E'NTITLED AN ORDINANCE ISSUING A SPECIFIC USE PERMITTO ALLOW A
DT.JPLEX WITHIN A R-S (RESIDENTIAL SINGLE-FAMILY DWELLING)
DISTRICT FOR PROPERTY LOCATED AT 788 AND 798 SHELL ROAD IN THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS,
WHEREAS, Fulton Johnson has applied for a specific use permit to allow a duplex in a
R-S (Residential Single-Fainfly Dwelling) District for property located at 798 and 798 Shell
Road, being Lots 16-19, Block 3, Shell Road Addition Beaumont, Jefferson County, Texas,
containing 0.275 acres, more or less as shown on Exhibit "A," attached hereto; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered
the request and is recommending approval of a specific use permit to allow a duplex in a R-S
(Residential Single -Family Dwelling) District for property located 788 and 798 Shell Road,
subject to the following conditions:
1. Install a 4' wide sidewalk along the property line abutting Shell Road and
Kermeth Avenue; and,
2. The proposed driveways be redesigned or relocated to meet City standards; and,
3. Construction plans must meet all requirements by Water Utilities for water and
sanitary sewer services, including any requirements of the City's backflow, pre-
treatment, and/or F,O.G, program; and,
4. Construction plans must meet all Fire and Building Code requirements; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit to allow a duplex is in the best interest of the City of Beaumont and its citizens;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this ordinance are hereby, in all
things, approved and adopted; and,
Section 1.
That a specific use permit allow a duplex in a R-S (Residential Single -Family Dwelling)
District for property located at 788 and 798 Shell Road, being Lots 16-19, Block 3, Shell Road
Addition Beaumont, Jefferson County, Texas, containing 0,275 acres, more or less as shown on
Exhibit "A," attached hereto is hereby granted to Fulton Johnson, their legal representatives,
successors, and assigns, as, shown on Exhibit "B," attached hereto and made a part hereof for all
purposes, subject to the following conditions:
1. Install a 4' wide sidewalk along the property line abutting Shell Road and
Kenneth Avenue.

Section 2.
That the specific use permit herein granted is expressly issued for and in accordance with
each particular and detail of the site plan attached hereto as Exhibit "B," and made a part hereof
for all purposes.
Section 3.
Notwithstanding the site plan attached hereto as F.xhibit "B" the use of the property
herein above described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 28 of the Code of Ordinances of Beauniont, Texas, as amended, as well as
comply with any and all federal, state and local statutes, regulations or ordinances which may
apply.
The meeting at which this ordinance was approved was in all things conducted in strict
compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.

The purpose for the request of a Specific U'se Permit (SUP), is to build Two (2) new
Duplex structures on the combined lots, 16-19 Block 3 of the Shell Road Addition,
on the corner of Sheel St. and Kenneth Ave. in the city of Beaumont. Our request
to build these two units will provide safe, clean new affordable housing options
for residents of the city of Beaumont. The clients' intentions are to construct the
units and keep them as rental units to offer families, college students and/or any
approved section 8 candidates. Each unit will be Two (2) stories and provide with
off street parking and privacy wood fencing. During construction, all necessary
measures will be taken to, impede and impact the neighboring residents as
minimally as possible beyond normal construction activities.
During construction, the client will be marketing the units for rental upon
completion and a successful Certificate of Occupancies is obtained for each unit.
Again, our goal for this request is to provide safe, affordable housing options for
