HomeMy WebLinkAboutRES 24-084 RESOLUTION NO. 24-084 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: WHEREAS, on July 27, 1988, and on January 20, 1989, weed liens were attached to property legally described as Calder L7 B32 (1186 Laurel Street); and, WHEREAS, the total weed lien principal amount due is $370.00, with lien assessment fees of$6.00; and, WHEREAS, since the filing of said liens, the total amount of interest accrued through April 2, 2024, is $1,293.33 equaling a total amount of$1,669.33; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be and is hereby authorized to waive the weed lien interest in the amount of $1,293.33, and accept payment in the amount of $376.00 for the principal and assessment fee for the two (2)weed liens. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. The current property owner of record is Say Thi Gilfillian (married last name is Warren). The liens were in the name of Van Bay Nguyen, et ux and were filed in the County records in 1988 and 1989. I originally received a payoff request from Capital Title on February 14, 2024. I provided them with a payoff for the two (2) liens which at that time totaled $1,666.19, and then I sent them an updated payoff in the amount of$1,668.11 at their request which was good through March 20, 2024 (attached). This included interest and filing fee charges. On March 13 we were contacted by the current owner of record, Say Warren, asking if there was a way to get relief from the interest charges since the liens were so old, and she never knew anything about the liens or she would have paid for them long ago before all the interest had accrued. Mrs. Warrant was provided with the procedure to request relief, and we received her request letter Friday, March 15 (attatched). If you have any questions,please let me know. Thank you. I will get to the point as to why I am writing to you. I have recently been made aware of a lien against my lot that I have owned since December 1998. I have maintained the grass cutting and pay property tax to it and have been doing so for 26 years now. It became more of a burden than a blessing to me, but I paid the taxes and did maintenance on a regular basis. After 26 yrs., I have recently put this lot on the market and have an interested buyer.We went through the process of transfer only to be alerted by Capital Title Company,that there is a lien and 1/2 alley abandonment(2/22/24). We settled the'/2 alley abandonment, but there's this lien I need to clear up. I previously did not know that there's a lien on it or why.After the directions of the reactor, the title company,sister-in-law who works for the city, and the Internet,my journey led me to Ms. Lynn Foote(Code Enforcement Supervisor). Ms. Foote is patient and answered my many questions, even the ones I did NOT want to hear. For example,the lien was placed so long ago that the city does not keep archived photos to the tot so that I could confirmed it mine and not my neighbors on either side of me or the city does not send notification that there is a balance owed to the next owner. Ms. Foote did advise me and gave me an option.This leads me to you. Ms. Ray, I am writing to ask you to waive or reduce the interest charges accrued on this lien.The original amounts are two$185.00(Total$370)and total interest since July 27, 1988,and January 20, 1989, is$1480.11.I have attached supporting documents for your convenience, but I am sure you could also confirm it with your sources. I am not trying to escape my responsibilities,but had I known back then,I would have immediately taken care of this lien or had I been notified at any point in time, I would have taken the initiative to lessen my burden. 1 I have not done anything with this lot except to religiously pay tax and maintenance and have no plans to develop on this lot, please help me so I could transfer it to another individual who will. c-rcly, • ill; Say t ren 409-926-7815 2
