HomeMy WebLinkAboutRES 24-262RESOLUTION NO.24-262 BE IT RESOLVED BY THE CITY COUNCIL QF THE CITY OF BEAUMONT: THAT the City Council adopt a Communication Plan with the Fire Union for contract negotiations in the form attached hereto as Exhibit "A." The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. PASSED BY THE CITY COUNCIL, of the City of Bepumont this the 15th day of October, 2024. �i Mayor Roy West - ADDENDUM A COMMUNICATIONS PLAN DURING COLLECTIVE BARGAINING The City of Beaurnont (CITY) is a Civil Service city pursuant to Chapter 143 of the Local Government Code. The Firefighters' Local 399 (FIRE UNION) and Beaumont Police Union (POLICE UNION) are the Bargaining Units for the Beaumont Firefighters and the Beaumont Police Officers, respectively. This document acknowledges that the City Council (COUNCIL) recognizes that the CITY'S City Manager and individuals appointed by the City Manager shall represent the CITY during the Collective Bargaining process. 1, The purpose of this document is to outline the comtllunication process between the CITY, the FIRE UNION, and the POLICE UNION (collectively as the PARTIES) during [lie Collective Bargaining process to promote professional and productive negotiations. a, The Collective Bargaining process begins upon the adoption of the Ground Rules, 2. The Collective Bargaining process is divided into four phrases: 1. Preparation a. During this stage the PARTIES prepare and exchange initial proposals and adopt the Ground Rules. 2. Negotiations a. The PARTIES will meet during a series of prescheduled Negotiation Sessions. b. The Negotiation Sessions are open to the public. c. The COUNCIL is permitted to attend as a member of the public and shall not participate in the negotiation discussions. 3. Contract Expiration a. The expiration of the contract shall not affect the Communications Plan. 4. Ratification a. A final contract document shall be presented to the COUNCIL as an agenda item. b. The COUNCIL shall have the authority to amend, modify, or adopt as written the final contract document. 3. The COUNCIL acknowledges and understands that the PARTIES have adopted Ground Rules; those documents upon their execution are incorporated herein as part of this Communications Plan as Addendum A. 4. The COUNCIL acknowledges and understands that any request for information regarding the status negotiations shall be directed to the CITY's City Manager. 1IPage ADDENDUM A a. The City Manager agrees to respond timely to all requests for information. S. The COUNCIL aclurowledges and understands that members of the FIRE UNION and POLICE UNION should not contact or attempt to contact the COUNCIL directly or indirectly during the Collective Bargaining process. 6. The COUNCIL acknowledges and understands that they should not contact or attempt to contact members of the DIRE UNION or POLICE UNION or their representatives directly or indirectly during the Collective Bargaining process. 7. The document shall present the entirety of the Communications Plan, and any changes shall be brought to the COUNCIL for approval and adoption. 8, Nothing in this document is intended to restrict the authority of the COUNCIL granted to it under the CITY's Charter. 21Page
