A Joint Public Hearing of the Planning Commission and City Council was held on August 18,
2025 and called to order at 3:00 p.m. with the following members present:

APPROVAL OF MINUTES
Commissioner Beatty moved to approve the minutes of the Joint Public Hearings held on July 21,
2025. Commissioner Javed seconded the motion. The motion to approve the minutes carried 6:0.

REGULAR MEETING
1) PZ2025-226:
Request for approval of a Replat of Lot 16. Block 19, Gulf Terrace
Addition, Beaumont, Jefferson County, Texas into Lots 16A & 6B, Block 19, Gulf Terrace
Addition, Beaumont, Jefferson County, Texas, containing .328
Applicant: Access Surveyors
Location: 9330 and 9340 Josey Street
Mrs. Engman presented the staff report. Access Surveyors, on behalf of property owner Osman
Nieto, is seeking approval of a Replat of Lot 16, Block 19, Gulf Terrace Addition, Beaumont,
Jefferson County, Texas into Lots 16A & 16B, Block 19, Gulf Terrace Addition, Beaumont,
Jefferson County, Texas. The intent of the Replat, is to divide the single lot, into two (2) lots for
new residential single-family development.

Slides of the site plan, subject property, and surrounding area were shown.
Planning staff recommended approval of the request.
Thirty-one (31) notices were mailed to property owners within two hundred (200) feet of the
subject property. Zero (0) responses were received in favor and one (1) was received in opposition.
The response in opposition stated that the lot is not big enough and that the property owner has
maintained the lot for 25 years.
The applicant was present. Colby Brackin of Access Surveyors, 11025 Old Voth Road, Beaumont,
Texas addressed the Commission. He stated that

ordinance requirement for a residential single-family dwelling.
The public hearing on this item was opened and closed without comment.
Commissioner Jabbia moved to approve a Replat of Lot 16, Block 19, Gulf Terrace Addition,
Beaumont, Jefferson County, Texas into Lots 16A & 16B, Block 19, Gulf Terrace Addition,
Beaumont, Jefferson County, Texas containing .328 acres more or less, as requested in PZ2025-
226.
Commissioner Jabbar seconded the motion. The motion to approve the request carried 6:0.
JOINT PUBLIC HEARINGS
Mayor West called the Joint Public Hearings of August 18, 2025 to order at 3:15 p.m. and
explained the purpose of the Joint Public Hearing process. Mayor West then turned the meeting
over to Acting Chair Makin to conduct the Joint Public Hearings.
2)PZ2025-229:
Request for approval of a Rezoning from a R-S (Residential-Single Family
Dwelling) District to a LI (Light Industrial) District.
Applicant: Justin Broussard
Location: 6187 Fannett Road

Mrs. Engman presented the staff report. Justin Broussard is requesting approval of a Rezoning
from a R-S (Residential-Single Family Dwelling) District to a LI (Light Industrial) District, for
the property located at 6187 Fannett Road. The intent of the Rezoning is to consider other industrial
or commercial development opportunities, with the potential to expand the existing recreational
vehicle park.
According to the Comprehensive Plan of Beaumont the property is located within a
j:^\]cT\\_^aPah!FTXVWQ^aW^^S!<TbXV\]!R^\]RT_ck!PaTP*!P\]S!cWT!_a^_^bTS!ITi^\]X\]V!S^Tb!\]^c!P__TPa!
to align with the plan.
It should be noted, that a portion of the property is within the Special Flood Hazard Area, and any
R^\]bcadRcX^\]!fX\[\[!\]TTS!c^!QT!X\]!bcaXRc!R^\\_\[XP\]RT!fXcW!cWT!:Xchlb!PS^_cTS!>\[^^S!<P\\PVT!P\]S!
Prevention Ordinance.
Slides of the site plan, subject property, and surrounding area were shown.
Planning recommends denial of the request.
Eight (8) notices were mailed to property owners within two hundred (200) feet of the subject
property. Zero (0) responses were received in favor and zero (0) were received in opposition.
Brief discussion followed concerning the current zoning designation and permitting of the property
adjacent to 6187 Fannett Road.
A representative of the applicant was present. Jonathan Hart, 2206 Nantucket Drive, Houston,
Texas addressed the Commission. He stated that the recreational vehicle park will likely not be
developed. Mr. Hart further stated that the applicant would like to combine the three-acre property
with his neighboring Light Industrial district zoned seven-acre property in order to develop a new
project. He also stated the applicant is working with a development team to determine the best use
for the property. Mr. Hart stated that the applicant has not spoken to the owner of the vacant,
neighboring property located at 6191 Fannett Road.
Further discussion followed concerning zoning of surrounding properties.
The public hearing on this item was opened and closed without comment.
Commissioner Jabbar moved to table the request for five (5) months for the applicant to present a
more comprehensive development plan for the request of a Rezoning from an R-S (Residential-
Single Family Dwelling) District to a LI (Light Industrial) District, as requested in PZ2025-229.
Commissioner Linton seconded the motion. The motion to table the request carried 6:0.
3) PZ2025-237:
Request for a Specific Use Permit to allow a retail liquor store within a GC-
MD-2 (General Commercial-Multiple Family Dwelling-2) District.
Applicant: Nadia Figueroa Morfin

Location: 4515 N Major Drive, Suite A
Mrs. Engman presented the staff report. Nadia Figueroa Morfin requests a Specific Use Permit to
open a retail Liquor store to be located at 4515 N Major Drive, Suite A. The GC-MD-2 (General
Commercial- Multiple Family Dwelling-2) zoning district requires a Specific Use Permit for all
new proposed land uses. The store will sell a variety of ales and spirits, mixers and other retail
products.
Slides of the site plan, subject property, and surrounding area were shown.
Planning staff recommended approval of the request with the following condition:
1. Shall comply with all applicable Building Codes and Fire Codes.
Seventeen (17) notices were mailed to property owners within two hundred (200) feet of the
subject property. Zero (0) responses were received in favor and one (1) was received in opposition.
This request received protest from the property owners comprising 20.9% of the surrounding land
area. Section 28.02.008(d) of the City's Code of Ordinances states, "The city council shall not
amend, supplement, change, modify or repeal any regulation, restriction or boundary or approve
a specific use permit where a protest against such change (has been filed), signed by the owners
of twenty (20) percent or more either of the area of the lots included in such proposed change or
of the lots or land immediately adjoining the same and extending two hundred (200) feet therefrom,
except by favorable vote of three-fourths (3/4) of all the members of the city council."
Brief discussion followed concerning current occupancy of the shopping center.
The applicant was present. Nadia Figueroa Morfin, 2817 Windsor Lane, Port Neches, Texas
addressed the Commission. She stated that --site
\[X`d^a!fX\[\[!QT!b^\[S!^\]!P!jK^?^k!QPbXb!fXcW!\]^!^\]
consumption. Ms. Morfin further stated that she will be the first tenant in the new building and
that she does not have prior experience operating a liquor store. She further stated that she currently
owns a yogurt business and has owned food related businesses in the past. Ms. Morfin stated she
has signed a lease and that the property owner will provide exterior security cameras and she will
provide interior security cameras.
The public hearing on this item was opened.
Dillon Richardson, 4575 North Major Drive, Beaumont, Texas addressed the Commission. He
stated that the speed of traffic on North Major Drive is not conducive for a retail liquor store and
requested that the Commission be mindful of approving liquor stores in the area of North Major
Drive.
The applicant was given an opportunity to speak in rebuttal. Ms. Morfin stated that she has no
control of the traffic in the area and that her goal -

compliance of City and TABC regulations. She further stated that she will maintain a clean, safe,
and well monitored store and is committed to being a responsible business owner.

Brief discussion followed concerning the Engineering Department traffic review.
Commissioner Linton moved to approve the request Specific Use Permit to allow a retail liquor
store within a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District, as requested
in PZ2025-237, with the following condition:
1. Shall comply with all applicable Building Codes and Fire Codes.
Commissioner Beatty seconded the motion. The motion to approve the request resulted in a tie
vote of 3:3 (Jabbia, Javed, and Jabbar). Alternate Commissioners Sorrell and Dixon were asked to
vote resulting in a tie vote of 4:4 (Jabbia, Javed, Jabbar, and Dixon).
Mrs. Engman noted that the recommendation to City Council will reflect a 4:4 tie vote.
