A Joint Public Hearing of the Planning Commission and City Council was held on February 23,
2026 and called to order at 3:03 p.m. with the following members present:

APPROVAL OF MINUTES
Alternate Commissioner Senigaur moved to approve the minutes of the Joint Public Hearings held
on January 26, 2026. Alternate Commissioner Sorrell seconded the motion. The motion to approve
the minutes carried 6:0. Chair Makin not yet present.
REGULAR MEETING
1) PZ2025-385:
Request for approval of an Abandonment to a portion of the unimproved
right-of-ways for Ocean Street and Rainbow Street.

Mrs. Engman presented the staff report. Zach Rowe of Leavins Engineering & Design, LLC, on
behalf of Bevilport, LLC, is requesting an Abandonment to a portion of the unimproved right-of-
way to both Ocean Street and Rainbow Street located in Beaumont, Jefferson County, Texas.
Bevilport, LLC, is the sole landowner abutting said rights-of-way and is seeking abandonment of
them for commercial development.

A general utility easement exists beginning at the eastern edge of the South 23 Street right-of-
of both Ocean and Rainbow Street

rights-of-way. The easement continues further east and terminates at the property line and the

Slides were shown of the site plan, subject properties and surrounding areas.
Planning staff recommended approval of this request with the following conditions:
1. If approved, the applicant shall obtain an appraisal and title search report for the property
to be abandoned at their expense. Appraisal and title search report must be submitted to the
planning office along with proof that payment has been arranged prior to the item being
placed on the City Council agenda.

opposition stated that this is their driveway, would like to purchase the property themselves and
that they do not want the street opened.

The applicant was present. Zach Rowe, of Leavins Engineering & Design, LLC, 3250 Eastex
Freeway, Beaumont, Texas addressed the Commission. He stated that he had nothing to add to the
report from staff.
Discussion followed concerning location of the requested abandonment.
The public hearing on this item was opened.
Avis Chaisson, 2828 Woodside Street, Dallas, Texas addressed the Commission. She stated that
her parents are interested in purchasing property south of the property the applicant is requesting
to be abandoned and wishes to confirm that the abandonment does not include the existing paved
driveway and dead end of Rainbow Street.
Al Bernard, 4520 Cartwright Street, Beaumont, Texas addressed the Commission. Mr. Bernard
requested general information relating to the definition and process of abandonments.
Roy Adams, 4310 Corley Avenue, Beaumont, Texas addressed the Commission. Mr. Adams stated
that he is interested in purchasing the alleyway located on Rainbow Street and requested additional
information relating to the abandonment.
Chair Makin arrived at 3:11 pm.
The applicant was given the opportunity to speak in rebuttal. Mr. Rowe stated that the
abandonment will not directly affect Corley Avenue nor did it include the existing built out
portions of Rainbow and Ocean Streets and provided other specifics related to the request.
The public hearing on this item was closed.
Mrs. Engman explained the abandonment process and how it relates to the requested item.
Commissioner Little moved to approve the request for an Abandonment to a portion of the
unimproved rights-of-way for Ocean Street and Rainbow Street, as requested in PZ2025-385, with
the following conditions:
1. If approved, the applicant shall obtain an appraisal and title search report for the property
to be abandoned at their expense. Appraisal and title search report must be submitted to the
planning office along with proof that payment has been arranged prior to the item being
placed on the City Council agenda.

Request for approval of an Abandonment to the unimproved Mildred Street
right-of-way.
Applicant: Michael Prudhomme

Mrs. Engman presented the staff report. Michael Prudhomme, is requesting an Abandonment of
-of-way, south of his property at 4430 Bob Street. The

right-of-way, and it appears surrounding property owners have been using the area in relation to
their residences.
It should be noted that an abandonment of the unimproved right-of-way as proposed would create
two land locked parcels owned by abutting property owners on Cadillac Lane.

Planning staff recommended approval of this request with the following conditions:
1. If approved, the applicant shall obtain an appraisal and title search report for the property
to be abandoned at their expense. Appraisal and title search report must be submitted to the
planning offices along with proof that payment has been arranged prior to the item being
placed on the City Council agenda.
2. If approved, a Replat is required to combine the two parcels fronting the Mildred Street
right-of-way to comply with Chapter 26 of the City of Beaumont Code of Ordinances. A
complete plat application must be submitted to the Planning offices prior to the item being
placed on the City Council Agenda.
Six (6) notices were mailed to property owners immediately adjacent to the unimproved right-of-
way. Zero (0) responses were received in favor and two (2) were received in opposition. One
response in opposition stated that the request hinders the owners of the Mildred lots from future
development due to lack of property access and another response in opposition stated that they
would like to have access to their property from Bob Street.
The applicant was present. Michael Prudhomme, 4430 Bob Street, Beaumont, Texas addressed the
Commission. He stated that he has cleared the property and maintained the property for years and
wishes to construct two (2) homes on the lot. Mr. Prudhomme further addressed access to the
property by surrounding property owners. He also stated that he agrees to the conditions
recommended by staff and will stay within the original intent of the request.

Brief discussion followed concerning a small structure located at the rear of the property, with
Mrs. Engman noting that should the requested item be denied, a License to Encroach may become
necessary for the structure to remain on the property.
The public hearing on this item was opened.
The following individuals addressed the Commission in opposition to the request by expressing
concerns of accessibility to their property, loss of property value, along with opposition to a Replat
of the property because it will limit future development:

The applicant was given the opportunity to speak in rebuttal. Mrs. Donna Prudhomme (4430 Bob
Street, Beaumont, Texas), stated that she and her husband do not want to cause opposition with
their neighbors and addressed upkeep of the Mildred Street portion of the property. She
additionally expressed concerns of suspicious activity and abandoned cars on the property. Mrs.
Prudhomme also said they do not wish to land-lock the surrounding property owners.
The public hearing on this item was closed.
Further discussion followed concerning specifics of the request.
Commissioner Senigaur moved to deny the request for an Abandonment to the unimproved
Mildred Street right-of-way, as requested in PZ2026-6.
Commissioner Templeton seconded the motion. The motion to deny the request carried 7:0.

Mrs. Engman presented the staff report. The property owner, Kevin Benton is seeking approval of

a Replat of Lots 21-24, Block 121, Cartwright 2 Addition, Beaumont, Jefferson County, Texas

into Lots 21A and 21B, Block 121, Cartwright 2 Addition, Beaumont, Jefferson County, Texas
containing 0.32 acres mor or less. The intent of the replat is to combine four lots into two and
construct single family homes on each lot.

Commission. Mr. Benton stated that he agrees to the conditions recommended by staff.

Location: The southernmost 25.1 acres of 87.28 acres at approximately the Northwest
intersection of Northwest Parkway and Pointe Parkway
Mrs. Engman presented the staff report. Ripley Woodard, of Meta Planning + Design, on behalf
of Binnacle Development, LLC, is seeking approval of a Preliminary Plat of Belle Terre, Section
1, a Planned Unit Development in Beaumont, Jefferson County, Texas, along with two (2) waiver
request.
Section 1 of the development will consist of 115 new residential lots, with a mix of lot sizes

1. A waiver to increase the maximum number of lots served by a single outlet street from 32
to 115. Future phases of the development shall provide additional outlets.
2. A waiver to allow Ellis Ridge Trail to function as residential streets rather than collector
streets. A collector street shall be installed on phase 2 of the subdivision.
Engineering and Fire Department staff have reviewed the request and have indicated no objections
to the proposed waivers.
It should be noted that a Traffic Impact Analysis (TIA) will be required to evaluate traffic impacts
at the Northwest Parkway intersection. Additionally, a capacity study will be required for the
overall master plan to ensure adequate infrastructure capacity for the proposed development.

Sam Parigi, 4450 N. 14 Street, Beaumont, Texas addressed the Commission. Mr. Parigi stated
that he represents the owners of the tract of land, along with an additional surrounding 165 acres
of property. He further stated that he agrees with the request and it will jump start development of
the Pointe Parkway area.

Location: The Northern portion of the 17.449 acre tract East of 9195 Dishman Road
Mrs. Engman presented the staff report. Philip Jacobs of Schaumburg & Polk, Inc., is seeking
approval of a Preliminary Plat of The Meadows Subdivision, Phase 1, East Beaumont, Jefferson
County, Texas. Phase one will consist of nineteen (19) single-family residential lots located on

Mrs. Engman presented the staff report. Maria D. Garcia, on behalf of Lamar University, is

an abandonment of a portion of Oregon Avenue between Cunningham Street and Rolphe
Christopher Drive allowed for the construction of the existing parking lot. The proposed
abandonment will allow for the University to proceed with plans to develop a new music annex
building within the existing parking lot.

1. Lamar University shall be responsible for abandoning the existing sanitary sewer line by

behalf of Bevilport LLC, is requesting approval to rezone the property located west and south of
4195 Milam Street. The request would change the zoning from RM-H (Residential Multiple
Family-Highest Density) District to GC-MD-2 (General Commercial-Multiple Family Dwelling-
2) District for the southernmost 100 feet, totaling approximately 4.623 acres, and to GC-MD
(General Commercial-Multiple Family Dwelling) District for the remaining 42.038 acres.
The purpose of the rezoning is to allow for future commercial development. The proposed GC-
MD-2 area is intended to serve as a controlled buffer between future commercial uses of the subject
site and the existing residential uses facing Corley Avenue. The GC-MD-2 zoning district requires
a Specific Use Permit for all new land uses.

property. Zero (0) responses were received in favor and six (6) were received in opposition. The
responses in opposition expressed concerns of potential density of dwellings, safety and potential
property tax increases.
The applicant was present. Zach Rowe, of Leavins Engineering & Design, LLC, 3250 Eastex

Freeway, Beaumont, Texas addressed the Commission. He stated that the Milam Street and 23
Street area will contain 5,000 sq. ft. warehouses. Mr. Rowe further stated that there are presently
no future development plans for the remainder of the property.
Brief discussion followed concerning the proposed buffer, potential future development plans and
future installation of a detention pond.
Property Owner Rod Carroll, 1208 Roll Road, Beaumont, Texas addressed the Commission. Mr.
Carroll stated that he has owned the property for twenty (20) years. He further stated that he is in
preliminary discussions with Jefferson County Drainage District No. 6 for the purchase of twenty-
two (22) acres for a detention pond to assist with any future flooding.

of traffic safety, adequate ingress/egress, drainage and flooding, changes to the dynamic of the

currently zoned for multi-family housing, therefore, it could currently be developed as an
apartment complex once permitted by the City. He is requesting that permission be granted for

commercial use be allowed as well. Mr. Rowe further stated that both commercial and multi-family
housing would be anticipated to generate the same amount of traffic. He also stated that Jefferson
County Drainage District No. 6 is interested in use of a portion of the property for construction of
a detention pond regardless of development of the property. Mr. Rowe further noted that any
permitting would be required to be reviewed and approved by the City. He also stated that due
diligence will be exercised to ensure that the existing pipelines will not be disturbed. Mr. Rowe
stated that parcelization of the property took place in approximately 1940 when the area was
originally sub-divided.
Brief discussion followed concerning the owner considering a GC-MD-2 zoning for the property,
zoning of surrounding properties and specifics of the request.
