RESOLUTION NO. 26-211
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
WHEREAS, on March 18, 2025, by Resolution No. 25-045, City Council awarded a
contract to SETEX Construction Corp., of Beaumont, Texas, in the amount of $283,521.76, for the
Highway 124 12-Inch Water Main Replacement (From Phelps Road to Downs Road) Project;
and,
WHEREAS, previous Change Order Nos. 1-2, increased the contract amount to
$308,594.41; and,
WHEREAS, proposed Change Order No. 3, in the amount of ($2,910.00), is required to
adjust the estimated quantities in the contract to reflect the actual quantities used in the completion
of the project and to add one hundred and twenty-eight (128) calendar days to reflect the actual
days used. If approved, the final contract amount will be $305,684.41.
WHEREAS, the project has been inspected by the Water Utilities Staff and found to be
complete in accordance with the provisions and terms set out in the contract.
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT the City Manager be and he is hereby authorized to accept Change Order No. 3, in
the amount of ($2,910.00), accept maintenance, and make final payment to SETEX Construction
Corp., of Beaumont, Texas, in the amount of $15,284.22, for the Highway 124 12-Inch Water Main
Replacement (From Phelps Road to Downs Road) Project; and,
