Commissioner Linton seconded the motion. "I"he motion to approve the minute s carried 7 -D 0. Planning Commission May 19, 2025 Chairman Neiad welcomed the newly elected Counellmernbers and thanked the out -going Councilmen-ibers for their service. REGULAR MEETING 1) PZ2025-177: Request for approwil of a plat for the street dedication of Wescalder ald Road and Pit Stop Road and dedication of a drainage way out of and part of Lot 5 and Lot 6, Block 8, Wescalder Fig Acres Addition., Beauinoiit, Jefferson County, Texas. Applicant: City of Bea-uniont Location. 2405-2499 Wescalder Road Mrs. Engman prescnted the staff report. In 2021, Scott Hollenion and the heirs of the A.J. Fasulo Estatc requested that the City of Beaumont accept maintenance of the private drive located cast of Wescalder Road and north of Baker Road., and its infrastructure. The Planning Commission tabled this request multiple time to allow for additional supporting data. On March 18, 2024, the Planning Commission recommended denial of the request. However on August 6, 2024, the City Council found the request to be in the best interest. of the City, subject to certain conditions. A subsequent amendment to the original application included the dedication of the adjacent drainage way, also owned by the heirs of the A.J. Fasulo Estate. 'rhe City engaged Whitely Infrastructure group to complete the required plat work. With the dedication and acceptance of Wescalder Road, Pit to Road, and the drainage way, City crews will be able to begin infrastructure improvement, and ongoing maintenance will become the City's responsibility. Slides of the site plan and subject property were shown. Planning staff recommended approval of the request. Nineteen (19) notices were mailed to property owners that reside along Wescalder Road. Four (4) responses Nvere rcceived in favor and zero (0) were received in opposition. Tom Rowe of Whiteley Infrastructure Group, 655 Langham Road, Unit 14, Beauniont, Texas addressed the Commission. He stated that the plat request will allow the City to accept mah)tenance of the private drive in order that it may proceed with infrastructure improvements and ongoing maintenance. Brief discussion followed concerning specifies of the request. 'I"he motion to approve the request carried 7:0. 2 Planning Commission May 19, 2025 2) PZ2025-144: Request for approval of a sidew-alk Nvaiver. Applicant: Nick Ferguson Location: 4390 West Cardinal Drive Chairman Nejad announced that lie will abstain from voting on this item. Mrs. Enginan presented the staff report. Nick Ferguson, on behalf of the ITEX Group, LLC, requests a waiver to the sidewalk reqtiirenient for a new multi-faniily deVClOPDIeIIt at 4390 West Cardinal Drive. Section 26.03.004(3) of the City's ordinances states, "The planning and zoning connnission 127CI grant a iiwwer to the sicleiiwlk requireinent iI' h y)]Wicant can proi�e there is an engineering reasonfor not insicilling a sicleiiwlk. " The applicant's letter cites the following- 1. TxDOT does not permit sidewalks within their right of way, which restricts 0111, ability to comply with the ordinance as originally intended. 2. If the sidewalk were moved behind the property line it would end abf Uptly at the DD6 ditch on the west side of the property rendering the side -walk incomplete and in-ipractical. The ditch presents a significant physical barrier, further complicating the sidewalks implementation. 3. On the cast side of the property, there is a vacant lot with no connecting sidewalk and is densely wooded. This further complicates the continuity of pedestrian access,, as it would require additional adjustments that are not feasible without creating umiecessary hardship. The City's Traffic Engineer reviewed the request and does not support. the waiver, noting that the reasons provided do not constitute valid engineering barriers to sidewalk construction. Although the original plan placed the sidewalk within TxDfffright-of-waye, TxDOT denied that location. Slides of the site plan and subject property were shown. Plating Staff recommended denial of the request. The applicant was present. Nick Ferguson, 3735 one wood 'Frail, Port Arthur, Texas addressed the Commission. He stated that TxDOT denied the location of the sidewalk, therefore, the installed rebar was removed. Mr. Ferguson further stated that the property line extends across the ditch and installation of a sidewalk would allow a crosswalk moving forward. He also stated that a 15" utility casement exists along the south side of the property. Further discussion followed con erasing specifies of the request. Commissioner ScnigLiar moved to deny the request for approval of a sidewalk waiver, as requested in PZ2025-144. Commissioner Linton seconded the motion. Applicant: Brand), Tarvcr Location: 3825 W. Lucas Drive Mrs. Engman presented the staff report. Brandy Tarver requests a Specific Use Permit to opcil a retail beauty supply store to be located at 3825 W. Lucas Drive, Suite D. The GC-MD-2 (General Commercial- Multiple Family Dwelling-2) zoning district requires a Specific Use Permit for all new proposed land uses. The store will sell a variety of hair and beauty products. Slides of the site plan and subject property were shown. Plaiming staff recon-emended approval of the request, with the following conditions: 1. Plans must meet all requirements by Water Utilities for any water and sanitary sewer improvements, including any requirements of the City's backflow, pre-treatn)ent, and/or FOG program. 2. Compliance with all applicable building and fire Codes. Seventeen .(17) notices were mailed to property owners within two hundred (200) Feet. of the subject property. Five (5) responses arc received in favor and zero (0) were received in opposition. The applicant was present. Brandy Tarver, 3825 W. Lucas Drive, Suite D, Beaumont, Texas addressed the Commission. She stated that salon services will not be offered at the location and only hair extensions and hair products will be sold. The public hearing on this item was opened and closed without comment. Commissioner Makin moved to approve the request for a Specific Use Permit to allow a retail store in a GC-MD-2 (General Commercial -Multiple Family Dwelling-2) District, as requested in PZ2025-115, with the following conditions: 1. Plans must meet all requirements by Water Utilities for any water and sanitary sewer 0 improvements, including any requirements of the City's backflow, pre-treatment, and/or FOG program. 2. The motion to approve the request carried 7:0. 4) PZ2025-126: Request for approval of a Rezoning of approximately 366 acres from R-S (Residential -Single Family Dvvelling) and A-R (Agricultural -Residential) Districts to PUD (Planned Unit Development) District. Applicant: Acadia Dowlen, LLC by Sam Yager III Locatioll.: 366.06 acres at approximately the southwest corner of Iwlen Road and Delraware Street Mrs. Engii-ian aluiounced that this item has beet) tabled to the June 16, 2025 Planning Commission meeting. 5) PZ2025-135: Request for approval of a Rezoning of property from R-S (Residential - Single Family Dwclllng) District to PUD (Planned Unit Development) District and a Specific Use Permit to approve the general land use and density plan. Applicant: META Planning + Design Location: 87.28 acre tract at approxiii-tately the northwest intersection of Northwest Parkway and Pointe Parkway Mrs. Enman announced that this item has been tabled to the June 16, 2025 Planning Comn-iission meeting. 6) PZ2025-150: Request to amend Chapter 28, Section 28.03.023(c) of the City"s Code of Ordinances to an gaming sites and gaming machines in order to comply with the Texas Constitution. Applicant: City of Beaumont Mrs. Engn-ian presented the staff report. In the City of Fort Worth v. Rylie case, the Texas Court of Appeals affirmed that cities in Texas may enforce lom cal rcstrictions on gaing machines, and that unless the state constitution is amended,, eight -liners remain illegal as unconstitutional lotteries because they involve elements of chance, consideration, and prize. The court concluded that these ni.achines are not protected under the state's "fuzzy animal" exccption or regulated skill-gan-le stactutcs. Therefore, Fort Worth"city ordinances regulating then-i were upheld and not pre en-1pted by state law. However, the State Comptroller continues to issue permits and decals for amusement redemption devices, also known as gaming machines or 8-liners. 0 In Chapter 28 of the City's Zoning Code, the Peri-nitted Use 'Table identifies the zoning districts where gaming sites and machines are allowed. Should the Planning and Zoning Conin-iission and City Council wish to ban gaming sites and gaming machines to operate within eity limits, the permitted use table MLIst be amended to reflect such a decision. Mrs. Engman further gave a presentation of the rcquested Acin. The presentation hicluded the current ordinance requirements with City Attorney Reed discussing the City of ort TVorth v. R - case regarding gaming machines. Mrs. Engman also presentcd the history of the ordinance, policy options, and the next steps moving forward. 5 Planning Commission May 19, 2025 Mrs. Engman explained the options for Commission consideration: 1. an gaming sites Lind gaming machines within the city limits of Beaumont; or 2. Amend the permittcd use table to only allow gaming sites within industrial zoning districts; or 3. No change Planning staff recommended approval of the request. All Game Room owners have been notified of this item by rcgUlal'mail using the addresses on file. Brief discussion followed conceming the request options. Police Chief TimOCDaschek discussed crime relating to game rooms and presented a map for the Commissioner's review,, with Mrs. Engman discussing violation enforcement measures as it relates to operating permits. Assistant Police Chief Jason Plunkett discussed prior operations relating to ordinance compliance. Assistant Fire Chief Scott Wheat and Game Room Administrator Lindsey Gilbreath discussed game room inspections,, required security systems, en-iployee badges, the permitting process, and other on -site game room requirements. The public hearing oji this item was opened. Attorney Scott Renick, 1420 Wellington Circle, Beaumont, Texas addressed the Conlil-lissioll. Mr. Renick stated the he is present on behalf of business owners who are legally -And responsibly operating with five or feNver of the accessory gaming devices. Mr. Renick spoke to the businesses that have made significant investments to comply with the City's gaming ordinance. He further stated that there is no evidence that crimes are related to ganiing sites. Mr. Renick also stated that his clients are opposed to the ordinance amendment. He stated that gaming machine supplemental income allows the stores to remain open and loss of that revenue will be a hardship for the business owners. Mr. Renick further stated that should a store close, it will might not be able to reopen due to economics of the area it serves. He also stated that the stores provide jobs for the community and there is no basis in which to repeal the ordinance. Mr. Renick further stated that the maJority of his clients live locally and instructed the. afficted business owners present in the audience to stand. Don Dodd, 1635 Weston Court, Beaun-iont, Texas addressed the Commission. Mr. Dodd spoke to the disadvanfictges of allowing game rooms/gaming machines. He further stated that lie does not think Beaumont should have game rooms or gaming machines in. stores and has witnessed cash prizes being paid to winners. lei Planning Commission May 19, 2025 Chairman Nejad made a motion to allow the speaker additional time in which to speak. Mr Dodd ftirther stated grandfathered businesses that are being closed due to violations are reopening within days with an LLC being listed as the mvner, rather than an individual person. He also stated that they are operating as casinos by paying out cash money to winners. Francis Graliam, 1761 Rena Street-, Beauniont, Texas addressed the Commission. Ms. Graham stated that she is opposed to the of of game rooms gaming machines due to crime and its economic effcct. Wilma Adilow., 5275 MeadolAr6ew Road, Beaumont 5 P I"exas addressed the Commission. She stated that she is opposed to the operation of game rooms/gaming machines as it is prioritizes profit over people by targeting working-class areas, creating an environment that oftell leads to increased crime, gars-ibling addiction, and economic hardship. Chairman Nejad requested that a business owner address the Commission as to the amount of revenue generated by gaming machines. Afarshad, 7215 Brazos Avenue, Port Arthur, Texas addresscd the Commission. Mr. Arshad stated that his store operates five gaming machines and that the daily revenue generated fron-i the gaming machines will pay fhe wages of one employee. He further stated that smaller stores do not have much revenue and the operation of gaming machines provides thein with needed additional revenue. The public hearing on this item was closed. The reason for the requested change in zoning is as follows: Tract I and Tract 11 were formerly used in the production of minerals and were unavailable for the development of other uses as the City developed around the two sites over time. In recent years, the mineral production prospects fi-orn the sites dwindled as reserves were depleted. It became apparent to the City and the owner that the use of the site as a mineral production facility would change over time and that preparation for that change would need to occur in advance to be ready for the day when change was needed. The conversion of the site from mineral production to other uses would involve removal of production and transportation facilities, easements, and other mineral infrastructure to make way for future uses and development. Given the combined size of the Property W-36 6.06 -acres), it was determined that a Municipal Management District may also be needed to handle the financing of considerable infrastructure in support of the potential development of the Property. In anticipation of this change in use, the property owner with the support of the City in Resolution 17-043) created Beaumont Municipal Management District 11o.1 (the. "District") in 2017 through the Texas Legislature. The District was created to help prepare for the conversion of the Property from mineral production to future mixed -uses. The District can provide, and finance water, sewer, drainage, road, and other public infrastructure required for mixed -use development of the Property. These I public ire m proveents are typically initially financed by the developer and reimbursed later from the sale of tax-exempt municipal bonds issued by the District and supported by using the District's own future tax collections from taxable property values created by the development of land and construction of above ground improvements within the boundaries of the District. This type of structure incentivizes a developer to create higher taxable values to support the sale of bonds for the reimbursement of public infrastructure, which is also in the best interests of the City and County. In preparation for the future change in use and potential development of the Property as a potential mixed -use development, the, City consented to the creation of the District in 2022, and the District hold and passed a bond authorization election, As the City has developed over time around the Property, the City has made varied zoning decisions which situate the Property at the intersection of several different approved land uses. The following zoning classifications exist along the boundary of and/or across the street from the Property: surrounding ADoroved Zoning Classifications: R-S - Residential Single -Family Dwelling District. RM-M - Residential Multiple. -Family Dwelling -Medium Density District. RM-H - Residential Multiple -Family Dwelling- i hest Density District. NC - Neighborhood Commercial District, GC -MD- General Commercial -Multiple Family Dwelling District. GC-MD-2 - General Cornmercial-Multiple Family Dwelling-2 District. PUD- Planned Unit Development. The Property's current zoning classifications do not reflect the surrounding urban environment and zoning classifications which surround the Property, and the flexibility which is needed to achieve highest and best uses. The current zoning classifications for the Property are: Current Property Zonin-qclassifications: A-R - Agricultural Residential District R-S - Residential Single -Family Dwelling District. FILE: PZ2025-217 STAFF REPORT In April 2007, the City Council approved a Specific Use Permit (SUP) allowing a charter school to operate within a GC -MD (General Commercial — Multiple Family Dwelling) zoning district. In June 2009, the SUP was amended and approved to expand the school to occupy the building to the west within the parking lot. In 2009, the applicant proposed a total of 350 students with 35 teachers on site. Over time, the school's enrollment significantly increased without the benefit of an approved amendment to their SUP. According to the National Center for Education Statistics, it is reported that a total of 657 students attended Harmony Science Academy at the 4055 Calder Avenue location for the 2023-2024 school year. At present, the campus no longer complies with key conditions of the Specific Use Permit. The increase in student enrollment has resulted in the site's inability to adequately manage vehicular traffic without adversely affecting public safety, pedestrian access, and neighboring properties. During school hours, traffic congestion at peak times significantly impedes access to adjacent businesses, residential streets, and hinders the movement of emergency response vehicles in the area. Section 28.04.001(h) of the City's Code of Ordinances states, "a specific use permit may be revoke d or m odie d, after notice an d h e orin g., for el th er of the fo flo win g reasons: 1.
