A Public Hearing of the Planning Commission was held on March 16, 2026 and called to order at
3:00 p.m. with the following members present:

APPROVAL OF MINUTES
Commissioner Linton moved to approve the minutes of the Joint Public Hearings held on February
23, 2026. Alternate Commissioner Beatty seconded the motion. The motion to approve the minutes
carried 5:0.

: Request for approval of a Replat of Lot 5, Major Drive Office Park Addition,

Addition, Beaumont, Jefferson County, Texas.
Applicant: Charles Weinbaum, Weinbaum Building, LTD
Location: 1726 N Major Drive
Mrs. Engman presented the staff report. Charles Weinbaum, of Weinbaum Building LTD, is
seeking approval of a Replat of Lot 5, Major Drive Office Park Addition, Beaumont, Jefferson
County, Texas into Lots 5-A and 5-B, Major Drive Office Park Addition, Beaumont, Jefferson
County, Texas containing 0.943 acres more or less. The intent of the replat is to divide a single lot
into two (2) lots separating an existing cell tower lease from the remainder of the property to allow
for future commercial development.

for a lot within a GC-MD (General Commercial Multiple-Family Dwelling) zoning district was
considered and approved at the Board of Adjustment meeting held on March 5, 2026.
Slides were shown of the site plan, subject properties and surrounding areas.
Planning staff recommended approval of this request.
Twenty-two (22 notices were mailed to property owners within two hundred (200) feet of the
subject property. Zero (0) responses were received in favor and zero (0) were received in
opposition.
A representative of the applicant was present. Wesley Berlin of Spartan Engineering Solutions,
2583 Pine Bluffs Court, Highland, Michigan addressed the Commission. He stated that his client,
Auto Zone, is under contract to purchase the southern portion of the property for construction of a
new Auto Zone store. Mr. Berlin further stated that Mr. Weinbaum will retain ownership of the
cellular tower lot. He also stated that the applicant, Charles Weinbaum, was present should the
Commission have further questions.
The public hearing on this item was opened and closed without comment.
Commissioner Linton moved to approve the request for a Replat of Lot 5, Major Drive Office
Park Addition, Beaumont, Jefferson County, Texas into Lots 5-A and 5-B, Major Drive Office
Park Addition, Beaumont, Jefferson County, Texas, as requested in PZ2026-48.
Commissioner Little seconded the motion. The motion to approve the request carried 5:0.
2) PZ2026-50
: Request for approval of a Replat of Lots 20 & 21, Block 1, Deerfield
Addition Phase Four, Beaumont, Jefferson County, Texas into Lot 21-A, Block 1,
Deerfield Addition Phase Four, Beaumont, Jefferson County, Texas.
Applicant: Access Surveyors
Location: 8310 Chappell Hill Drive

Mrs. Engman presented the staff report. Access Surveyors, on behalf of the property owners Ali
and Hanan Hamdan, are seeking approval of a Replat of Lots 20 & 21, Block 1, Deerfield Addition
Phase Four, Beaumont, Jefferson County, Texas into Lot 21-A, Block 1, Deerfield Addition, Phase
Four, Beaumont, Jefferson County, Texas containing 0.563 acres more or less. The intent of the
replat is to combine the two (2) residential lots into one.
It should be noted that abandonment of an easement is requested through a separate planning
application.
Mrs. Engman stated that the property within the perimeters of this replat request has charges
pending in Municipal Court due to present zoning code violations.
Staff recommended approval of the request with the following conditions:
1.

areas which would interfere with the use and maintenance of said easements. The city is
not responsible for repairs or damages to a

3. Shall add a plat note stating

Planning and Community Development prior to final recordation of the plat at the Jefferson
County Courthouse.
Slides of the site plan, subject property and surrounding area were shown.
Sixteen (16) notices were mailed to property owners within two hundred (200) feet of the subject
property. Zero (0) responses were received in favor and three (3) were received in opposition. One
response stated that it is preferred that the property remain for the purpose of housing development
only. One response in opposition stated that there is long term use of a shipping container on Lot
20 and they expect business use of a future large shop if the residential lots are combined.
Brief discussion followed concerning the proposed added condition number 4 as it relates to the
shipping container located on the property and the pending Municipal Court zoning violations,
allowed usage of a shop should one be constructed, and the removal of trees and shrubs located
within an easement as noted in condition number 3.
The applicant was present. Mitch Brackin, of Access Surveyors, 11025 Old Voth Road, Beaumont,
Texas addressed the Commission. He stated that Access Surveyors has already addressed

conditions 1-3 and will address added condition 4. Mr. Brackin had no additional information to
add.
Property Owner Ali Hamdan, 8310 Chappell Hill Drive, Beaumont, Texas addressed the
Commission. Mr. Hamdan stated that he understands that the storage contain has to be removed
from the property. He further stated that he would like to combine the two lots into one in order to
construct a garage. Mr. Hamdan also stated that once the garage is built, he will empty the storage
container and remove it from the property. He stated that he was told by the City that it was okay
to have a storage container on the property as long as it was not located near the street, however,
Mr. Hamdan stated that he agrees with the conditions

recommended by staff.
Further discussion followed concerning City ordinance as it relates to storage containers, resolving
the storage container zoning violations prior to the property replat being filed, and a grace period
W\\!eVWQV!b\]!\[\]dS!bVS!^`\]^S`bg!\]e\\S`ka!PSZ\]\\UW\\Ua*
The public hearing on this item was opened.
Dilcia Cruz, 6160 Bonner Drive, Beaumont, Texas addressed the Commission. Ms. Cruz stated
that her home is currently for sale and prospective buyers had provided negative comments
regarding litter at 8310 Chappell Hill Drive.
Frank Owens, 8335 Chappel Hill Drive, Beaumont, Texas addressed the Commission. Mr. Owens
stated that he is opposed to the request. He further stated concerns of litter on the property and
decreased property value.
The property owner did not speak in rebuttal.
The public hearing on this item was closed.
Further discussion followed concerning a time frame in which to remove the storage container.
Attorney Reed explained the Court process as it relates to the zoning violation charges and spoke
to specifics of the replat request. Mrs. Engman provided further information relating to specifics
of the replat request and the four (4) conditions.
Commissioner Linton moved to approve the request for a Replat of Lots 20 & 21, Block 1,
Deerfield Addition Phase Four, Beaumont, Jefferson County, Texas into Lot 21-A, Block 1,
Deerfield Addition Phase Four, Beaumont, Jefferson County, Texas, as requested in PZ2026-50,
with the following conditions:
