Mrs. Engman presented the staff report. Brayden Gott of Fittz and Shipman Inc., has requested
approval of a Replat of Lots 1-9, Luca Estates into Lots I A-9A, Luca Estates, Beaumont, Jefferson
County, Texas. "I"he intention of the plat is to adjust the northern property lines of the existing lots
to create larger lots for future devclopment.

Staff reconimended approval of the request.
Twenty-two (22) notices were mailed to property owners within two hundred (200) feet of the
subject property. One (1) response was received in favor and zero (0) in opposition.
Brief discussion followed concerning the dilapidated building located on the property.

will be demolished.

Mrs. Engman presented the staff report. Brayden Gott of Fittz and Shipman Inc., requests approval
of a Replat of Tract 2, Block 3, Garden Villas Replat and of Lot 26A, Block 3, Garden Villas
Replat, Beaumont, Jefferson County, Texas into Lots' I and 2, Shady Gardens, Addition,
Beaumont, Jefferson County, Texas. The intent on the Replat, is for Lot I to absorb approxim'ately
149' X 195' of Lot 2 giving Lot I a depth of approximately 424'. The property is located south of
Highway 90 in the City of Beaumont's Extraterritorial Jurisdiction.

JOINT PUBLIC HEARINGS
Mayor West called the Joint Public Hearings of August 19, 2024 to order at 3:13 p.m. and
explained the purpose of the Joint Public Hearing process. Mayor West then turned the meeting
over to Chairman NeJ ad to conduct the Joint Public Hearings.
4) PZ2024-163: Request for a Rezoning Study of Isla Street and thesurrounding area
bordered by Oak and Street, Magnolia Avenue, Maple Street and IH 10
Eastbound feeder road.
Applicant: City of Beaumont
Location: Isla Street and the surrounding area bordered by Oakland Street, Magnolia
Avenue, Maple S treet and II I 10 Eastbound feeder road
Mrs. Hngn-ian presented the staff report, In March of 2024, planning staff received concerns of
commercial uses encroaching into a residential neighborhood near the Isla Street area. Research
revealed that this area has been zoned as Ll (Light Industrial) since 198 1. Development ill this area
have been stagnant and very little industrial uses lave taken advantage of the existing zoning
district. To preserve the existing residential land uses and address a lack of development, staff Is
proposing a rezoning of the area between Oakland Street heading east to Magnolia Avellue and
from Maple Street extending south to Interstate 10 Eastbound feeder road to encourage appropriate
infill development to this area.

Existing uses are pred01111nantly residential with some light commercial uses, churches and one
truck lot. Staff is recommending a zone change from Ll (Light Industrial) zoning district to ICE
(Residential Conservation Revitalization), GC -MD (General Commercial — Multiple Family
Dwelling), GC-MD-2 and NC (Neighborhood Commercial) zonii)g districts. Over the last 15
years, ten (10) structures were demolished, and four (4) residential homes were constrLICted.
The entirety of Oakland Street including 1405 Isla, 1420 Concord and fron-i 1890 Magnolia south
to where Magnolia intersects IH 10 East Feeder Road, to be rezoned from LI (Light Industrial)
zoning district to GC -MD (General Commercial- Multiple Family Dwelling) zoning district. This
will foster the existing commercial zoning heading south along Magnolia and will cxtend the
commercial zoning district from Martin Luther King Parkway south to Concord Road.
The so-tithern side of Maple Strcet, beginning at 1075 Maple Street through to 1355 Maple Street,
including the 2000 Blocks of Linson Street, Forrest Street, and Cable Avenue to end at Isla Street
be rezoned to RCR (residential Conservation Revitalization) zoning district. This will allow for
both residential developments, and some commercial developinew with an approved Spceific Use
Permit.
The lots known as 2036 Linson and 1260 Isla, are recommended to be rezoned to GC-MD-2
(General Commercial- Multiple Family Dwelling-2) zoning district as this plot of land is an
established truck lot. Staff recognizes the existence of the use and its proximity to neighboring
residences, the GC-MD-2 general Commcreial-Multiple Family Dwelling-2) zoning district will

allow the truck lot to be CODfOrIlling and ensure necessary protection to neighboring residences
should expansion occur.

200' south from where Isla Street intersects Cable Avenue is proposed to be rezoned from Ll
(Light Industrial) zoning district to NC (Neighborhood Commercial) zoning district to allow for
smaller neighborhood type uses, such as a comer store, beauty salon, etc.
"I'he remaining portions of the outlined area, along Isla, Linson, Forrest, St Charles and Cable, are
proposed to be rezoned from LI (Light. Industrial) zoning district to ICI (Residential Conservation
Revitalization) ZODing district allowing for residential development and some commercial
development with an approved Specific Use Permit.

Staff recommended approval of the request
Two hundred thirteen (21 notices were mailed to property owners within two hundred (200) feet
of the subject property. Zero (0) responses were received in favor and zero (0) in opposition.
The public hearing on this item was opened.
Eddie Mc riff, 4835 Ada Street, Beaumont, Texas addressed the Commission. He stated that the

established track lot adds to street deterioration it is a noise pollution nuisance during evening
hours, and individuals are residing on the property. Mr. McGriff further stated that he wishes to

preserve the integrity of the neighborhood and welcomes new housing. He also stated that he is in
favor of the request.
Brief discussion followed relating to the established truck lot and potential new housing in the
area.
The public hearing on this item was closed.
Commissioner. Makin moved to approve the reqtiest for a Rezoning Study of Isla Street and the
SUrrounding area bordered by Oakland Street, Magnolia Avenue, Maple Street and 1H 10
Eastbound feeder road, as requested in 1'Z2024-163.
Commissioner Linton seconded the motion. The motion to approve the request carried 5:0.
5) PZ2024-182: Request for a Specific User Permit to allow swimming lessons in an FPS
(Residential Single Family Dwelling) zoning district.
Applicant: Staci Ishee
Location: 8130 Shenandoah Drive
Mrs. Engnian presented the staff report. Staci Ishee, is requesting a Specific Use Permit to continue
offering swimming lessons at the home located at 81 0 Shenandoah Drivc. Ms. Ishee has taught
at this location for thirty (30) years, beghming tentatively in May with private lessons by
appointment. Group classes begin in June running through July for about 6 weeks Ms. Ishce
teaches ten (10) classes per day with a maxin-iuni of eight (8) students per class. Classes are held
Monday through Thtirsday from 9:00 any to 1:00 pm. and resuming in the afternoon from 3:00 pm
to 6:45 pm. Private lessons may also be booked through August.
Ms. Ishee began with teaching her own children, sparking a program focused on swimming as a
critical life skill, with the increasing number of homes with pools and proximity to natural bodies
of water in our area. Classes are available for both children and adults

Staff recomn-iendcd approval of the request with the following condition:
1. Per Engineering, the driveway can accommodate four (4) cars and seventeen (17) cars can
park on the street. At no point shall cars block driveways or restrict life safety vehicles to
navigate the neighborhood. The owner of the business shall be responsible for enforcing
such parking restrictions.
Twenty-one (21) notices were mailed to property owners within two hundred (200) feet of the
subject property. One (1) response was received in favor and one (1) in opposition. Mrs. Engman
read the notice in opposition in which the resident expressed concerns that the request will result
in too much traffic and noise. She also read the notice in favor of the requcst in which the resident
stated that they are not opposed to parking along the street.

Commission. Ms. Ishee presented to the Coy amission photos and cinails in support of licr request
(Exhibit "A"). She also read a prepared statement describing her enjoyment of teaching swimming
lessons.
Chairman Nejad moved to allow Mrs. Ishee to exceed the three minute limit and continue speakijig.
Commissioner Makin seconded the motion. The motion to approve the request carried 5:0.

According to the Comprehensive Plan' the property is located within a "Conservation

2003, to allow for a welding shop, post the rezoning and allowance of a parking lot expansion for
Exxon Mobil adjacent from the property.
The proposed rezoning, appears to be in accordance with the Comprehensive Plan as it would allow
for the expansion and growth of existing businesses within the Conservation Revitalization Area.

read the notice in opposition to the rcquest which stated that the owner wishes to construct a home
and does not want to have umiecessary complications with building on their property.
The applicant was present. Jaquincy Durousseau, 2055 en loci Street, Beaumont, Texas
addressed the Commission. He stated that he wishes to teach welding classes at his place of
business. Mr. Durousseau read a prepared statement outlining the history of his business and the
purpose of the requested item.
Brief discussion followed concerning specifics of the request and the dilapidated structure located
on the neighboring property.

Commissioner Loyola moved to approve the request for a Rezoning from an IW-H (Residential
Multiple Family -High Density) zoning district to an LI (Light Industrial) or a more restrictive
zoning district, as requested in PZ2024-199.
Commissioner Beatty seconded the motion. The motion to approve the request carried 5 -00.
7) PZ2024-214: Request for a Rezoning from a PUD (Planned Unit DevelopIlIcnt) zoning

more restrictive zoning district.

Parkway. The purpose of the rezoning is to allow for commercial development.

The proposed zoning district allows for uses that could benefit the growing area, Such as

veterinarian services, general merchandise stores,, food stores, apparel, furniture, eating places, etc.
Additional uses include business offices, like real estate, accounting firms, insurance office. This
could allow for neighborhood stores and localized shopping and offices for residents and
businesses located north of Highway 105.

Mrs. Engman pre sented the staff report. Tyler Wharton is requesting a S peel 5 c Use Permit to a I I ow
a tool and equipment rental store at 3105 Eastex Freeway. This property previously operated at a
used car dealership and has an existing office, concrete parking, fencing and lighting. The applicant
will offer selling and leasing of tractors, trailers, and hand held construction equipment.

applicant approves of the conditions recommended by staff.

Commissioner Makin moved to approve the request for a Specific Use Permit to allow commercial
equipment rental and sales within the GC -MD (General Commercial -Multiple Family Dwelling)
zoning district, as requested in PZ2024-228, with the following conditions:
1. Any construction plans must meet all requiren-tents by Water Utilities for water and sanitary
sewer services, including any requirements of the City's back -flow pre-treatment and/or
FOG program.

Mrs. Engman presented the staff report. Tyler Wharton is seeking a Rezoning from an RCR-1-1
(Residential Conservation Revitalization Historic) zoning district to an RCR (Residential
Conservation Revitalization) zoning district and a Specific Use Permit to allow restaurants,
professional offices, commercial retail, administrative offices, and music studio at 660 North 7"'
Street. Mr. Wharton has recently purchased the property and intends to renovate it to allow for
smaller commercial developments to serve the unique bistoric area and its residents.
According to the City's comprehensive plan this property is located within a "Stable Area"'. Such

of Ordinances.
Seventeen (17) notices were mailed to property owners within two hundred (too) feet of the
subject property. Zero (0) responses were received in favor and zero (0) in opposition,
Brief discussion followed concerning possible renovations to the exterior of the building, which is
located within the Historic District. Mrs. Engnian explained that currently no exterior renovations
have been requested and should a request be made, the item would be presented to the Historic
Landmark Commission for consideration.
The applicant was present. Tyler Wharton, 2467 Calder Street, Beaumont, Texas addressed the
Commission. fie stated that building is currently 30% occupied and there is limited parking in the
rear of the propert3r. Mr. Wharton ftirther stated that he owns the neighboring properties on either
side of the strLicture with additional parking available.
The public hearing on this item�Nras opened and closed without comment.
Commissioner Linton moved to approve the request for a Rezoning from an RCR-H (Residential
Conservation Revitalization -Historic) zoning district to ail RCR (Residential Conservation
Revitalization) zoning district and a Specific Use Permit to allow restaurants, professional offices,

Like many other southeast Texas families, 0M, son, Blare Broussard IV, started switTirning lessons with Stab Isle e at just one
year old. He continued every surnmer Until 5 years old.
Our home has a swimming pool. Our biggest fear was our son not knowing how to swim at a young age. With Stacif S
gUidance, teaching, and instruction OUr son quickly learned the basics. Starting with what to do if he fell in the pool, holding
his breath, and not being afraid if he did fall in the pool. By age 5, OUr son could safely swim by himself with suporvision.
We thank Staci and her team for easing OUr minds by teaching our soil swimming lessons. The residence where the lessons
occurred were a familiar and comfortable setting f0r0LJ1' son beCaUse they were just like the pool in the backyard of our home.
We consider Staci's swimming lessons to be an essential business in our community, and Off area WOUld have a huge void

Ib wino rn it may concern, I am the oldest of 4 kids and my morn enrolled me in swimming lessons when I was 10 years old
with Mrs Ishee, She not only taught me brit My brothers and sister as well. We met Mrs Ishee at our elementary school where
she had worked a few years before. When I began lessons I was terrified of the water but Mrs Ishee along with her son
worked with me Until I overcame my fear and after taking lessons with her for 2 years me and my younger brother graduated
tier COUrse as swirnmers. My sister and little brother continues to take tier course every summer while she allows me and my
younger brother to swim just for the fun before she begins class. Her lessons are taught with patience and gUidance to help
aid her students to become strong swirnmers and to make sure that we know how to survive in any water situation that may

Ishee, who has been an integral part of our lives since she began teaching our son, Benjamin, to swim when he was just
three years old.
As the parents of a child with a disability, finding someone who not only Understands but also patiently and creatively
addresses the unique challenges our son faces has been an enormous blessing. Benjamin has not been able to walk since
the age of 8, but in the pool, he can walk, jump, and do many other things able-bodied children can do. Staci's patience and
determination were evident from the very beginning, as she worked to develop an adaptive technique that would allow
Benjamin to swim safely. Thanks to tier innovative approach, Benjamin has been swimming for the past 15 years and
counting.
I would be there to share all of this in person today, but I am currently getting Benjamin settled in at Texas A& M , where ho
will major in engineering with the long -terra goal of designing handicapped -accessible vehicles. Learning to swim is one of
the many pieces that have contributed to his confidence and independence, making it possible for him to attend college
three hours away.
The impact of Staci's dedication goes far beyond the pool. Her adaptive techniques allowed Benjamin to be the only camper
in his age grOLIp at IDA camp to pass the swim test, enabling him to swim Independently withOLA a life preserver. The
achievement of learning how to swim was not just a milestone in his swimming journey; it has been a significant step toward
greater independence and confidence in all aspects of his life.
Staci's influence extends beyond Benjamin. She also taught two of our daughters, who both joined the SHARKS Beaumont
SLImmer swim team, and Our oldest daughter excelled on OUr school's swim team, earning several ribbons and medals in
competition. These accomplishments are a direct result of Staci's exceptional teaching and her ability to inspire confidence
and skill in her students. We are now looking forward to her teaching our two -year -old daughter how to swim in the next few
years.
To our family, Staci is more than a swim instructor —she is like family. Her kind and determined nature, COLIpled with her
expertise, has been life -changing for our special needs son and deeply it paCtfUl for our entire family. We wholeheartedly
recommend her to anyone seeking swim lessons, regardless of their limitations or drCUmstances.
It is our sincere hope that Staci will be allowed to continue her important work. The difference she makes in the lives of
children and their families is profound, and we cannot imagine a more deserving person to continue doing what she does
