January 22, 2024. Commissioner Makin seconded the motion. The motion to approve the minutes

Mrs. Engman presented the staff report. Jared Riggenbach has applied for the abandom-nent of a
6' wide se Ter line easement at 4595 College Street. The easement is located along the southern
property line of Lot 8 in the College Acres Addition. Redevelopment of this property for all
O'Reilly Auto Parts shop requires the sanitary sewer line to be re-routed to accommodate their
plan, which necessitates an abandonment of the existing sewer easement.
Slides of the site plan and subject property were shown.
Planning staff recommended approval of the request with the following condition:
1. A new easement and sanitary sewer line to be dedicated to the city.
The applicant was present. Jared Riggenbach of Baseline Corporation, 1750 Seamist Drive, Suite
160, Houston, Texas addressed the Commission. No questions were asked of the applicant.
Commissioner Makin moved to approve the request to abandon a sanitary sewer easement in Lot
8 of the college Acres Addition, as requested in PZ2024-17, with the following condition-.

Mrs. Engman presented the staff report. Tabitha Haygood of Fitt z and Shipman has requested
approval of a Replat of Lots 6, 7 and 8, Block 1, Lovell Lake Estates Addition into Lots 7A and
8A, Block 1, Lovell Lake Estates Addition, Beaumont, Jefferson County, Texas. This property is
located within the City's extraterritorial jurisdiction.
The intent of the plat is to increase the property size of Lot 8A by shifting the eastern boundary
line by 18" to the east.

Ten (10) notices were mailed to property owners within two hundred (200) feet of the subject
property. One (1) response was received in favor and zero (0) in opposition.
A representative of the applicant was present. Brayden Gott of Fittz and Shipman, Inc., 1405
Cornerstone Court, Beaumont, Texas addressed the Commission. He stated that that the property
owner would like to expand the driveway and construct a workshop. Mr. Gott ftifther stated that
the property owners involved are in agreement to the request.

3) PZ2024-26: Request for approval of a .eplat of land out of and part of Blocks

and 2 of the Stone Oak RR Industrial Subdivision, Beaumont,
Jefferson County, Texas
Applicant: Tom Rowe of Whiteley Infrastructure Group

Mrs. Engman presented the staff report. Tom Rowe of Whiteley Infrastructure Group has requested
approval of a Replat of land out of and part of Blocks 17, 18, 23 and 24 of the M.C. Cartwright
Subdivision into Lots I and 2. Stone Oak RR 1ndustrial Subdivision, Beaumont Jefferson County,
Texas.
The intent of the plat is to give adequate street frontage to Lot I for future development of the
property.

Planning staff rcconimended approval of the rcqucst.
Thirteen (13) notices were mailed to property owners within two hundred (200) feet of the subject
property. Zero (0) response s were received in favor and zero (0) in opposition.
The applicant was present. Tom Rowe of Whiteley Infrastructure Group, 655 Langham Road, Unit
14, Beaumont, Texas addressed the Commission. Mr. Rowc stated that the purpose of the request
is to allow the property owner frontage access on Stone Oak Drive and to be in con-i-Pliance with
City ordinance.

Conn-tissioner Beatty seconded the motion. The motion to approve the request carried 6:0.

Mayor West called the Joint Public Hearings of February 26, 2024 to order at. 3:19 p.m. and
explained the purpose of the Joint Public Hearing process. Mayor West then turned the meeting
over to Chairman NeJad to conduct the Joint Public Hearings.
4) PZ2024-3: Request for amendments to the Zoning Ordinance concerning yard
requirements for planned unit and cluster housing developments, Section
28.04.004 and 28.04.008
Applicant: City of Beaumont
Mrs. Engman presented the staff report. The City of Beaumont administration requests approval
to amend Sections 28.04.004 and 28.04.008 of the City of Beaumont Code of Ordinances to reduce
the minimum required setback in PUD (Planned Unit Development) zoning districts and cluster
Dousing developmcnts. A setback is a required buffer from the closest edge of a permanent
structure to the nearest property line. Our ordinances for PT D and cluster housing currently require
a minimum front yard setback of twenty-five (25) feet from all public street rights -of -way and the
boundary of the developnwnt.
Section 28.03.023(b) District area and height regulations identify exterior side setbacks measuring
at ten (10) feet in other zoning districts to be adequate distance to avoid sight obstructions. It is
typical of PLED and cluster housing developments to house individuals who wish to have smaller
yard space with larger homes, which are commonly referred to as patio homes. To meet emerging
development trends and community needs, staff requests the setback requirement be reduced from
twenty-five (25) feet to ten (10) feet.
Planning staffrecommended approval of the request.
Mrs. Engman explained that the request only applies to planned unit and cluster housing
developments, not single-fan-ifly or multi -family residential zoning districts. She further noted that
planned unit and cluster housing development requests will require approval of the Planning
Commission and City Council.
Mrs. Engman also stated that the minimum setback requirements are voluntary, not mandatory,
allowing the developer to have a more buildable area in which to construct housing. She further
stated that single- firim i ly and multi -family residential zoning districts wishing to reduce a setback
are required to appear before the Board of Adjustment to request a Variance.

concerning yard requirements for planned unit and cluster housing developments., Section
28.04.004 and 28.04.008, as requested in PZ2024-3.

5) PZ2024-9: Request. for a Specific Use Permit to allow a church within the R-S
(Residential Single -Family Dwelling) District
Applicant: Charles Evans
Location: 2190 Milani Street
Mrs. Engnian presented the staff report. Charles Evans is requesting approval of a Specific Use
Permit to allow a church at 21.90 Milan-1 Street. Pmposed activities of the church include church
services) bible study and Sunday school, Historically, this site was a church although records show
water services being terminated in 2015. Due to the extended vacancy, it is no longer considered
legal nonconforming use. Scction 28,03.023 Pcrinitted uses requires a church located in a
residentialZ011ing district to obtain a successful Specific Use Permit.
This property currently has existing litter and weed violations. These cases will need to be resolved
with the city prior to issuance of a Certificate of Occupancy. February 23, 2024, staff made an
inspection and it was not -iced work was being completed without the benefit of an approved
building permit. A stop work order was posted that same day.

Planning staff recommended approval of the request with the following conditions, which includes
an amendment to condition number 5 not shown in the original packet distributed for this case:
1. Shall remedy all code violations associated with 2190 Milani Street prior to issuance of a
Certificate of Occupancy.
2. A parking lot permit shall be obtained and illustrate the proposed parking lot layout to be
in accordance with city standards including installation of wheel stops to delineate spaces.
3. Shall be in compliance with Section 28.04.006 Landscaping and screening rcquiren-lents if
the parking lot increases 25% or inore in the number of parking spaces.
4. Construction plans must meet all requirements by Water Utilities for water and sanitary
sewer services, including any requirements of the City's backflow, pre-treatment and/or
FOG program.
5. Construction plans must meet all applicable Fire and Building Codc requirements,
including obtaining all applicable building permits.

Sixteen (16) notices were mailed to property owners within two hundred (200) feet of the subject
property. Zero (0) responses were received in favor and zero (0) in opposition.

The applicant was present. Charles Evans, 3735 Perth Place, BeaUmont, Texas addressed the
Commission. Ile stated that. exploratory work was being conducted on FebrUary 23'dand work has
not started mi the property. Mr. Evans ftirther stated that there is no objection to the conditions
recommended by staff. He also stated that the church is owned by Church of God in Christ and
currently has 5-6 members. It was noted that Mr. Evans must comply with the number of parking
spaces and that ADA parking cannot be constructed with gravel.
The public hearing on this item was opened and closed without comment.

(Residential Single -Family Dwelling) District
Applicant: DRC Construction, L.L.C.
Location: 5445 Garner Road
Mrs. Engman presented the staff repod. Caitlin Button of DRC Construction, L.L.C. is requesting
approval of a Specific Use Permit to allow a duplex at 5445 Garner Road. The existing structure
Xs currently vacant and inhabitable.

DRC Construction, L.L.C. intends to construct a duplex to rent the units. This �-Nril I increase housi ng
stock in Beaumont and offer a variety in housing types for tenants who do not wish to reside in an
apartment.
According to our City's Comprehensive Plan the property is located within the "Stable

1. Construction plans must meet all requirements by Water Utilities for water and sanitary
sewer services, including any requirements of the City'backflow, pre-treatment and/or
FOG program.
2. Construction plans shall comply with all applicable Fire and Building Code requirements.
3. A 4' wide sidewalk shall be installed along Garner Road.
Eighteen (18) notices were mailed to property owners within two hundred (200) feet of the subject
property. Zero (0) responses were received in favor and four (4) 111 opposition. One notice in
opposition stated that the property owner felt this request will change the neighborhood and she
did not want to see that happen.
This request received protest from the property owners comprising 28% of the surrounding land
area. Section 28.02.008(d) of the City's Code of Ordinances states., "The city council shall not

A representative of the applicant was present. Caitlin Button of DRC Construction, L.L.C., 8952
Wingfield Drive, Lumbei-ton, Texas addressed the Con-imission. She stated that the existing
StrUCtUre will be demolished and the existing garage will remain for storage. Ms. Button further
stated that the property is owned by DRC Construction, L.L.C. She also stated that she has not
spoken to surrounding property owners, nor has she heard of any objections from them.

Property owner Tom Cockerill, 6495 Highpoint Avenue, Beaumont, Texas addressed the
Commission. He stated that lie has receivcd complaints of the condition of the existing house
located on the property and looks to offer affordable housing by constructing a duplex in place of
the house. Mr. Cockerill ftirther stated that the duplex will be. Constructed on all elevated slab. He
also stated that the property has been owned since 2015 and this will be the first duplex constructed
by DRC Construction, L.L.C. Mr. Cockerill further stated that the existing house was previously
rented.
The public hearing on this iten-i was closed.

SUBJECT: Consider a request for the conveyance and dedication of private streets and
infrastructure to the City of Beaumont.
STAFF REPORT
PZ2021-243maas tabled for six (6)months at the September 18.2O23.Planning Commission
meeting for the purpose of receiving additional information from the owner regarding private
contractor costs and producing plans to bring the streets up to city infrastructure standards.
Staff have not received aby correspondence of associated costs or plans from Scott Holleman
nor the heirs of the A.]. Fasulo Estate yet.
Scott Holleman and the heirs of the Al Fasulo Estate have requested the City of Beaumont to
accept maintenance of the private drive east of Wescalder Road and north of Baker Road, and
its infrastructure. The City recently adopted a process for the conversion of private streets and
other infrastructure to public ownership and maintenance. Also attached is an analysis of the
condition ofthe existing private \nfrastruoture,,conducted bythe Public Works Department.
|n2O2l.engineering conductedasurveyandanalysisofthestreetsandd[a(nage|nfrastructure.
They found that the entire pavement is in very poor condition and requires full rehabilitation.
The ditches had been poorly maintained and not graded properly to drain with driveway
culverts that were not set properly. The condition of the water and sewer lines was unknown.
At the October 2-021 Planning Commission meeting, after some discussion, the Commission
requested a more thorough investigation of the drainage, water and sewer situation and
minimum improvements needed for acceptance of the neighborhood.

The water system requires replacement either before orimmediately after acceptance
ofthe road r|ghts+gf-wvay.This |s toimprove the fire protection tothe development and
to eliminate the multitude of services running from an extensive bank of meters in the
Wescalder right-of-way. The current cost estimate is $275,000 to install water mains,
Urgent Work:
The City would eventually need to set four (4) manholes on the sanitary sewer system to
provide access to the lines for inspection and cleaning. Estimated cost, if performed by a
contractor, |s$4O.00O.
Remaining Work:
The remaining work would be addressed during normal prioritization ofscheduled
workload and are listed |nnospecific order:
w Estimated cost of excavation of roadside ditches, installing driveway culverts to
grade, rehabilitation ofasphalt roads, etc. \s$S2S,l2G.50.

It is an estimated grand total of$]-O25,l26.5O more or less, to bring the current conditions to
standard if the streets and infrastructure are to be accepted and work to be performed by City
staff and a contractor. The grand total may increase due to unforeseen costs.
Fire Department —Fire Marshal reviewed the site, and the Fire Department has concerns about
the width and load limits of the current private street. City streets must have a 75,000-pound
load limit rating and bewide enough for afire apparatus. Most ofthese streets are narrow,
being approximately 10'-12' wide.

provides solid waste services, improvements bzthe roads will berequired tomaintain the
weight of the garbage trucks.
Staff recommends denial due tothe following reasons: narrow width of streets, lack offire

Should Planning Commission choose to approve the request, staff would recommend the
following condition:
1. f\ plat produced by a licensed surveyor must be submitted to the Planning Office prior to
final acceptance of the streets and infrastructure.

COMMENTS
Attached for your review are updated estimates from Public Works/Engincering and Water
Utilities, as well as the Fire Department and Solid Waste recommendations for tea o AJ Fasillo
Estate request for the City of B eaumont to consider accepting the private streets as pubi ic streets.
S ofid 'waste — Solid Waste provides garbage service to 242 5 Wescalder Road. If the City
provides solid waste services, ill1prOWMents to the roads will be required to maintain the weight
of the garbage trucks. There will be no additional expense to provide solid waste services.
Public Worlis/E ngineering — Engineering did a survey and analysis of the streets and drainage
infrastructure. The existing pavement was found to be composed of a mixture of gravel, chunks
of concrete, milling material and asphalt. The entire pavement is in very poor condition and
requires a full rehabilitation. The drainage infrastructure is comprised of an open ditch and
driveway culvert network. The ditches have been poorly maintained and not graded properly to
drain. A majority of the driveway culverts are not set properly to drain water effectively. There
are several buried culvorts that -are impeding drainage. The estimated cost to in-1prove the
drainage and bring the streets up to code is $525,126.50. A detailed cost estimate is attached.
Water Utilities — a review of the plat and construction plans show the water lines are not located
witl�n an utility easernent. dedicated to the City of Beaumont. Due to the urAmown condition of
the water and sewer lines, it is recommended to delay acceptance until water meters are relocated
to meet city standards and sewer services are verified to not run within private property. The
estiniate to construct new water lines., sewer lines and water meters within the public right-of-
way is $492, 00. A detailed cost estimate, is attached.
Fire -De artment — Fire Marshall Joc Condina reviewed the site and the Fire Department has
concems about the width and load limits of the current private strect. City streets must have a
75,000 pound load Ili -nit rating and be wide enough fir a fire, apparatus. A majority of these
streets are narrow being approximately 10' to 12'.
Staff recommends denial due to thce narrow width of the streets, having no fire hydrants along the
streets and load limit concerns. It is recommmded to reject the request until a plat from a
certified civil engineer is provided dedicating the, streets to include, utility and drainage
easements. The. Fire Dcpartni-ent currently provides fire protection for the structures within the
ncighborhood but there are concerns at accessibility and lack of fire hydrants.

The City of Beaumont Planning Division requests approval to rezone 5895 Win Drive from R-S
(Residential Single -Family Dwelling) District to Li (Light Industrial) District. The northern half of
this site is currently used as the Fit»s landfill and is zoned U while the southern half remains
undeveloped and zoned R-S. Planning staff is recommending amending the zoning district of
the city -owned properties to have a consistent zoning district and rn1n1rn|ze any delays to future
projects or expansion of the landfill.
According to our Comprehensive Plan of Beaumont the property is located within the
