January 27, 2025. Commissioner Makin seconded the motion. The motion to approve the minutes

Subdivision, Beaumont, Jefferson County, Texas into 'Tracts 3A and 3B,
Block 1,, Lovell Farm Subdivision, Beaun-tont, Jefferson County, Texas.
Applicant: Jason Culbertson

Mrs. Engnian presented the staff report. Jason Culbertson has requested approval of a Replat of
part of Lot 3, Block 1, Lovell Farm Subdivision into Tracts 3A and 3B, Block 1, Beaumont,
Jefferson County, Texas. This property is located within the City"s extraterritorial jurisdiction.
The intent of the plat is to divide the property into two residejitial lots.
Slides of the site plan and subject property were shown.
Staff recommended approval of the request.
Twelve (12 notices were mailed to property owners within two hundred (2,00) feet of tllc subj ect
property. Three (3) responses were received in favor and zero (0) were reccIvcd in opposition. A
response in favor stated support of the request if used for single-family purposes.
The applicant was present. Jason Culbertson, 11610 Ridgecrest, Beauniont, Texas addressed the
Commission. He stated that the property will be divided into two residential lots. Mr. Culbertson
further stated that the entrance will be a common drive to both lots.
The public hearing on this item was opened and closed without coinment.
Conuiiissioner Jabbar moved to approve the request of a eplat of part of Lot 3, Block 1, Lovell

Mayor West called the Joint Public Hearings of February 24, 2025 to order at 3:15 p.m. and
explained the purpose of the Joint Public Hearing process. Mayor West then turned the meeting
over to Chairman Nej ad to conduct the Joint Public Hearings.
2) PZ2025-22:. Request for a Specific Use Permit to allow an Artisan office and shop
within the CBD (Central Business District).

Mrs. E.Jiginan presented the staff report. Stoney Petit, is requesting a Specific Use, Permit to operate
an Artisan office and shop at 450 Bowie Street in the CBD (Central Business District). Anderson
Artisans is a skilled carpentry business specializing in crcating one-of-a-kinn wooden pieces. The
Central Business District is intended to acconiniodate the conimercial offices and serviec,
residential and public activities. The use of the property as a bLISiness office and shop could aid ill
economic growth of the downtown area. Although the CBD district does not have parking
requirements, our City's Traffic Engineer has reviewed the proposal and has no inuilediate
concerns.
Slides of the site plan and subject property were shown.
Staff recomn-iended approval of the request with the following conditions-.
1. Construction plans niust meet all requircii-ients by Water Utilities for water and sanitary
sewer serviecs, including any requirements of the City's backflow, pre-treatment and/or
FOG pro gram.
2. Construction plans shall comply with all applicable Fire and Building Code requirements.
3. All operations of the business shall remain in compliance with Article 12.09 of the City of
Beaumont Code of Ordinances.
`I"wenty-eight (28) notices were mailed to property owners within two hundred (200) feet of the
subject property. Six (6) responses were received in favor and zero (0) were received in opposition.
The applicant was present. Michael S. "Stoney" Petit 11, P.O. Box 5115, Beaulnont, Texas
addressed the Commission. He stated that Anderson Homes will be relocating to the front of the
existing structure. Mr. Petit further stated that Anderson Artisans will operate as a carpentry
con-ipany located in the shop area of the existing building with business hours being 7:30 aril to
4:00 pm.
The public hearing on this item was opened and closed without conmi.ent.
Commissioner Jabbar moved to approve the request for a Specific Use Permit to allow an
Artisan office and shop within the CBD (Central Business District), as requested in PZ2025-22,
with the following conditions:

1. Construction plans must meet all requirements by Water Utilities for water and sanitary

3) PZ,2025-25:. Request for a Rezoning of an R-S (Residential Single -Family Dwelling)
zoning district to a GC -MD (General Conin-iercial-Multiple Family
Dwelling) zoning district.
Applicant: Jaramillo Lucas
Location: 6690 Rebecca Lane
Mrs. Engman presented the staff report. Property Owner Jaramillo Lucas, is requesting a rezoning
for the 1.08- acre property at 6690 Rebecca Lane, located at the intersection of Rebecca Lane and
Comstock Road. Mr. Lucas seeks to change the zoning from R-S (Rcsidential ',Single Family
Dwelling) to GC -MD (General Commercial Multiple — Family DwellIng) District. This request
follows a violation notice from the Planning Departmcnt, indicating that his business "Luccis Lcnt�n
Seri;ice & Londscciping LLU' is not in compliance with the City's adopted Code of Ordinances.
The rezoning request is intended to allow his business to contimie operating at this location.
If approved, this rezoning could result in "spot zoning", introducing a high -density commercial
use(s) into a predominantly single-family residential area. This includes surrounding properties,
such as Lefler Park to the west. The proposed rezoning is not consistent with the Comprehensive
Plan for Beaumont and may violate Chapter 211 of the Local Government Code.
According to the Con-iprehensive Plan the property is located within a "Stable Area", which is

Staff recommended denial of this request.
Thirteen (13) notices were mailed to property owncrs within two hundred (20 0) feet of the sir j ect
property. Zero (0) responses were received in favor and zero (0) were received in opposition.
Brief discussion was had concerning the location currently being operated as a lawn business.
A representative and agent of the applicant was present. Attorney Douglas Greer (representative),
2905 Toccoa., Beaumont, Texas and Ricardo Alvarez (agent), 3012 Glenwood Avenue, Beaumont,
Texas addressed the Commission, Mr. Greer read a prepared statement and presented a packet
(Exhibit 1) for Commission rciliew. He stated that the request is justified because of its unique
places cnt of the lot involved; the current nature of the Rebecca Lane neighborhood area; and, the
manner in which the business is conducted. Mr. Greer further stated that the lawn busincss is not
visible from street view and is mostly surrounded by forest. He also stated that the entrance and
exit to the business is located on Comstock Road, has no walk-in customers, and does not impact
the Rebecca Lane neighborhood.

Chairman Nejad made a motion to allow Mr. Greer additional time to speak. Commissioner
Noyola seconded the motion. The motion to approve the request to allow Mr. Greer additional
tine e to speak carried 8:0.
Mr. Greer continued by stating that it appears that con-imercial and industrial activity currently
exists within the Rebecca Lane neighborhood. He further stated that the lawn business does not
have open signage and all services are conducted off -site.
Mr. Alvarez stated that business has been in operation for four years, beginning with two
employees and currently havingsix employees with most con-imuting together to and from work.
He ftirther stated that the hours of operation are 9:00 am to 4:00 pm, witli no loud jioises from

equipment.
Mr. Greer stated that employees of the lawn business voluntarily remove litter from Lefler Park.
He further stated that the business is licensed with the State of Texas, are tax payers, and bave had
no con-iplaints from neighboring property owners.
Furthcr discussion followed relating to equipment located on the property and visibility from the
street.
The public hearing on this item was opened and closed without comment.
Additional discussion was had concerning specifies of spot zoning and rezoning, along with how
it relates to future sale of property.
Specifics of denial of the request and tabling the request were discussed.

4. This lawn care business does not sell products to the consuming public flu- ough
walk-in sales. It travels to its clients' homes and businesses to provide its services. It does not add
to any congestion on the, roads of the Rebecca Lane neighborhood.

Tabitha Haygood, of Fitt z & Shipman, Inc. requests approval of the Preliminary plat for Whispering
Heights, Phase 11. Conditional approval was previously granted in April of 2022. However, no final
plat has been recorded prompting the renewal of the Preliminary Plat in compliance with section
26.02.002(c) of the Code of Ordinances which states`*. Failure to prepare a final plat and have it
recorded in accordance with the provisions of this chapter within twenty-four (24)months from the
date of preliminary plat approval shall result in the expiration of the previous approval. #
The development is located north of Rehan Wood Street. The 5.53 acre development will feature
eighteen (1) new residential single family lots, in an R-S (Residential Single -Family Dwelling)
zoning district. The proposed residential streets Taher Wood and Yasmin Wood Street will have a
50 ft. right-of-way with a 27 ft, pavement width. All lots will access Pointe Parkway via the
extension of Mumtaz Drive and the existing Behan Wood Street. Water and sewer will be provided
by extension of City utilities.
Section 2 6.03.0 0 2- (4) states, "'Colle cto r s tre e ts and minor collector s tree ts shall b e constructed in
new subdivisions by the subdivider. A street serving more than sixty-four (64), but less than four
h un dred fifty (50) dwelling unit. , shall be a minor collector s tre e t with a right -of- way of n o less
than sixty (60) feet and a thirty -.six foof curb to face of curb pavement. , ."Addresses
condition #1.
Section 26.03.008(a)(2) states, "Streetlights shall be installed at a// intersections and at additional
locations not less than two hundred (200) feet apart: Locations shall be designated so as to provide
an average separation of approximately two hundred fifty (250)feet." Addresses condition #2
Section 2 6.0 3. 11 states, "Utility e cis em en ts and wo ter and sewer facilities shall be provided by the
subdivider in accordance with the standards and specification for m inim um water and sanitary
sewer requirem en ts on file in the office of the water u tilities director for" the city,' Ad dresses

Section 26.02.0off. states, ""..the subdivider shall submit a moster or tentative plan for a//
contiguous a property owned or intended for development by the subdivider as req uire d by the

utilities, droinage facilities and park and open space needs. "
Planning staff recommends approval of the request with the following conditions:
1. Correct the right-of-way width and pavement width for Mumtaz Drive to be in accordance
with Section 26.O3OO2Nl.
2. Space streetlights to meet City Subdivision Ordinance requirements. Revise the streetlight
layout plan tomeet City Ordinance Requirements.
B. Construction plans must meet all requirements by Water Utilities for water and sanitary sewer
services, including any requirements of the City's back -flow, pre-treatment and/or FOG
4. Relocate the sanitary sewer service connections to be offset from the telecom and energy
easement for Blocks 5-7,asshown 1ndetail H-Z9.
5. submit an updated master plan prior to the recordation of the plat.

Rebecca Lane, located at the intersection of Rebecca Lane and Comstock Road. Mr. Lucas seeks
tochange the zoning from R-S(Residential Single Family Dwelling) toGC-MD (General
follows a violation notice from the Planning Department, indicating thathis business "'Lucas
Lawn Service & Landscuping LLC' is not in compliance with the City"s adopted Code of
Ordinances. This notification came following a report from the Cities Heavy Trash operators
that the location was putting lawn service debris to the street weekly for pick up.
The rezoning request isintended toallow his business tocontinue operating aithis location.
If approved, this rezoning could result in "spot zoning", introducing a high -density commercial
use(s) into a predominantly single-family residential area. This includes surrounding properties,
such as Lefler Park to the west. The proposed rezoning is not consistent with the
Comprehensive Plan for Beaumont and may violate Chapter 211 of the Local Government Code.

We represent Mr. Jaranfillo Lucas in this matter. This letter is sent as part of a Rezone
Application submitted by the above party. Thank you for taking the time to read this letter.
Mr. Lucas is the owner and operator of Lucas Lawn Service & Landscaping LLC. This
Rezone Application pertains to the operation of this business at 6690 Rebecca Lane, Beaumont,
Texas 77708.
We are submitting this Rezone Application before the deadline of Januai-y 29, 2025, in
order for this to be considered by the Planning Commission at its next meeting on February 24,
2025.
On November 22, 2024, Lucas Lawn Service & Landscaping LLC received a letter from
Inspector Lewis of the City of Beaumont Planning & Zoning Division pertaining to an inspection
of this property. This letter informed Mr. Lucas that his business was in violation of the Beaumont
Code of Ordinances Section 28.03.023(a), "Operating Illegal one Use," apparently for operating
a business in an area zoned for residential use.
Accordingly, we are submitting this Rezone Application, requesting that the zoning
designation for this subject address and business operating on same be changed from residential
to commercial use, to accommodate the operation of this business as a commercial entity on this
property and to allow this business to be in compliance with the Beaumont Code of Ordinances.
The reason for this requested change is that the owner of this business wishes to I -Lin this

Mohammed Ali Tejani is requesting approval of a Specific Use Permit to allow a retail liquor
store to be located at 3100 N Major Drive, Suite 2-100. Texas Liquor would be open Monday
through Saturday from 10 a.m. to 9 p.m. and closed on Sundays. They will offer sodas, drink
mixes, beer, wine, and other spirits.
Staff recommends approval of the request with the following conditions:
1. Construction plans must meet all requirements by Water Utilities for water and sanitary
sewer services, including any requirements of the City's back -flow, pre-treatment
and/or FOG program.
