Planning Commission February 24, 2025 IM, GULAR MEETING 1) PZ2025-20; Request for approval of a eplat of part of Lot 3, Block 1, Lovell Farm Subdivision,, Beaumont, Jefferson County, Texas into Tracts 3A and 3B, Block I, Lovell Farm Subdivision, Beaumont, Jefferson County, Texas. Applicant: Jason Culbertson Location: 12167 FM 365 Mrs. Engman presented the staff report. Jason Culbertson has requested approval of a Re -plat of part of Lot 3, Block 1, 1,.ovell Farm Subdivision into Tracts 3A and 3B, Block 1, Beaumont, Jefferson County, Texas. This property is located within the City's extraterritorial jurisdiction. The intent of the plat is to divide the property into two residential lots. Slides of the site plan and subject property were shown. Staff recommended approval of the request. Twelve (12) notices were mailed to property owners within two hundred (too) feet of the subject property. Three (3) responses were rcecived in favor and zcro (0) were received in opposition. JOINT PUBLIC HEARINGS Mayor West called the Joint Public Hearings of February 24, 2025 to order at 3:15 p.m. and explained the purpose of the Joint Public Hearing process. Mayor West then turned the meeting over to Chairman NcJad to conduct the Joint Public Hearings. 2) PZ2025-22.- Request for a Specific Use Permit to allow an Artisan office and shop within the CBI (Central Business District). Applicant- Michael S. "Stoney" Petit 11 Location: 450 Bowie Street Planning Commission February 24, 2025 Mrs. Eragman presented the staff report. Stoney Petit, is requesting a Specific Use Permit to operate an Artisan office and shop at 450 Bowie Street in the CB D (Central Business District). Anderson Artisans is a skilled carpentry business specializing in creating one -cif a -kind wooden pieces. The Central Business District is intended to accommodate the commercial offices and service, residential and public activities. The use of the property as a business office and shop could aid in economic growth of the downtoi-vii area. Although the CB D district does not have parking requirements, our City's Traffic Engineer has reviewed the proposal and has no immediate concerns. Slides of the site plan and subject property were shown. Staff recommended approval of the request with the following conditions: 1. Construction plans must meet all requirements by Water Utilities for water and sanitary sewer services, Including any requirements of the City's backflow, pre-treatment and/or FOG program. 2. Construction plans shall comply with all applicable Fire and Building Code requirements. 3. All operations of the business shall remain in compliance with Artielc 12.08 of the City of Beaumont Code of Ordinances. Request for a Rezoning of an R-S (Residential Single -Family Dwelling) 6 zoning district to a GC -MD (General Conimerelal-Multiple Family Dwelling) zoning district. Applicant- Jaramillo Lucas Locatioll: 6690 Rebecca Lane Mrs. Eragman presented the staff report. Property Owner Jaran-ifflo Lucas, is requesting a rezoning for dic 1.08- acre property, at 6690 Rebecca Lane, located at the intersection of Rebecca Lane and Comstock Road, Mr. Lucas seeks to change the zoning from R-S (Residential Single Family Dwelling) to GC -MD (General Commercial Multiple — Family Dwelling) District. This request follows a violation notice from the Planning Department, indicating that his business "'Luca.� Lai.in Seri�lce & Landscciping LLC Y.R is not in compliance with the City's adopted Code of Ordinances. The rezoning request is intended to allow his business to conti.nue. operating at this location. If approved, this rezoning could result in "spot zoning", introducing a higli-density commercial use(s) into a predominantly single-family residential area. This includes surrounding properties, such as Lefler Park to the Nest. The proposed rezoning is not consistent with the Comprehensive Plan. for Beauniont and may violate Chapter 211 of the Local Governniclit. Code. Zero (0) responses were received in favor and zero (0) were received in opposition. Brief discussion was had concerning the location currently being operated as a lawn business. A representative and agent of the applicant was present. Attorney Douglas Greer (representative), 2905 Toccoa, Beaumont, Texas and Ricardo Alvarez (agent), 3012 Glenwood Avenue, Beaumont, Texas addressed the Commission. Mr. Greer read a prepared statement and presented a packet (Exhibit 1), for Commission review. He stated that the request is justified because of its unique placement of the lot involved; the current nature of the Rebecca Lane neighborhood area; and,, the maluier in which the business is conducted. Mr. Grcer ftirther stated that the lawn business is not visible from street view and is mostly surrounded by forest. He also stated that the entrance and exit to the business is located on Comstock Road, has no walk-in customers, and does not impact the Rebecca Lane neighborhood. N Planning Commission February 24, 2025 Chairman Nqad madc a motion to allow Mr. Greer additional time to speak. Commissioner Noyola seconded the motion. The motion to approve the request to allow Mr. Greer additional time to speak carried 8:0. Mr. Greer continued by stating that it appears that commercial and industrial activity ClIlTently exists within the Rebecca Lanc neighborhood. He furthei' - stated that the lawn business does not havc open signage and all services are conducted off -site. Mr. Alvarez stated that business has been in operation for four years, beginning with two employees and currently having six employees with most commuting together to and from work. He further stated that the hours of operation are 9:00 any to 4:00 pm, with no loud noises from equipment. Mr. Greer stated that cmployees of the lawn business voluntarily remove litter froll). Lefler Park. He further stated that the business is licensed with the State of Texas,, are tax payers, and have had no complaints from neighboring property owners. Further discussion followed relating to equipment located on the property and visibility from the street. The public hearing on this item was opened and closed without comment. Additional discussion was had concerning specifies of spot zoning and rczoning, along with how it relates to future sale of property. Specifies of denial of the request and tabling the request were discussed. Chairman Nejad moved to table, until further information from the Applicant and advisement with the City Attorney and Planiiing Staff is obtained, the request for a Rezoning of an R-S (Residential Single-Fani.ily Dwelling) zoning district to a GC -MD (general Commercial -Multiple riamily Dwelling) zoning district, as requested in PZ2025-25. In other words, if soincone told you to drive down Comstock Road, begiiming at its intersection with Rebecca Lane, and turn into Doris Lark, which wraps around and turns into Rebecca Lane, and tell ine what conunercial or industrial activity you see, you could name a handful of things, but not the Lawn Service Mr. Lucas runs. Again, the business never fronts Rebecca Lade. The ingress and ogress from the business is on this bigger street, C onisto ok-, and not on the neighborhood street, Rebecca Latte. 41 The Manner An Which the Su ° e Bu inem Is Conducted When the lawnservice business travels to Glient locations to perform its work, the business vehicle exits froin Coy stoGlc, turns right on Comstock and then turns and leaves on Helbig. The business does not regularly travel through Rebecca Lane or any other parts of the neighborhood to conduct its business. So we submit there is no physical impediment or obtutisiveness into the neighborhood wbich is zoned residential. Additionally, this Lawn ears business does not feature, walk-in customers that would be parking on the neighborhood street, There is no obtrusive or even open signage of the business extending hito the neighborhood. The lawn service does pot pcxforin any servicos for customeis onsite, but rather performs clistomer services at the customer locations, making it distinguishable from a typical brick -and - mortar business receiving a stream of oustolliers. The few people who would engage with the lawn service on -site would enter from the Conistoelc entrance, which is not in the neighborhood. Their services are p erfornied off -site. They merely store and prepare thei r raw materials to be used hi their services at their business. So they're, not r ' unning a commorcial establislunent that feat-Lires custolners regularly coming in to f4eir place, like a converdence store or hardware store or auto ineclianic shop. The nature of the bushiess does not invite atiti-social behavior or possibly attract derelicts or criminals, like, for instance, a convenience store often does. They perform all of their services at their customers' residences or business.
