RESOLUTION NO.24-091 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: WHEREAS, Entergy Texas, Inc., has requested that the City grant an eighteen feet (18') wide utility casement to allow the relocation and installation of new utility poles at the intersection of Liberty Avenue and N 13"' Street, said easement being a 0,0135-acre tract of land out and part of Lots 21 and 22, Block 30 of Jarrette Addition, situated in the Noah Tevis League Survey, Abstract No. 52, as described in Exhibit "A," and attached hereto; and, WHEREAS, the City Council has considered the purpose of said conveyance and is of the opinion that the acceptance of said conveyance is necessary and desirable and that same should be accepted; NOW, THEREFORE,, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and THAT said above -described utility easement requested from Entergy Texas, Inc., be and the same is hereby, in all things, accepted. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Goveriu-rent Code, Chapter 551. ("Property") The Right -of -Way granted is in the area as shown by the attached Exhibits A & B hereto attached and made a part hereof, Grantee shall apply for a Street Cut and Barricading permit with Grantor before the start of construction, Grantee shall hydro -vac waterlines during the installation and anchoring of instruments near Grantor's waterlines. Grantee shall backfll hydro -vac location sites with a flowable Wokfill mix that meets all requirements of TxDOT Item 401; attached as Exhibit C hereto attached and made a part hereof. plowable fill mix design shall be a mimmum of 100 psi compressive strength at twenty-eight (28) days. Unless otherwise herein specifically provided, the center line of the Grantee facilities initially constructed on this Right -of -Way shall be the center line of the Right -of -Way; together with the right of ingress and egress to and front the Right -of -Way across the adjoining land of the Grantor, Grantee shall have the right to install and maintain gates in all existing and future fences crossing tile Property where same intersects the Right -of -Way to provide access to and fi•om the Grantee Facilities, provided such gates will be installed in a planner that will not unreasonably weaken such fences. Grantee shall have the full and continuing right, but not the obligation, to clear and keep clear vegetation within or growing into the Right -of -Way and the further right to remove or modify fi•ohll time to tune trees, limbs, and/or vegetation outside the Itiglit-of Way which is dead, decaying or in danger of falling or leaning oil Grantee Facilities, by use of a variety of methods used in the vegetation management indust.y. Grantor reserves the right to continue to use and enjoy the surface of tile, Easement Area for all purposes that do not interfere with or interrupt the use or enjoyment of the Easement by Grantee for the purposes provided herein, including but not limited to the right to place surfacing materials over and across the ) moment.
