The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance
with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on January 6,
2026, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to
consider the following:

Mayor West called the council meeting to order at 1:30 p.m.
Rev. Torey Doucette with New Birth Community Baptist Church gave the invocation. Mayor
West led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor West, Mayor Pro Tem Turner, Councilmembers Durio,
Hilliard, Williams, Sherwood and Crenshaw. Also, present were Kenneth R, Williams, City
Manager; Sharae Reed, City Attorney; Tina Broussard, City Clerk.
Mayor West read the announcement regarding Executive Session being held after the
conclusion of Councilmember Comments.

Mayor Pro Tem Turner moved to approve Consent Agenda Item F with additional
language regarding reimbursement after a ninety 90-day period, “that a request to submit
reimbursements after ninety (90) days must be submitted in writing prior to the deadline,
and good cause for the exception must be provided and approval is at the sole discretion
of the city”. Councilmember Durio seconded the motion.

Resolution 26-005
REGULAR AGENDA
1.Council to adopt the rules for the Bond Facilitation Committee.
At the October 10, 2025, meeting, the Council voted to create a Bond Facilitation
Committee and appointed members. The adoption of these rules would also amend
Resolution 25-243 to include two (2) year terms for all members.
Councilmember Durio moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY
ADOPTS THE RULES FOR THE BOND COMMITTEE, AND THAT THE ADOPTION OF THESE RULES
SHALL AMEND RESOLUTION 25-243 TO INCLUDE TWO (2) YEAR TERMS FOR ALL MEMBERS, EACH
TERM BEGAN ON NOVEMBER 5, 2025, AND WILL EXPIRE NOVEMBER 5, 2027, WITH AN
AMENDMENT TO ITEM J. Mayor Pro Tem Turner seconded the motion.

RESOLUTION 26-008
2.Council to consider an ordinance amending Chapter 28, Article 28.04, and Chapter 18,
Article 18.03 of the Code of Ordinances of the City of Beaumont.
On December 2, 2025, the City enacted short-term rental regulations. Following this,
Councilman Hilliard requested minor changes to the regulations. Councilman Williams
also supports this request. The proposed amendments are included in the attached
exhibit and summarized here:
1.Remove Section 18.03.007 and amend Section 18.03.004 of the City Code
of Ordinances. This will eliminate the requirement for a short-term rental
platform to include the permit number on listings and to remove listings that
do not have a permit number listed. Additionally, it will eliminate the
requirement for a short-term rental platform to collect and render hotel

occupancy tax to the city. If amended, the owner will be solely responsible for remitting owed
taxes to the city.
2.Remove Section 28.04.009(d)(9) from the City Code of Ordinances. This will
remove the 300-foot minimum distance requirement for short-term rental
properties.
Councilmember Hilliard moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING
CHAPTER 28, ARTICLE 28.04, ENTITLED “ZONING REGULATIONS”, AND CHAPTER 18, ARTICLE
18.03, ENTITLED “HOTEL OCCUPANCY TAX”, OF THE CODE OF ORDINANCES OF THE CITY OF
BEAUMONT, TO REVISE REGULATIONS RELATED TO SHORT-TERM RENTALS, PROVIDING FOR
CODIFICATION, PUBLICATION, AND EFFECTIVE DATE. Councilmember Durio seconded the
motion.

3.Council to consider a request for a Specific Use Permit to allow a washateria in a GCMD-
2 (General Commercial-Multiple Family Dwelling-2) District for property located at 4515 N.
Major Drive, Suite A-B.
Hung Nguyen requests a Specific Use Permit to allow a washateria to be located at 4515
N Major Drive, Suite A-B. The GC-MD-2 (General Commercial- Multiple Family Dwelling-
2) zoning district requires a Specific Use Permit for all new proposed land uses. Major
Mojo Washateria will offer 24-7 self-service washing and drying machines, with folding
tables, vending machines, free Wi-Fi access, and a lounge area.
At a Joint Public Hearing held on December 15, 2025, the Planning Commission
recommended 9:0 to approve the request for a Specific Use Permit to allow a washateria
in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District for property
located at 4515 N. Major Drive, Suite A-B, with the following conditions:
1.Shall comply with all applicable Building and Fire codes.
2.Construction plans must meet all requirements by Water Utilities for water
and
sanitary sewer services, including and requirements of the City’s backflow,
pretreatment, and/or F.O.G. program.

Council to Conduct a Public Hearing to receive comments regarding the Zip
Advertisement Policy and Program

4.Council to consider a Resolution authorizing the implementation of the Zip Advertisement
Policy and Program.
The City’s transit system, Zip, is requesting approval to launch a new advertising program
that would allow local businesses, schools, event organizers, and other groups to place
ads on buses and vans, including placards inside of the vehicles. All revenue from the
program would go directly toward improving bus stops with shelters, lighting, and
benches, and would also help provide matching funds for grants. This program is
designed to create a self-sustaining way to enhance safety and comfort for all riders and
visitors utilizing Zip services.
The Transit Management of Beaumont will manage and oversee the program.
Approve the resolution.

BACKGROUND
Police ammunition is a budgeted item and will be purchased from Precision Delta Corporation of
Ruleville, Mississippi utilizing a BuyBoard Co-Op Contract, which complies with the State of
Texas procurement statues.
The attached quote in the amount of $82,957.18 is for eleven different types of ammunition for
use by the Beaumont Police Department.

REQUESTED ACTION:Council consider a resolution approving an annual maintenance
agreement from Environmental Systems Research Institute, Inc.
(ESRI) of Redlands, CA that is utilized by multiple departments.
BACKGROUND
The Environmental Systems Research Institute, Inc. (ESRI) Geographic Information System
(GIS) platform is currently used across multiple departments of the City of Beaumont. The
software suite enables the creation, editing, and distribution of maps, geographic information,
and related datasets that integrate with and support applications used by Public Safety, Water,
Code Enforcement, Planning & Zoning, and other City departments.
This agreement represents a renewal of the existing three-year contract and will have an annual
cost of $90,300.00 for a three-year term, totaling $270,900.00.
This purchase is exempt from competitive bidding because the software is proprietary and
available from a single source, which holds exclusive rights to modify, maintain, and support the
system.

REQUESTED ACTION:Consider authorizing the Beaumont Convention and Visitors Bureau

BACKGROUND
Adding two new pollinator gardens will help establish habitat for important plant, insect, and
bird species that will enhance Tyrrell Park as a birding hot spot. In turn, it can also be used to
further promote Beaumont as a premier birding destination near the Gulf Coast. Irrigation will
also be added to support the sustained growth of the gardens on the nature trail.

REQUESTED ACTION:Council to consider an ordinance amending the FY 2026 Budget.
BACKGROUND
In accordance with Article VI of the City Charter, the City Manager shall strictly enforce the
provisions of the budget as specified in the ordinance adopting the budget. He shall not authorize
or approve any expenditure unless an appropriation has been made in the budget ordinance
adopting the budget, and there is an available unencumbered balance of the appropriation
sufficient to pay the liability to be incurred. Approving the proposed amendment will ensure
expenditures are within the approved budget and are in accordance with financial policies as
approved within the budget document.
1.The General Liability Fund’s Adopted Budget for FY 2026 is $4,525,000. This Fund pays
expenses associated with the City’s insurance coverage including, but not limited to, general
liability, law enforcement liability, automotive liability, cyber liability, and
property/wind/hail/flood coverage. The City has now increased its TML Intergovernmental
Risk Pool policy to include coverage for Mobile Equipment and Auto Physical Damage for
fleet units 2023 and newer, fire engines, and ambulances. The contribution change is the
prorated amount for each policy that will carry us until October 1, 2026. Moving forward, the
City can expect the annual cost for the policies to be around $75,000 each per year. There were
178 fleet items added. The total fiscal impact for FY 2026 is $117,045. There is no fund balance
requirement for the General Liability Fund.

NAMED STORM DEDUCTIBLE – MOBILE EQUIPMENT
This endorsement forms a part of the Declarations to which attached,
effective on the inception date of the coverage unless otherwise stated
herein, and modifies such coverage as is afforded by the provisions of the
coverage shown below:

Notwithstanding deductible amounts selected by the Member as referenced under II.A.,
General Conditions, it is agreed that, with respect to all loss of or damage to mobile
equipment caused by a named storm as designated by the National Weather Service, the
deductible amount shall be the greater of:
1.The sum of 1% of scheduled values for all items that are lost or damaged, subject
to a minimum of $1,000 for each item; or,
2.The Mobile Equipment deductible shown on the declarations.
Exception:
With respect to loss or damage caused by flooding to any item which at the time of loss is
situated less than 9 feet above mean sea level, the percent deductible under 1. above shall
be 2%.

REQUESTED ACTION:Council to consider a resolution authorizing a payment for insurance
coverage for various City-owned fleet.
BACKGROUND
The proposed annual premium for Mobile Equipment coverage is based on a total insured value
of $20,545,351.00. The cost of the policy is $59,063.00 with a renewal date of October 1, 2026.
The proposed annual premium for Auto Physical Damage coverage is based on a total insured
value of $19,484,044.00. The cost of the policy is $57,982.00 with a renewal date of October 1,
2026. The deductible for both policies is $10,000.00 per occurrence.
The coverage is through the Texas Municipal Intergovernmental Risk Pool.

REQUESTED ACTION:Council consider a resolution authorizing the City Manager to
execute Change Order No. 2, accept maintenance, and authorize
final payment to TRP Construction Group, LLC, for the Citywide
Pavement Markings - Phase IV Project.
BACKGROUND
On April 10, 2025, by Resolution No. 25-145, City Council awarded a contract to TRP
Construction Group, LLC, of Haltom City, Texas, in the amount of $475,497.00, for the
Citywide Pavement Markings – Phase IV Project.
Previous Change Order No. 1, in the amount of $54,688.00 is attached for your review.
Proposed Change Order No. 2, in the amount of $42,692.00 is required to adjust the estimated
quantities in the contract to reflect the actual quantities used in the completion of the project. If
approved, the adjustment in quantities would result in a final contract amount of $572,877.00.
The project has been inspected by the Engineering Division and found to be complete in
accordance with the provisions and terms set forth in the contract. Acceptance of Change Order
No. 2, maintenance, and final payment in the amount of $178,559.55 is recommended.

Certificates of Obligation.

REQUESTED ACTION:Council consider a request for a Rezoning from R-S (Residential-
Single Family Dwelling) District to GC-MD-2 (General
Commercial-Multiple Family Dwelling-2) District for property
located at 7085 Highway 105 and two lots to the East and the lot
immediately West.
BACKGROUND
Abdallah Atiyeh, is requesting approval of a Rezoning from an R-S (Residential-Single Family
Dwelling) District to GC-MD (General Commercial-Multiple Family Dwelling) or a more
restrictive zoning district, for the property located at 7085 Highway 105 and the lot immediately
west, and the two lots to the east.
According to the Comprehensive Plan of Beaumont the property is located within a
Contemporary Neighborhood Design Concept area, “allowing for a diversity of housing types
and convenient access to parks, schools and shopping centers while still protecting single-family
residential areas from intrusion of incompatible land uses and vehicular traffic.” The request
aligns with the Comprehensive Plan of Beaumont.
A shopping center development along this corridor is appropriate considering its proximity to
Major Drive and Highway 105.
At a Joint Public Hearing held on December 15, 2025, the Planning Commission recommended
6:3 to approve the request for a Rezoning from R-S (Residential-Single Family Dwelling)
District to GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District for property
located at 7085 Highway 105 and two lots to the East and the lot immediately West. The
Commission expressed the necessity to obtain a grading permit during the meeting. The
developer obtained their grading permit on December 19, 2025.
