Commissioner Noyola moved to approve the minutes of the Joint Public Hearings held on
November 25, 2024, Commissioner Jabbia seconded the motion. The motion to approve the
Minutes carried 5:0. Alternate Con-LmIssioner Sorrell entered a vote as Commissioner Jabbar was
not yet present.

Mrs. Engman presented the staff report. Access Surveyors, is seeking approval of a eplat of a
portion of Lot 1, Block B, Mayfair. 2 nd Addition, Beaumont, Jefferson County, Texas into Lots 1--
A. and 1-B, Block B. Mayfair 2 nd Addition, Beaumont, Jefferson County, Texas. The intent of the
Replat, is to divide the existing .483 aercs into two residential lots.

Texas addressed the Commission. He stated that width of the smaller lot meets City of Beaumont
minimum lot width requirements and has an adcquate amount of roadway frontage.

Commissioner Jabbar moved to approve the reqUeSt of a Replat of a portion of Lot 1, Block B,

3) PZ2024-328: Request for approval of a Preliminary Plat of Graystone Subdivision,
Phase One, Beaumont, Jefferson County, Texas.

Mrs. Engman presented the staff report. Alberto Flefarto of Fitt z & Shipman, Inc. has requested
Preliminary Plat approval of ray tone Subdivision, Phase 1. Conditional approval of this plat was
previously grantcd in May 2022; however, development did not proceed, and the approval expired
without the rccordation of a final plat. The application is now being brought back to the Planning

Commission for consideration of the 8.5045 acre development, which will consist of 31 new
residential lots within an R-S (Residential Single -Family Dwelling) District. The proposed
collector streets Oak Crest Drive and Maple Grove Drive, will have a 60" wide right-of-way and a
37 ft. back -of -curb to back -of -curb pavement width. Water and sewer will be provided by an
extension of the city' s facilities.

Court, Beauniont, Texas addressed the Commission. The applicant approved of the conditions
recommended by staff.
Commissioner Jabbar moved to approve the request of a Preliminary Plat of Graystoiie

Applicant: Access Surveyors
Location: 4391 and 4635 W. Cardinal Drive
Mrs. Engman presented the staff report. Access Surveyors, is seeking approval of a Replat of Lots
2 and 3 Delta BUSiDess Park Addition, Beaumont, Jefferson County, Texas into Lots 3-A and 3-B,
Delta Business Park Addition, Beaumont, Jefferson County, 'I"exas. The intent of the plat, is to
remedy an illegal division of land and legally subdivide the property into two lots for commercial
or industrial development.
Slides of the site plan and subject property were shown.
Staff recommended approval of the request with the following conditions:
1. Clearly identify the parties responsible for maintenance within the dedicated easement on
the plat, subject to the City's approval, prior to final recordation.
2. The exclusive waterline easement should not be included within the shared access
easement.
Mrs. Engman stated that two additional conditions have been added to the request, being:

3. Add a Plat note to state "Per Clerks file No. 20200039991, Official Public Records of Real
Property, Jefferson County, Texas, the installation, maintenance, and repair of the
Common Access Driveway and related tallity and drainage facilities located therein shall

4. Shall add a Plat note "City of Beaumont" below the call out that says "exclusive
waterline easement."

Brief discussion followed concerning specifies of the request.
The applicant was present. Colby Brackin of Access Surveyors, 11025 Old Voth Road, Beaumont,
Texas addressed the Commission. The applicant approved of the conditions reconui-iended by staff.
The owner was present. Henry LaBrie, 10655 I-lighway 365, Beaumont, Texas addressed the
Commission. He stated that Lot 3-B will be used for future development of buildings for lease and
understands that the lot cannot be divided.

Mayor West called the Joint Public Hearings of December 16, 2024 to order at 3:24 p.m. and
explained the purpose of the Joint Public Hcaring process. Mayor West then turned the meeting
over to Chairman Nejad to conduct the Joint Public Hearings.
5) PZ2024-325: Request for an Amended Specific Use Permit to allow a retail shopping
center with restaurants., clothing stores, food shops, beauty salons and
professional offices on the GC-MD-2 (General Commercial -Multiple
Family Dwelling-2) District portion of the property.
Applicant: Hani Tohnie
Location: 3100 N. Major Drive
Mrs. Engman presented the staff report. In February of 2017, the City Cowicil approved a Specific
Use Permit to allow a 37,750 sq. ft, retail shopping center with 216 parking spaces. The proposed
tenants included retail shopping, offices and restaurants. In April of 2023, the developer received
an An -fended Specific Use Permit to accommodate site layout changes from the original
application.
Hani Tolime is requesting approval of an Amended Specific Use Permit to allow the construction
of a third driveway to serve the retail shopping center. This driveway will be gated and serve as an
access point for delivery trucks.
The submitted site plans show a 5' wide sidewalk to be placed within the Texas Department of
Transportation (TXDOT) right-of-way. Planning staff have not received a copy of a permit issued
from TXDOT allowing a sidewalk within their right-of-way. Therefore, the applicant and their
engaged contractor will be held responsible to ensure development of the facility follows the site
plan approved by the Plaiming Division on March 14, 2023, which den-ionstrated all parts of the
sidewalk to be installed on private property.

Staff recomn-tended approval of the request with the following conditions:
1. Construction plans shall comply with all applicable Building and Fire Code and
requirements.
2. Construction plans must meet all requirements by Water Utilities for water and sanitary
sewer services, including any requirements of the City"s backflow, pre-trcatment and/or
FOG program.
3. Directional lighting shall be installed to reflcct away from the residences located off
village Drive, south of the proposed development.
4. 'I"he 5' wide sidewalk shall be constructed on private property along the front property line,
unless the applicant submits to the Planning Offices written permission from the Texas
Department of Transportation (TXDOT) allowing the sidewalk to be placed within their
right-of-way.

5. Shall submit an amended plans to the Building Official reflecting the construction of the
third driveway.
Forty-two (22) notices were mailed to property owners within two hundred (too) feet of the subject
property. Four (4) responses were received in favor and two (2) were received in opposition. Mrs.
Engman read the responses in favor encouraging new development and opposition expressilig
concerns of a bar in close proximity to their backyard and the area being too small to accommodate
a third driveway.
Brief discussion followed concerning specifies of the conditions. Mrs. Engman explained that the
conditions are original to the Specific Use Permit with the exception of conditions 4 and 5, which
were added to the amend ed request,
The applicant was present. Hani "Foluiie of Golden Triangle Consulting Engineers, 85 Interstate
Frontage Road, Suite 204A, Beaumont, Texas addressed the Commission. He stated TxDOT has
granted final approval of the driveway. Dr. Tolune. turther stated that the driveway will be gated
with a keypad entry for the use of deliveries only, He also discussed the drainage design, which
will flow directly to the Jefferson Counin ty Draage District No. 6 drainage infrastructure. The
applicant approved of the conditions recommended by staff.
The public hearing on this item was opened.
Ronald Smith, 8070 Village Drive, Beauniont, Texas addressed the Commission. He stated that
the project has resulted in daniage to his fencing. Mr. Smith also encouraged growth, but without
damage to private property.
Darwin Bolton, 8050 Village Drive, Beaumont, Texas addressed the Commission. He stated that
he is opposed to the driveway due to traffic safety concerns, drainage, and placement of garbage
containers along the fence line.
Kristine Smith, 8060 Village Drive, Beaumont, Texas addressed the Commission. She stated the
project has resulted in damage to her fencing. She further stated concerns relating to possible
ftirther fencing damage due to the turn radius of the proposed driveway.
Rob Jones, 3698 Canyon Lane, Beaumont, Texas addressed the Commission. He stated that he is
in opposition to the request and inquired as to specifies of the request relating to location of the
proposed driveway.
Carl Gerace, 8040 Village Drive, Beaumont, Texas addressed the Commission. He inquired as to
flow of traffic and turn radius of the proposed driveway. Mr. Gerace also expressed traffic safety
concerns.
Stacey Ojcmcni, 8030 Village Drive, Bcaumont, Texas addressed the Commission. She stated that
she is opposed to the request as she does not want a driveway located along the fencing and
expressed concerns relating to placement of garbage containers along the fence line. Ms. Ojemeni
further inquired as to whether higher fencing will be installed.

Denis Paquet, 2595 Sunflower Lane, Beaumont, Texas addressed the Commission. Mr. Paquet
expressed concerns relating to traffic safety.
Jane Burns, 2mberwood Drive, Beaumont, Texas addressed the Commission. She stated that
she is opposed to the request due to traffic safety concerns.
Courtney DeBettencourt, 2589 Sunflower Lane, Beaumont, Texas addressed the Commission. She
stated the she is opposed to the request due to traffic safety concerns.
The public hearing on this item was closed.
The applicant was given an opportunity to speak in rebuttal. Dr. Tolui-ic stated lie will provide to
the owl-icr/developer the names and addresses of residents with damaged fencing. He further
discussed specifics of the drainage infrastructure and turn radius of the proposed driveway. Dr.
"I"olune further stated that an 8' fence with a landscaping buffer will be installed to provide privacy.
He also stated that the owner/developer will work with the neighbors regarding placement of the
garbage containers. Dr. Tohme further stated that deliveries to the property will be provided by
small delivery trucks. He further noted that should the concerns of the citizens occur in the ftiture,
City ordinances are in place to protect and address those concerns.
Further discussion followed conceming specifics of the request relating to fencing, the landscaping
buffer, and layout of the requested driveway.
Commissioner Jabbia moved to approve the request for an Amended Specific Use Permit to allow
a retail shopping center with restaurants, clothing stores, food shops, beauty salons and

portion of the property, as requested in PZ2024-325, with the following conditions:

6) PZ2024-339: Request for a Specific Use Permit to allow a vehicle storage facility in a
GC -MD (General Conimercial-Multiple Family Dwelling) District.
Applicant: Jennifer & Buddy Dubose
Location: 5525 Cole Street
Mrs. Egan presented the staff report. Jennifer and Buddy Dubose of Hooked Recovery are
requesting approval of a Specific. Use Permit to operate a Vehicle Storage Facility to be locatcd at
5525 Cole Street. Hooked Recovery is a repossession collector for delinquent loans of
automobiles, boats, watercrafts, atv's, recreational vehicles, lawiu-nowers, farm equipment, utility
trailers and more in collaboration Nvith banks through the national repossession database.
Notification of repossession is sent by the bank, and then accepted by I looked Recovery where
they they. locate the requested repossession; once located they notify the batik, and local police
department then relocate the repossessed item to the storage location at 5525 Cole Street. The item
will be held on the lot for a period of 1-60 days based on the lienholders processes.
City of Beaumont Police Department requires all towing services to be registered with the City, in
addition to bearing proof of being licensed and permitted as a tow truck pursuant to State statues.

Staff reconimended approval of the request with the following conditions:
1. "I'he applicant shall be in coinpliance with Articles 12.06 and 6.08 of the City's code of
ordinances.
2. The applicant shall obtain a Certificate of Occupancy from Building Codes.
3. All repossessed items must be located within the enclosed area and shall not be stored on
any right-of-way.
4. Any Riture construction plans niust ineet all requirements by Water utilities for water and
sanitary sewer services, including any requirements of the City's back -flow, pre-treatment
and/or FOGIr program.
Twenty (20) notices wcre mailed to property owners within two hundred (too) feet of the subject
property. Zero (0) responses were received in favor and one (1) was received in opposition.
Protest against this request was received from more than 20% of the land immediately adjoining
the subjcct property. Therefore, a vote of flu-ce-fouiths (3/4) of the City Council shall be required
to approve the requested Specific Use Permit.
Brief discussion followed concerning fencing of the property.
The applicant was not present.

ordinances.

Mrs. Engman presented the staff report. Dion Lowe and Alicia Ramsey, are requesting approval
of a Specific Use Permit to allow a drinking establishment to be located at 3110 N Major Drive,
Building C, Suite 5.
The proposed operations will run from 12:00 PM to 2:00 AM. The business plans to offer specialty
drinks, and finger foods. The applicant intends to cater to after or needs for professionals, with
a dress code and age limit for patrons.
Slides of the site plan and subject property were shown.
Staff reconuiiended approval of the request with the following conditions:
1. The establishment and property premises shall remain in compliance with the building
code, fire code,,, zoning code, offenses and nuisance code,, health and sanitation code and
all other applicable codes of the city.
2. Construction plans must meet all requirements by Water Utilities for water and sanitary
sewer services, including any requirements of the City's back -flow, pre-treatment and/or

Forty-two (42) notices were mailed to property owners within two hundred (200) feet of the Sub 'ject
property. Four (4) responses were received in favor and four (4) per c received in opposition. Mrs.
Enginan read the responses in favor encouraging new development and being in favor of the
request if the establishment does not produce loud noise or music, to disturb the neighborhood.
Those in opposition expressed concerns of noise, drunk driving, and proximity of a bar to their
neighborhood and backyards.
The applicants were present. Dion Lowe and Alicia Ramsey, 6370 Arrowhead Drive, Beaumont,
Texas addressed the Commission. Ms. Ramsey stated that the establishment will have a lounge
atmosphere with no loud music. Mr. Lowe stated that he has previous experience operatin gc'-i bar
and restaurant. Ms. Ramsey further stated that security will be provided during operating hours.
The applicant approved of the conditions rcconimended by staff.
Brief discussion followed concerning the number of staff to be employed and the site occupancy
rate.

Courtney DeBettencourt, 2589 Sunflower Lane, Beaumont, Texas addressed the Commission. She
stated the she is opposed to the request due to concerns of noise, lighting, property safety, traffic
safety, and property value.
Charles Cox,, 3510 Grayson Lane, Beaumont, Texas addressed the Commission. He stated that he
is opposed to the request due to traffic safety concerns.
Denis Paquet, 2595 Sunflower Lane, Beauniont, Texas addressed the COMMiSSiOD.Mr. Paq-tiet
expressed concerns relating to the age limit of the establishment patrons, noise, and drunk driving.
He further inquired as to the type of drinking place that will be operated.
Darwin Bolton., 8050 Village Drive, Beaumont, Texas addressed the Commission. He stated that
the owner/developer has not addressed the ditch hole created along his property line as a result of
the project. Mr. Bolton further stated that he is opposed to the request due to noise, drunk driving,
location of the outdoor patio, and traffic safety concerns.
Rob Jones on behalf of the Fairfield Homeowners Association, 3698 Canyon Lane, Beauniont,
Texas addressed the Commission. He stated that the Association is opposed to the request due to
noise., drunk driving, and traffic safety concerns.
Kristine Smith, 8060 Village Drive, Beaumont,'Fexas addressed the Commission. She stated the
she is opposed to the request due to noise, patron age, location of the outdoor patio, and traffic
safety concerns.

she is opposed to the request due to close proximity of the subdivision and neighborhood park,
drunk driving, and traffic safety concerns. Ms. Bums further encouraged the Commission to take
into consideration the opposition expressed by the residents of Fairfield Subdivision.
The public hearing on this item was closed.
The applicants were given an opportunity to speak in rebuttal. Mr. Lowe stated that classical or
jazz music will be played, not loud music. He further stated that security will be on site and that
the establishment will be geared to persons aged 25 and tip. Ms. Ramsey stated that traffic safety
concerns currently exist. She further stated that the business floor plan calls for a large seating area
in order to give it a lounge atmosphere. Ms. Ramsey ftirther stated that employees will be trained
to not over -serve alcohol to customers. Mr. Lowe then provided more details relating to hours of
operation.
The public hearing on this item was re -opened.
Jane Burns, 2545 Amberwood Drive, Beaumont, Texas addressed the Commission. She stated that
the Commission cannot allow approval of the request as the residential location is not proper.

drinking will take place at the establishment, which will destroy the neighborhood.

current request for a drIDking establishment allows for the sale of more alcohol than food. Ms.
Smith further stated that she is opposed to the request.

Commissioner Iyola moved to deny the request for a Specific Use Permit to allow a drinking
place in a GC-MD-2 (General Commercial -Multiple Family Dwelling-2) District, as requested in
PZ2024-349.

STAFF REPORT
Zach Rowe, of Leavins Engineering & Design, LLC, has requested Preliminary Plat approval of
Auroras Estates. The 14.791 acre development consists of 13 new residential lots and is located
within the R-S (Residential Single -Family Dwelling) District. Water and sewer will be provided by
replacement and extension of the city' s facilities.
Leavins Engineering is also seeking approval of two) waivers. The developer requests
approval of a waiver to extend the maximum cul-de-sac length from 800-'to 1000'. Section
26.03.002 (8) (A) states "a cul-de-sac shall be no more than eight hundred feet long, unless
top ograph y, de nsity, a deq ua te circulo tio n, or other un us u ol con di tions n e cessita te a greater
len g th, and shall te rm in a te at a circle with ci m in im um righ t- of- way radius of fifty (5 0) fee t are
d
o po vem en t radius of thirty-three (33) feet back to back of curb. "
The developer seeks approval of a second waiver to allow the extension of Timber Ridge Lane
to be constructed using material other than concrete paving. Section 26.03.002 states "'The
arrangement, classification, character, extent, width, grade and location of all public and
priva te s tre e ts shall co nform to the ma or street and hi g h way plan, the official s tre e t
construction standards and the official street construction specifications of the city..."' Timber
Ridge Lane is an existing asphalt road, our standards currently call for the use of concrete for
new construction streets. The applicant is requesting to complete the cul-de-sac using asphalt
to maintain consistency.
Timber Ridge Lane currently serves three residential properties; the proposed cul-de-sac
extension will add an additional three residential properties for a total of six properties served
on the 1000' cul-de-sac street. The proposed waivers will greatly enhance the existing dead end
street and provide adequate emergency service accesses.
Section 2 6.0 2.0 0 2- (a) (9) .states, "'The location of existing and proposed s e we rs,, water and gas
mains and other public utilities easements and improvements." Address condition #1.
IFC2021 Appendix C Section C103 Hydrant spacing states "Fire apparatus access roods and
public streets providing required access to buildings in accordance with Section 503 shall be
F provided with one or more fire hydrants, as determined by Section CI 02. 1. "' Address condition
Section 24.05.009 states, ""no structure or land shall hereafter be located, altered or have its use
changed withoutfull comphance with the terms of this article and other applicable regulations"
Address condition #3.
Section 26.02,002(a)(15) states, "a list of the proposed restrictive covenants, conditions, and
limitations to govern the nature and use of the property being subdivided." Address condition
#4.
The Planning staff recommends approval of this request and two (2) waivers with the following
conditions:
1. Construction plans must meet all requirements by Water Utilities for water and sanitary
sewer services,
2. Shall comply with IFC 2021 adding hydrants to the new 6" waterline at 500' intervals
along Timber Ridge Lane.
3. All development shall comply with the Flood Damage Prevention Ordinance.
4. Shall clearly label the responsible party for maintenance of the drainage easements on
the final plat to be recorded.

and Timber Ridge Lane. Water distribution service and fire protection will be provided to the proposed lots and
existing nearby residences by constructing a six-inch (6") line along Best Road and Voth Road alongside the City's
existing thirty -inch (Bo") line as well as by replacing an existing three-inch (3") line along Timber Ridge Lane. Sanitary
sewer collection will be extended to those portions not currently served within the development by extending and
eight -inch (8" collection I in e east along Voth Road and north along Timber Ridge Lane.
For those lots fronting Best Toad and Voth Road, storm water runoff will be collected and conveyed northward via
existing roadside ditches. Lots 11, 12 and 13 will drain to an existing pond located within a proposed 5.791-acre
common area, which in turn is drained via an existing channel to Best Road. The drainage plan proposes to
perpetuate the existing drainage of the proposed lots and Timber Ridge Lane in a northerly direction through the
subdivision where it discharges back to an existing roadside ditch on the south side of Voth Road.

Eleuterio Albarran, representing SDB Development LP, is seeking approval of a Specific Use
Permit to allow a duplex within the R-S zoning district located at 5450 Concord Road. In July
2024, the property was issued a stop work order when an inspection revealed repairs occurred
without a permit. Additionally, it was revealed this property was converted into 4 dwelling
units in recent years. If approved, this request would allow for the property owner to reduce
the n u rn ber of units from 4 to 2, which would bri ng this property into compliance with tine
City's zoning regulations.
