrs. Maree Calcote, Chairman of the Clean Community Con.mission, invited all on Friday, March 13th, to meet and hear the in—coming president of "Keep Texas Beautiful" who will speak about some of the things that the State is doing to help Beaumont in our clean—up efforts at lunch at St. Mark's Episcopal Church, 6$0 Calder. Mrs. Calcote said that Mrs. 'Paula Cott, the District 16 Governor of Keep Texas Beautiful will also be present as well as representatives from eight counties who have been invited. Reservations for lunch will be needed and the fee will be $5.00. Mr. Mark T efferson, 229 Orleans (Kyle Building), Fame Hair Designs or Fame Uptown, addressed Council to express his thanks as a small business and to relate the positive feedback from the Economic Summit that he is hearing from 'nis clientele for the positive support and attitudes of Council toward small businesses and the City as a whole. Mr. Bob Parks, 5155 0�rgain, CDmaoudore for the Beaumont Yacht Club, addressed C_-x2ncil I i-1 appreciation for the action talken today concerning the Marina ! expanslI an and lease.. Mr. dig: Snell, Port Arthur resident with his business jocated in at 1290 S. 11th Street, addressed Council to say that he has stored his boat at Galveston for the past 5 years and is look-inor fo_rward to moving it to the Beaumont Marina.
