To operate a music venue, with no alcohol, does not require an approved specific use permit (SUP). The requirement of the SUP came from the understanding that"club 415"would be a "byob" establishment. Please note, that prior to occupying this space, you will need to obtain a commercial alteration permit, and make the required alterations to bring the building into compliance with any applicable building, and fire codes. Once all inspections have been completed an approved, your alteration permit will facilitate your Certificate of Occupancy. If at any time you choose to move forward with "byob"or obtain a liquor license for the sale of alcohol, you will be required to resubmit an application for a specific use permit. According to your letter (attached) you will now hold an alcohol-free establishment. I understand you're wanting to keep the application simple, I must ask if there is an intent for in the future to become a "BYOB" establishment or even obtain a liquor license further down the road to allow club 415 to sell drinks themselves. The answer can be no, and that would be fine we will just need to amend your request slightly to change from a drinking place to a late hours club. However, what I want to share, is that if you are operating with no alcohol and then later plan to expand to allow BYOB, then we start back over at having to amend your specific use permit. While I understand at this time, you have no intentions on serving alcohol, or obtaining a liquor license. I would recommend continuing with the original application like we discussed in the pre- development meeting. This would allow you to begin operations with no alcohol, and then should you so choose to allow the BYOB it is already permitted with your existing application. The choice is yours of course, I just need to know which way you would like to proceed; 1. Amend your application to just a late hours establishment with NO alcohol; and in the future get an amended sup at the time you choose to add alcohol to your business. 2.
