The City of Beaumont has been a participant in the Ambulance Service Supplemental
Payment Program (ASSPP) since FY 2016. This program allows for a supplement
payment to governmental ambulance Medicaid Providers whose allowable costs exceed
the fee-for-service revenues during a specific period. In prior years, this payment has
been based on Medicaid and uninsured transport, however, in FY 2020 the program
moved to a charity reimbursement methodology. As a result, on October 1, 2019, the City
of Beaumont established a Charity Care Policy providing guidelines to determine eligibility
for a charity care patient.
Central Collections in collaboration with Revenue Optimization Solutions, Inc., LLC may
classify a patient as charity if the patient meets the following requirements: uninsured,
collection efforts result in no payment over a 60-day period and the payment predictor
model results in a low or medium designation of likelihood of payment. Once a patient is
determined to be charity care, no further attempts will be made to collect from the patient.
There’s a list of 1057 EMS runs totaling $1,417,340.00 from July 1, 2025, to June 30,
2026, that have been identified as charity care patients. The supplemental payment for

6.Council to consider an ordinance approving an amendment to Chapter 22 of the Code of
Ordinances, Article 22.03.005(d)(2) Industrial Waste Standards.
The Texas Commission on Environmental Quality (TCEQ) recently conducted an audit of
the City’s Pretreatment Program. As part of the audit, TCEQ reviewed the City’s Industrial
Waste Ordinance and identified a discrepancy in the table of technically based local limits
contained in Section 22.03.005(d)(2). The requested modifications can be found in the
attached TCEQ Pretreatment Program Audit Report found in section H (2).
The ordinance currently lists Biochemical Oxygen Demand (BOD), Chemical Oxygen
Demand (COD), and Total Suspended Solids (TSS) among the City’s technically based
local limits. TCEQ determined that these three parameters are surcharge parameters
rather than prohibited discharge limits regulated by the city as enforceable local limits.
To properly distinguish surcharge parameters from enforceable local discharge limits,
TCEQ has required the city to amend the ordinance and remove BOD, COD, and TSS
from the table of local discharge limits. This amendment is primarily a clerical and
regulatory clarification and does not change the City’s remaining enforceable technically
based local limits.
The proposed ordinance amendment would revise Section 22.03.005(d)(2) by removing
the following parameters from the table of technically based local limits:
Biochemical Oxygen Demand (BOD) - 250 mg/l
Chemical Oxygen Demand (COD) - 550 mg/l
Total Suspended Solids (TSS) - 300 mg/l
Approval will bring the City's Industrial Waste Ordinance into compliance with the findings
of the recent TCEQ Pretreatment Program Audit and ensure that Section 22.03.005(d)(2)
accurately identifies the City's enforceable technically based local limits.
Staff recommend approval of the proposed ordinance amendment.
Councilmember Crenshaw moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE
REPEALING THE CURRENT ORDINANCE FOR CHAPTER 22 OF THE CODE OF ORDINANCES, ARTICLE
22.03, SECTION 22.03.005(D)(2) INDUSTRIAL WASTE STANDARDS TO COMPLY WITH TCEQ AND
EPA REQUIREMENTS. Councilmember Hilliard seconded the motion.

PUBLIC HEARING
Council to conduct a Public Hearing to receive public comments regarding proposed
modifications to BMT Zip transit services, including the realignment of certain fixed bus
routes and changes to Saturday operating hours
Public Hearing Open: 6:25 p.m.
Cynthia Julen3585 N. Major Dr.Beaumont TX
JoAnn Arvey858 Phelan Blvd.Beaumont TX
Public Hearing Close: 6:28 p.m.
7.Council to consider a resolution authorizing proposed modifications to BMT Zip transit
service, including the realignment of fixed bus routes and amending Saturday operating
hours.
The Zip Service Optimization Plan proposes adjustments to improve transit system
efficiency and connectivity while concentrating service during periods of greatest use. The
plan would combine the existing Magnolia and Pine routes into a single Magnolia/Pine
Route and extend the Laurel/N. 11th route west along Delaware Street to Dowlen Road,
northeast on Dowlen, and south along the Eastex Feeder Road before reconnecting with
the existing route. The extended route would be renamed the N. 11th/Dowlen Route.
These realignments are intended to provide riders with improved access to employment,
grocery stores, shopping, dining, and entertainment, while creating additional transfer
opportunities that do not require riders to return downtown to the Dannenbaum Transfer
Station. For some passengers, the changes could reduce a two-trip journey to a single
trip.
The plan also proposes modifying Saturday service hours only by adjusting from the
current 7:15 a.m.–9:30 p.m. schedule to 7:00 a.m.–6:00 p.m. The proposed changes will
not eliminate Special Transit Services (STS); STS would continue to operate concurrently
with the transit schedule adopted by City Council, with required annual recertification.
If approved, the proposed adjustments will be effective October 1, 2026.
The proposed plan is anticipated to reduce expenditures in the Municipal Transit Fund by
approximately $91,000 in FY 2027.
Approval of the resolution.
Minutes – September 22, 2026

provide additional information regarding the extended hours at the next regularly

MEETING DATE:October 6, 2026
REQUESTED ACTION:Council to consider a resolution authorizing eminent domain
proceeding to acquire a Utility Easement located at 977
Forrest Street.
BACKGROUND
In August 2025, Archie Ray Victoria, owner of the property located at 977 Forrest Street,
contacted the Public Works Department regarding concerns that electrical lines
associated with the lift station located at the corner of Forrest Street and Long Avenue
were hanging at a low height.
After evaluating the site, City staff determined that the electrical service and control box
could be relocated closer to the lift station and fencing installed around the facility if a
utility easement could be obtained from the property owner. These improvements would
improve access control and allow the electrical equipment to be relocated within the
proposed easement area. The property owner initially indicated a willingness to convey
the utility easement.
On November 19, 2025, the City initiated efforts to acquire a utility easement across the
property located at 977 Forrest Street. Between November 19, 2025 and August 3, 2026,
City staff made multiple attempts to contact the property owner to negotiate the easement
acquisition. Communications were sent by certified mail, regular U.S. mail, telephone,
and hand-delivered correspondence to the owner’s mailing address at 4910 Avie Lane,
Beaumont Texas. The property owner did not respond to these communications.
The subject property was appraised by Cook & Associates, Inc. as follows:
Parcel #: 50122
Legal Description: 1400.12 Square Feet (0.0321-Acre) Utility Easement,
Out of and Part of Lot 1, Block 15, situated in the Jirou Addition
Owner: Archie Ray Victoria
Value: $2,000.00
Because the property owner has not conveyed the utility easement needed for the
proposed improvements, the City must initiate eminent domain proceedings to acquire
the required easement.
Under Texas law, the exercise of eminent domain authority must be authorized by the
governing body through a specific motion and recorded vote. Staff therefore requests City
Council authorization to proceed with the acquisition of the utility easement through
eminent domain.

MEETING DATE:October 6, 2026
REQUESTED ACTION:Council consider a request for a Rezoning a portion of a
property from R-S (Residential-Single Family Dwelling) to GC-
MD (General Commercial-Multiple Family Dwelling) or a more
restrictive zoning district for property located at 3750 E. Lucas
Drive.
BACKGROUND
Soutex Surveyors, on behalf of the Pioneer Presbyterian Church, is requesting approval
of a Rezoning of approximately two (2) acres of land located behind the church at 3750
East Lucas Drive from R-S (Residential-Single Family Dwelling) to GC-MD (General
Commercial-Multiple Family Dwelling) or a more restrictive zoning district. The purpose
of the request is to allow for the entire church property to be zoned commercial.
According to the Comprehensive Plan the property is located within a Stable Area, “these
are built up areas which are generally characterized by good to excellent structural
conditions and neighborhoods that are free from blighting influences such as incompatible
land uses, dilapidated and delict buildings and a deteriorated or poor public infrastructure.
Vacant parcels which may exist are good to excellent development areas.” Commercial
development along this corridor is appropriate given its proximity to Concord Road and
the Eastex Freeway, with consideration encouraged to ensure compatibility with nearby
residential uses to the north and west.
At a Joint Public Hearing held on September 21, 2026, the Planning Commission
recommended 6:0 to approve the request for a Rezoning a portion of a property from R-
S (Residential-Single Family Dwelling) to GC-MD (General Commercial-Multiple Family
Dwelling) or a more restrictive zoning district for property located at 3750 E. Lucas Drive.

MEETING DATE:October 6, 2026
REQUESTED ACTION:Council consider an ordinance adopting the City of Beaumont
Comprehensive Plan.
BACKGROUND
The City of Beaumont initiated an update to its Comprehensive Plan to establish a long-
range vision and policy framework to guide the City’s future growth, development,
mobility, infrastructure, and quality of life. Developed with extensive input from the
Comprehensive Plan Steering Committee, focus groups, residents, stakeholders, and
City staff, the updated Plan reflects the community’s priorities and establishes goals and
recommended actions for Beaumont’s future. The Comprehensive Plan serves as a
guiding document for City decision-making and does not, by itself, appropriate funding or
require implementation of individual projects. Recommended actions will be considered
over time based on available resources and City Council priorities through the annual
budget, Community Investment Plan, Strategic Plan, and other future actions of City
Council.
Able City, LLC was engaged by Resolution No. 25-173 to assist the City with development
of the updated Comprehensive Plan. All costs associated with the Plan are fully funded
by the $300,000 grant awarded to the City through the Texas General Land Office’s
