The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance
with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on April 2, 2024, at
the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider

Mayor West called the council meeting to order at 1:30 p.m.
Pastor Justin Buchanan, with Calvary Baptist Church gave the invocation. Mayor West led the
Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.

REGULAR AGENDA
1. Council to consider a resolution approving the purchase and installation of remote fuel
level monitors and related control panels for Water Production generators.
The City owns and maintains one (1) generator at Lawson's Pump Station and three (3)
generators at the Pine Street Water Treatment Plant. This project is to furnish and install
fuel level devices for remote monitoring of the generator fuel volume. The control panels
for the four (4) generators will also be upgraded to communicate with the fuel level
devices.
The total cost of the work is $125,212.34. Mustang CAT will perform the work as an
authorized dealer and sole source provider for Caterpillar machinery, service, and parts.
Funds will come from the Water Fund.

Councilmember Neild moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL BE AND ARE
HEREBY AUTHORIZED TO APPROVE THE PURCHASE AND INSTALLATION OF REMOTE FUEL LEVEL
MONITORS AND RELATED CONTROL PANELS FOR WATER PRODUCTION GENERATORS AT THE
LAWSON PUMP STATION IN THE AMOUNT OF $125,212.34 FROM MUSTANG CAT OF HOUSTON,
TEXAS. Councilmember Samuel seconded the motion.

2. Council to consider a request for rezoning from R-S (Residential Single -Family Dwelling)
District to GC -MD (General Commercial -Multiple Family Dwelling) District or a more
restrictive district for property located at 3060 North Dowlen Road.
David Fenner of Dowlen Road Church of Christ is requesting approval for a Rezoning
from R-S (Residential Single -Family Dwelling) to GC -MD (General Commercial — Multiple -
Family Dwelling) for the property located at 3060 North Dowlen Road. The intent of the
rezone request is to streamline development procedures for any future expansion or
reuse of the church. If the zoning district were to remain R-S a Specific Use Permit would
be required if the church intended to expand or re -use the building for other purposes.
Furthermore, Dowlen Road is categorized as a major arterial and common planning
practices encourage commercial uses along such roadways.
At a Joint Public Hearing held on March 18, 2024, the Planning Commission
recommended 8:0 to approve the request for Rezoning from R-S (Residential Single -
Family Dwelling) District to GC -MD (General Commercial -Multiple Family Dwelling)
District or a more restrictive district for property located at 3060 North Dowlen Road.

Councilmember Feldschau moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE
AMENDING CHAPTER 28 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN
PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP
OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED R-S
(RESIDENTIAL SINGLE-FAMILY DWELLING) DISTRICT TO GC -MD GENERAL COMMERCIAL -MULTIPLE
FAMILY DWELLING DISTRICT FOR PROPERTY LOCATED AT 3060 NORTH DOWLEN ROAD,
BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL

3. Council to consider a request for Rezoning from R-S (Residential Single -Family Dwelling)
District to LI (Light Industrial) District or a more restrictive district or a more restrictive
district for property located at 5895 Lafin Drive.
The City of Beaumont Planning Division requests approval to rezone 5895 Lafin Drive
from R-S (Residential Single -Family Dwelling) District to LI (Light Industrial) District. The
northern half of this site is currently used as the City's landfill and is zoned LI while the
southern half remains undeveloped and zoned R-S. Planning staff is recommending
amending the zoning district of the city -owned properties to have a consistent zoning
district and minimize any delays to future projects or expansion of the landfill.
According to the City's Comprehensive Plan the property is located within the designated
"Landfill" area. This request appears to align with the plan.

4. Council to consider a resolution authorizing the City Manager to submit a grant
application and execute a contract with the Federal Transit Administration (FTA) to
receive partial Operating Assistance Funds for the ZIP.
The City of Beaumont through its transit operator the Zip has prepared a grant application
for FY2024 partial grant funds from the FTA. The partial grant will help fund labor, fringe
benefits, vehicles, parts and supplies, purchased services, utilities, insurance, licenses,
and all other miscellaneous expenses needed for the operation and maintenance of the
Zip incurred in FY2024. The partial grant period runs from October 1, 2023, through
March 1, 2024.
Funds will come from the Federal Transit Administration.

$1,150,863.00 TO RECEIVE PARTIAL OPERATING ASSISTANCE FUNDS FOR THE ZIP THROUGH THE

5. Council to consider amending Chapter 2, Section 2.03.074 of the Code of Ordinances to
add twelve Grade 1 Firefighters positions.
The EMS Division, formerly a part of the Public Health Department, was moved into the
Fire Department in January 2021. In March 2021, the Council adopted Ordinance No. 21-
009, which added nine additional firefighter positions. At that time, Council was presented
with a plan to convert vacant EMS positions to firefighter positions provided that the
conversion was successful, and funding was available. The purpose of the plan was to
have a more secure staffing plan. In accordance with this plan, the Administration has
identified twelve vacancies in the EMS Division and is proposing to convert those twelve
vacancies to firefighter positions.
Funds will come from the General Fund.

support agreement with Creative Switching Designs, Inc. of

BACKGROUND
The Mitel phone system is in use in a large number of City facilities. The system provides
telephone communications, voice mail and four -digit dialing. The purchase is exempt from
competitive bidding since it is available from only one (1) source having exclusive rights to
maintain the Mitel infrastructure. The annual cost is $74,897.25.

feet (10') Exclusive Water Line Easement.
BACKGROUND
Family Services of Southeast Texas, Inc. has agreed to convey a ten feet (10') exclusive water
line easement to the City of Beaumont. The easement is described as being a 0.4547 acre tract of
land out of the Thomas Spear Survey, Abstract No. 50.
The easement is required for the construction of a water line and associated fire hydrants and
meters to serve a new facility located at 6730 Concord Road.

WHEREAS, Family Services of Southeast Texas, Inc., has agreed to convey a ten (10')
foot wide Water Line Easement to the City of Beaumont, said easement being a 0.4547-acre tract
of land out of the Thomas Spear Survey, Abstract No. 50, as described in Exhibit "A," and attached
hereto, to the City of Beaumont for a new facility located at 6730 Concord Road; and,
WHEREAS, the City Council has considered the purpose of said conveyance and is of the
opinion that the acceptance of said conveyance is necessary and desirable and that same should be

Jefferson, State of Texas, and being more particularly described in Exhibit "A",, attached and
made a part hereof for all purposes (the "Easement Area").
The Easement herein granted shall be used for the purpose of placing, constructing,
operating, repairing, rebuilding, replacing, relocating, and/or removing water lines and related
appurtenances in the Easement Area, and, it is expressly understood and agreed that the City of
Beaumont shall have the right of reasonable ingress to and egress from the Easement Area and
use of the same for the purposes aforesaid; provided, however that Grantee use of the Easement
and the rights appurtenant thereto shall in no event unreasonably interfere with or hinder the
business operations on the Grantor's adjacent property and/or Grantor's ingress and egress
thereto.
Grantor reserves the right to continue to use and enjoy the surface of the Easement Area
for all purposes that do not interfere with or interrupt the use or enjoyment of the Easement by
Grantee for the purposes provided herein, including but not limited to the right to place surfacing
materials over and across the Easement Area and to use the same for parking areas, driveways,
walkways or sidewalks; provided, however, no permanent buildings may be placed on the
Easement Area. Notwithstanding the foregoing, Grantee shall not be responsible for the repair
and replacement of any improvements placed by Grantor within the Easement Area and the same
shall be repaired and maintained by Grantor, at Grantor's sole cost and expense.
The conveyance of the Easement granted herein is made by Grantor and accepted by
Grantee subject to any and all existing casements, covenants, rights -of -way, conditions,
restrictions, outstanding mineral interests and royalty interests, if any, in the Easement Area of
record in the office of the County Clerk of the County of Jefferson (collectively, the "Permitted
Exceptions").
This Easement may be amended or terminated only by the written consent of the parties
hereto, or their respective successors and assigns.
TO HAVE AND TO HOLD the above described easement and right-of-way unto the said
CITY OF BEAUMONT, its successors and assigns forever, by, through, or under Grantor, but
not otherwise, subject to the Permitted Exceptions,

REQUESTED ACTION: Council consider a resolution authorizing the granting of an eighteen
feet (18') Utility Easement to Entergy Texas, Inc.
BACKGROUND
Entergy Texas, Inc., has requested the City grant an eighteen feet (18') wide utility easement to
allow the relocation and installation of new utility poles at the intersection of Liberty Avenue
and N 13th Street. The relocation of the utility poles onto City property is required by TxDOT
for the Interstate 10/US Highway 69 Interchanges project. The easement is described as being a
0.0135 acre tract of land out and part of Lots 21 and 22, Block 30 of Jarrette Addition, Jefferson
County, Texas situated in the Noah Tevis League Survey, Abstract No. 52.

Not applicable.

WHEREAS, Entergy Texas, Inc., has requested that the City grant an eighteen feet (18')
wide utility easement to allow the relocation and installation of new utility poles at the intersection
of Liberty Avenue and N 131h Street, said easement being a 0.0135-acre tract of land out and part
of Lots 21 and 22, Block 30 of Jarrette Addition, situated in the Noah Tevis League Survey,
Abstract No. 52, as described in Exhibit "A," and attached hereto; and,
WHEREAS, the City Council has considered the purpose of said conveyance and is of the
opinion that the acceptance of said conveyance is necessary and desirable and that same should be
accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and
THAT said above -described utility easement requested from Entergy Texas, Inc., be and
the same is hereby, in all things, accepted.
The meeting at which this resolution was approved was in all things conducted in strict

The Right -of -Way granted is in the area as shown by the attached Exhibits A & B hereto attached and made a part
hereof.
Grantee shall apply for a Street Cut and Barricading permit with Grantor before the start of construction. Grantee
shall hydro -vac waterlines during the installation and anchoring of instruments near Grantor's waterlines. Grantee
shall backfill hydro -vac location sites with a flowable backrill mix that meets all requirements orTxDOT Item 401;
attached as Exhibit C hereto attached and made a pail hereof. Flowable fill mix design shall be a minimum of 100
psi compressive strength at twenty-eight (28) days.
Unless otherwise herein specifically provided, the center line of the Grantee Facilities initially constructed oil this
Right -of -Way shall be the center line of the Right -of -Way; together with the right of ingress and egress to and from.
the Right -of -Way across the adjoining land of the Grantor. Grantee shall have the right to install and maintain gates
in all existing and future fences crossing the Property where same intersects the Right -of Way to provide access to
and from the Grantee Facilities, provided such gates will be installed in a manner that will not unreasonably weaken
such fences.
Grantee shall have the full and continuing right, but not the obligation, to clear and keep clear vegetation within of -
growing into the Right -of -Way and the further right to remove or modify from time to time trees, limbs, and/or
vegetation outside the Right -of -Way which is dead, decaying or in danger of failing or leaning on. Grantee Facilities,
by use of a variety of methods used in the vegetation management industry.
Grantor reserves the right to continue to use and enjoy the surface of the Easement Area for all purposes
that do not interfere with or interrupt the use or enjoyment of the Easement by Grantee for the purposes provided
herein, including but not limited to the right to place surfacing materials over and across the Easement Area and to
use the same for parking areas, driveways, walkways or sidewalks, landscaping and/or lighting; provided, however,
no permanent buildings may be placed on the Easement Area. Notwithstanding the foregoing, Grantee shall not be

REQUESTED ACTION: Council consider a resolution approving the purchase of a
replacement for the City's Mitel phone system from Creative
Switching Designs, Inc. of Brookshire, TX.
BACKGROUND
The City presently relies on Mitel Connect for its phone system across various City Departments.
However, the existing software and hardware have reached the end of their operational life and
necessitate an upgrade to Mitel Business.
The upgraded system will retain all the features of the current one while incorporating new
capabilities such as phone line recording, Contact Center integration, compatibility with 0365,
and updated phone equipment.
Furthermore, the new system will enable additional functionality for licensed users, including the
ability to remotely access their office phone via a mobile app. This enhancement will be
particularly advantageous for employees who regularly work in the field or have been authorized
for remote work.
The cost of the project will be $487,370.83 and was budgeted for fiscal year 2024. The
purchase is exempt from competitive bidding since it is available from only one source having
exclusive rights to maintain the Mitel infrastructure.
FUNDING SOURCE
Captial Reserve and General Fund.

Effluent Pump Replacement at the Wastewater Treatment Plant.
BACKGROUND
There are currently four (4) Effluent Pumps (#2, #3, #4, and #6) in operation at the Wetland
Pump Station. Following the nutrient removal, as part of the final stage of treatment, the
Wetland pumps move water from eight (8) constructed treatment cells to the natural Wetland.
During normal operations the Wetland has two (2) of the four (4) pumps operating with the
remaining pumps as backup for alternating the equipment to reduce wear, backup in the event of
repairs, and for periods of increased storm water flow. In emergencies such as a hurricane or
tropical storm, all four (4) pumps are used to meet the City's sewage needs. The current
Effluent Pump #3 was rebuilt in 2015, and routine maintenance through the years has discovered
a considerable amount of rust and wear, and replacement before failure is recommended.
City staff has obtained three (3) quotes and upon review recommends purchasing from Coastal
Pump Services, Inc., of Manvel, Texas. The total pricing for one (1) Lo-Lift vertical mixed
flow pump and motor is $162,741.00. The delivery time is estimated to be between 12-14
weeks after the order is received.

Water Revenue Bonds.

the Street Rehabilitation Citywide - Phase V (REBID) Project.
BACKGROUND
On November 7, 2023, by Resolution No. 23-338, City Council awarded a contract to ALLCO,
LLC, of Beaumont, in the amount of $6,847,514.00, for the Street Rehabilitation Citywide —
Phase V (REBID) Project.
Proposed Change Order No. 1, in the amount of $150,836.75, is needed to add items for Rusk
Street, and to adjust quantities for both Masterson Drive and Potter Drive. Change Order No. 1
will add items to remove and replace damaged or collapsed storm sewer infrastructure on Rusk
Street that was discovered after the asphalt was milled off of the road. Concrete pavement and
curb repairs will be required at the intersection of Rusk Street and 6th Street where most of the
storm sewer infrastructure repairs will be performed. 60 additional days will be added to the
contract for the additional work on Rusk Street. Additionally, the scope of work for both
Masterson Drive and Potter Drive will change from milling and ASB repairs to full depth
reclamation. No additional days will be added to the contract for the change in work for both
Masterson Drive and Potter Drive. If approved, Change Order No. 1 will result in a new contract
amount of $6,998,350.75.

REQUESTED ACTION: Council consider a resolution authorizing the City Manager to
execute Change Order No. 3 to the contract with ALLCO LLC, of
Beaumont, for the 48-Inch Pine Street Raw Water Line Project.
BACKGROUND
On July 18, 2023, by Resolution No. 23-193, City Council awarded a contract to ALLCO, LLC,
of Beaumont, in the amount of $29,191,513.63.
Previous Change Order Nos. 1 - 2 in the amount of ($8,957,185.65) are attached for your review.
Proposed Change Order No. 3, in the amount of $57,744, is requested to relocate an existing 10
inch sanitary sewer main from the path of installation of the proposed 48-inch raw water line at
the intersection of Coleman St. and Pine St. This existing sewer main and adjacent manhole were
not shown on the City's inventory map, nor were they located in the field by the surveyors as the
manhole was covered by soil and vegetation. The proposed scope of this change order is to
install a new upstream manhole, lower the 10-inch sewer pipe to an elevation below that of the
48-inch raw water line, and replace the existing brick manhole with a new fiberglass manhole.
The contractor will provide for bypass pumping of the sewer flow while this work is completed.
If approved, Change Order No. 3 would result in a new contract amount of $20,292,071.98 with
an additional three (3) calendar days to the contract time.
FUNDING SOURCE
Certificates of Obligation and CDBG/GLO.

BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
WHEREAS, on July 18, 2023, by Resolution 23-193, City Council awarded a contract to
ALLCO, LLC, of Beaumont, Texas, in the amount of $29,191,513.63, for the 48-Inch Pine Street
Raw Water Line Project; and,
WHEREAS, previous Change Orders No. 1-2, in the amount of ($8,957,185.65), resulted
in a decrease to the original contract; and,
WHEREAS, proposed Change Order No. 3, in the amount of $57,744.00, is requested to

NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT the City Manager be and he is hereby authorized to execute Change Order No. 3 in
the amount of $57,744.00 to adjust the estimated quantities in the contract to reflect the actual
quantities used in the completion of the project, thereby increasing the total contract amount to
$20,292,071.98 for the 48-Inch Pine Street Raw Water Line Project; and,
WHEREAS, adding an additional three (3) calendar days to the contract is necessary for
the competition of the work.
The meeting at which this resolution was approved was in all things conducted in strict
compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.

roughly St. 48 80. After internal inspection, it was determined that the line ties into
the manhole on the other side of Pine Street. After verifying sanitary sewer line
elevations, the line appears to be in conflict with the new 48" raw water line. Please
provide directions on how to proceed in this location with the sanitary sewer line.,

Received survey data from Soutex on Friday April 5. Confirmed 10 Inch Sanitary
Sewer is in conflict with 48-Inch RWL. Propose installing two manholes (upstream
and downstream) that lower elevation of existing Sanitary Sewer to about Flow Line
Elevation 8.5 Ft. This will give a clearance of 2.5 ft to bottom of proposed 48-Inch
RWL. Utilized Revised Plan Sheet PL-011 (copy attached) and add Specification 33
05 01.13, "Sanitary Sewer Pipe (PVC)". Contractor to remove and replace existing 10-
inch diameter sanitary sewer in conflict with that of new 10-inch, SDR 26 PVC pipe
per added Specification (copy attached). Use fiberglass manhole detail for
construction of the 2-new sanitary sewer manholes (copy of fiberglass detail
attached).

33 05 01.13 SANITARY SEWER PIPE (PVC)
1.00 GENERAL
1.01 WORK INCLUDED
A. Furnish labor, materials, equipment, and incidentals necessary to install 4- through 48-inch
gravity flow PVC pipe. Trenching, backfilling, and pipe embedment shall be in accordance
with Section 3123 33 "Trenching and Backfill [Utilities]."
1.02 QUALITY ASSURANCE
A. Certification: The sewer pipe manufacturer shall provide certification that the pipe supplied
conforms to these specifications and shall include laboratory tests results that support such
certification. If the manufacturer is unable to provide the certification, an independent
testing facility shall be utilized and retained at no cost to the Owner. The pipe supplied shall
be permanently marked with the manufacturer's name, the date of manufacture, and
identification with the tests performed to warrant its certification as being in conformance
with this standard.
B. Testing:
1. At a minimum, actual test results shall be required as follows:
a. Load bearing tests.
b. Material tests.
c. Hydrostatic tests.
2. Tests on PVC pipe 4 through 48 inches shall be made in accordance with appropriate
ASTM standard testing procedures and shall be performed on a minimum of 1 percent
of the pipe purchased.
C. Inspection: An inspection of the pipe after delivery to the Project shall be made by a
representative of the Owner. Pipe with visible defects which are indicative of poor
structural condition or poor workmanship shall be rejected and replaced without cost to the
Owner. Visible defects shall include cracks of any type, honeycombs, or any other defects of
poor workmanship. Any pipe rejected shall not be returned under any condition to the
Project.
1.03 SUBMITTALS
A. Submittals shall be in accordance with Section 0133 00 "Document Management" and shall
include:
1. Shop Drawing including the following information:
a. Product data sheet.
b. Manufacturer.
c. Nominal pipe diameter.
d. Standard dimension ratio (SDR).

2.01 MATERIALS
A. Gravity Pipe: ASTM D3034 4- to 15-inch SDR 26 or ASTM F679 18- to 48-inch PS46 (115)
Polyvinyl chloride pipe with bell and spigot compression joints. Pipe shall have a home mark
on the spigot to indicate proper penetration when the joint is made.
1. Use green coloring for ground identification as sanitary sewer pipe.
2. PVC meeting the requirements of ASTM D1784, with a cell classification of 12454 or
12364.
B. Gaskets: Conform to ASTM F477.
C. Joints: Tested in accordance with ASTM D3212.
D. Services: Where pressure rated piping is called for on the Drawings, PVC service laterals
shall be pressure rated.
3.00 EXECUTION
3.01 INSTALLATION
A. Install pipe to the lines and grades indicated. Begin installation at the downstream
discharge connection point and make connections where indicated.
B. Carefully lower sanitary sewage pipe into the trench to avoid damage to the pipe. Remove
dirt and trash from the pipe while suspended. Keep pipe clean during laying operations, and
seal the pipe against entrance of objects at the close of each operating day.
C. Where a gravity flow PVC wastewater line is within 9 feet of, and parallels a waterline,
construct the sewer of PVC meeting ASTM or AWWA specifications with a minimum
pressure rating for both the pipe and joints of 150 psi. The vertical separation shall be a
minimum of 2 feet between outside diameters and the horizontal separation shall be a
minimum of 4 feet between outside diameters. The gravity flow line shall be located below
the waterline.
D. Where a gravity flow PVC wastewater line crosses a waterline, construct the wastewater line
of PVC with a minimum pressure rating of 150 psi, and maintain an absolute minimum
distance of 6 inches between outside diameters. In addition, the wastewater line shall be
located below the waterline where possible and one length of the wastewater pipe must be
centered on the waterline.
E. Where a gravity flow PVC wastewater line crosses over a waterline, construct all portions of
the wastewater line within 9 feet of the waterline of PVC pipe with a pressure rating of at
least 150 psi with one joint of pipe centered on the waterline, using appropriate adapters.
Minimum horizontal deflection shall be 133 percent of manufacturers minimum radius or 75
percent of the manufacturer's maximum recommended joint deflection.
3.02 FIELD QUALITY CONTROL
A. Hydrostatic leak test gravity flow sewer lines shall be in accordance with the following:
1. Perform hydrostatic leak tests after backfilling.

2. The length of the pipe to be tested shall be such that the head over the crown of the
upstream end is not less than 2 feet or 2 feet above the ground water level whichever is
higher and the head over the downstream crown is not more than 6 feet.
3. Plug the pipe by pneumatic bags or mechanical plugs so that the air can be released
from the pipe while it is being filled with water.
4. Make provisions for measuring the amount of water required to maintain the water at a
constant level during this period.
5. The maximum allowable leakage is 10 gallons per inch of diameter per mile of pipe per
24 hours.
6. Remove the jointing material and remake the joint if any joint shows any visible leakage
or infiltration.
7. Remove and replace any defective or broken pipes.
8. Determine the rates of infiltration by means of V-Notch weirs, pipe spigot, or plugs in
the end of the pipe. Methods, times, and locations are subject to the Engineer's
approval.
9. Pipe with visible leaks or infiltration or exceeds the maximum allowable leakage or
infiltration is considered defective and must be corrected.
B. Low Pressure Air Test- Gravity Flow Sewer Lines:
Use air test in lieu of the hydrostatic test if desired, or if pipeline grades do not allow
filling the entire pipeline segment or manhole to the indicated depth.
Perform low-pressure air tests, using equipment specifically designed and manufactured
for the purpose of testing sewer pipelines using low-pressure air. Test is to conform to
procedure described in ASTM F1417 except for testing times. The following test times
are required:

a. Provide the equipment with an air regulator valve or air safety valve set to an
internal air pressure in the pipeline that cannot exceed 6 psig.
b. Pass air through a single control panel.
c. Provide pneumatic plugs that have a sealing length equal to or greater than the
circumference of the pipe to be tested.
d. Provide pneumatic plugs that resist internal test pressures without requiring
external bracing or blocking.
e. Provide an air compressor of adequate capacity for charging the system.
3. Perform air test only on lines 33 inches in diameter or smaller. Air tests for pipes larger
than 27 inches may be air tested at each joint.
4. Check connections for leakage with a soap solution. Release the air pressure, repair the
leak, and retest with soap solution until results are satisfactory, before resuming air test
if leaks are found.

1. Perform deflection tests on flexible and semi -rigid pipe in accordance with TCEQ
requirements.
a. The maximum allowable deflection of pipe measured as the reduction in vertical
inside diameter is 5.0 percent unless specified otherwise.
b. Conduct test after the final backfill has been in place a minimum of 30 days.

REQUESTED ACTION: Council consider a resolution authorizing eminent domain
proceeding to acquire a lift station easement at 250 South 4th Street.
BACKGROUND
The City originally obtained a 15-foot-wide temporary construction easement from Sampson
Steel Corporation during the construction of the 4th Street underpass pump station. After the
temporary construction easement lapsed, City staff continued to use it to access the pump station
as there was no other path to the station. An adjacent 15-foot-wide drainage easement is blocked
with various above ground utilities, barring its use as an access easement. After Sampson Steel
sold the property to Kelley Property Investment, LLC, the City was prohibited from continuing
to utilize the former temporary construction easement for access.
The City, realizing that a permanent easement had never been secured, contacted Kelley Property
Investment, LLC to acquire the lift station easement. The owner accepted the offer but after
several attempts within the last two (2) years, the owner's attorney has been unsuccessful in
providing the City proper documentation to secure said easement.
The subject property was appraised by Cook & Associates, Inc., as described:

BACKGROUND
The Planning and Community Development Department seeks authorization to submit a grant
application to the Resilient Communities Program and execute a contract if awarded. The Texas
General Land Office has released an opportunity of funding to cities for development of a
comprehensive plan that integrates hazard mitigation plans. A comprehensive plan sets forth a
vision and goals for a city's future and provides the overall foundation for all land use regulation.
Our goal is to take an all-inclusive approach to analyze and evaluate the future growth of our
community, with a focus toward resilience and mitigation.

THAT the City Manager be and he is hereby authorized to submit a grant application and
execute a contract with the Texas General Land Office to receive funds to develop the

The Texas General Land Office (GLO) allocated up to $100 million in Community Development Block Grant Mitigation (CDBG-
MIT) funds for the Resilient Communities Program (RCP). The RCP will fund the development, adoption, and implementation
of modern and resilient building codes and flood damage prevention ordinances to ensure that structures built within the
community can withstand future hazards.
Communities are encouraged to also learn about RCP's companion program, the Local Hazard Mitigation Plans Program (LHMPP), which is

Eligibility Criteria
Applications will have a maximum of $300,000 per applicant, first -come first -served.
At least 50% must address mitigation needs in the CDBG-MIT most impacted and distressed (MID) areas identified by the United States
Department of Housing and Urban Development (HUD).
Eligible Applicants
Units of local government (e.g., cities, counties, federally recognized tribes, and councils of governments) located in a CDBG-MIT eligible area.
Entity must have legal authority to adopt and enforce the building code, zoning ordinance, land use plan, and/or comprehensive plan
proposed in the RCP application.

REQUESTED ACTION: Council conduct a public hearing authorizing the City Manager to
submit a grant application and execute a contract with the Federal
Transit Administration (FTA) to receive funds for the Zip.
BACKGROUND
Administration seeks authorization to submit a grant application to the FY24 Bus and Bus
Facilities Program. To improve our transit system, it is imperative to enhance our bus stops, real-
time tracking technology, transit facilities and expand transit services.
Requested funding to the FTA will be $3,333,234, which requires a local match of $788,599.
TXDOT has committed $788,599 in transportation development credits to subsidize our local
match. Grant funds will be used to reroof transit headquarters, procure real-time tracking
hardware, implement credit card payment capabilities, install sixty (60) bus shelters and benches,
and procure two (2) vans to extend services to the HWY 105, Major, Folsom and Northwest
Parkway area.

PTN has reviewed The City of Beaumont's project to be submitted for the fiscal year (FY) 2024
5339(b) Bus and Bus Facilities Competitive Grant Program funding opportunity for the Beaumont
urbanized area and finds that the project is eligible for TDC. If funds are awarded, PTN will take
necessary actions to award an amount of up to 788,610 TDC for use as match.
PTN has considered the potential of the projects to expand the availability of funding for public
transportation projects and finds that the project meets the established goals set forth in Title 43,
Texas Administrative Code, §5.102 to support public transit and maximize the use of available
federal funds, particularly in situations in which federal funds otherwise would be unused because of
the inability to provide the non-federal share.

prescription assistance, transportation, housing assistance, utility assistance, food assistance, and other
supportive services.
3. Spindletop Center $20,000-Funding will enable Spindletop Center to implement the installation of two (2)
generators at group homes for extremely fragile, low to moderate income residents with severe intellectual
and developmental disabilities
4. RISE CENTER $20,000-Funds wiLL provide availability of affordable, reliable transportation to local medical
appointments for clients with disabilities.
5. Julie Rogers Gift of Life $18,500-Funding in support of the organization's medical and cancer prevention
outreach initiatives that include the Women's Breast & Men's Prostate Cancer Prevention Programs for 2300
Low to moderate -income Beaumont residents and the H.O.P.E Program (health, outreach, prevention,
education) which advances health and wellness for disadvantaged youth and adults.
6. IEA $20,000-Funding to further reduce incarceration and recidivism rates by expanding IEA's capacity to
provide therapeutic counseling services for more than 75 at -risk, juvenile justice -involved youth.
7. Child Abuse Forensic Services $20,000-Funds requested are budgeted to cover on -call hourly pay of
$3.25/hour. CAFS schedules SANE Nurses to cover 8,760 hours of on -call time per year.
8. Shorkey Education and Rehabilitation Center $20,000-The funding request will support the client screenings
conducted by therapists and follow-up reports for pediatricians for 80 children with special needs.
9. Legacy Community Health Services $20,000-The funding request will support the existing UberHealth
Transportation program, thereby addressing the significant transportation barrier and enhancing healthcare
accessibility for 1667patients in Beaumont city limits.
