FILE: PZ2025-113 STAFF REPORT Jerry Leblanc is seeking approval of the establishment of a Public Improvement District (PID) in accordance with Chapter 372 of the Texas Local Government Code. The proposed PID is intended to finance public infrastructure improvements to support a 62-lot development off Gail Road. Mr. Leblanc received approval of this development from the Planning Commission inNovember of2O24. The plat islocated within your packet. The scope of the proposed P|Dincludes w/ate�vvastevvate�storm water drainage facilities, street paving, detention facilities, public landscaping, and amenities including the engineering, testing, surveying, and the permitting costs related to improvements within the District. The estimated costs of the improvements include financing and administration are $2,284,942-60. Planning staff recommends approval of the request with the following conditions: l. Shall obtain approval from the Public Works Department for infrastructure improvements prior to construction of the Woodland Park subdivision and infrastructure as it relates to P|O No. l. 2.The Developer shall enter into aDevelopment Agreement with the City, pursuant to which the Developer shall design, construct, and deliver all required infrastructure in a manner that meets or exceeds all applicable [hv standards and specifications as it relates to P|O No. l. PETITION FOR THE CREATION DFA PUBLIC IMPROVEMENT DISTRICT THE STATE OF TEXAS COUNTY QFJEFFER5ON TO: THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: The undersigned petitioner (the "Petition er~b acting pursuant tothe provisions ofChapter 372 Texas Local Government Code., together with all amendments and additions thereto, petition this Honorable City Council to create a public improvement district ("District") in the territory described in Exhibits A and B attached hereto (the "Tand") within the City of Beaumont, Texas (the "City"), and in support ofthis petition the Petitioner would present the following: Section 1. Standing of Petitioner. The Petitioner isanowner ofthe Land within the District described below as determined by the current roll of the Jefferson County Appraisal District. The Petitioner, along with all other petitioners submitting petitions to the City in connection with the District, constitutes the owner of taxable property within the District sufficient to meet the requirements of Section 372-005(b), Texas Local Government Code. Thei m� Section improvements are the construction of water, wastewater, and storm water drainage facilities, street paving, storm water detention facilities, public landscaping and amenities including the engineering, testing, surveying, and permitting costs related toimprovements with inthe District. The estimated costs ofthe improvements include financing and administration. Section 3. Estimated cost of the proposed public improvements. $2,284,943.60 Secdon/L Boundaries. The proposed boundaries are described in the boundary descriptions attached as Exhibits and B. Section 15. Method of assessment.. The proposed method ofassessment shall bebased upon (i) an equal apportionment per lot or per square foot of property benefiting from the public improvements, as determined by the City Council, (ii) the ad valorem taxable value of the property benefiting from the improvements, or (iii) any cohibination thereof. Section 6. Appqrt io n, rn ent of cost. 2OOpercentofthe cost ofUhep roposed improvemems shall bepaid byassessment ofthe property owners within the District. Section 7' Management of the District. The management of the District will be the ultimate responsibility of the City Council of the City; provided that, to the extent allowed by law, the City may initially contract with a private sector company or a City established local government corporation to carry out all or a part of such City responsibilities, as well as the day-to-day management and administration ofthe District. Section 8. Concurrence of the Petitioner. The Petitioner signing this petition concurs in and requests the establishment ofthe District. Section 9. Advisory board. An advisory board may be established todevelop and recommend an improvement plan to the City Council. This petition shall be filed with the City Secretary in support of the creation of the Districtby the City Council asherein provided.
