HomeMy WebLinkAboutORD 24-003ORDINANCE NO. 24-003 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW AN RV (RECREATIONAL VEHICLE) PARK IN A GC -MD (GENERAL COMMERCIAL -MULTIPLE FAMILY DWELLING) DISTRICT FOR PROPERTY LOCATED AT 5497 FANNETT ROAD IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, WHEREAS, R & P Brothers, L,L.C, has applied for a specific use permit to construct an RV (Recreational Vehicle) Resort in a GC ­MD (General Commercial -Multiple Family Dwelling) District for property located at 5497 Fawcett Road, being Lot 10, Block A, Tyrrell Parr Addition, Beaumont, Jefferson County, Texas, containing 3 acres, more or less, as shown on Exhibit "A," attached hereto; and, WHEREAS, the Planning and Zoning Commission of the City of Beaumont considered the request and is recommending approval of a specific use permit to allow an RV (Recreation. Vehicle) Park in a GC -MD (General Commercial -Multiple Fancily Dwelling) District for property located at 5497 Faimett Road, subject to the following conditions: 1. This project will require an approved drainage plan to ensure the runoff for the proposed conditions equals that of the existing conditions for the 100-year storm event using Atlas 14 rainfall data, per Drainage District #6; and, 2. Shall be in strict compliance with Section 24.06,008 minimum standards for type "C" recreational vehicle park of the City's Code of Ordinances and all applicable Fire and Building Codes; and, 3. All lighting installed shall be directionally shielded from the residential properties located east and south of the subject site; and, WHEREAS, the City Council is of the opinion that the issuance of such specific use permit to allow an RV (Recreational Vehicle) Park is in the best interest of the City of Beaumont and its citizens; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this ordinance are hereby, in all things, approved and adopted; and, Section 1. That a specific use permit to allow an Recreation Vehicle Resort in a GC -MD (General Commercial -Multiple Family Dwelling) District for property located at 5497 Fainrett Road, being Lot 10, Block A, Tyrrell Park Addition, Beaumont, Jefferson County, Texas, containing 3 acres, more or less, as shown on Exhibit "A," is hereby granted R & P Brothers, L,L.C,, their legal representatives, successors and assigns, as shown on Exhibit 'B," attached hereto and made a part hereof for all purposes, subject to the following conditions: 1. Notwithstanding the site plan attached hereto, the use of the property herein above described shall be in all other respects subject to all of the applicable regulations contained in Chapter 28 of the Code of Ordinances of Beaumont, Texas, as amended, as well as comply with any and all federal, state and local statutes, regulations or ordinances which may apply. Plans were submitted to the City of Beaumont, Texas Department of Transportation and Drainage District G for review. Plans were approved but the Project was delayed due to the uncertainty that Covid 19 imposed on development, With the current economic growth that the golden Triangle areas is experiencing, I would like to move forward with the construction of the RV Park. Unfortunately, the Specific Use Permit expired and l have to start the process from the begiming, The proposed RV Park project will have management staff available on the property 24 hours a clay to assist travelers and maintain the property, Each RV pact will have a state of the art pedestal with utility connections, water, 50 AMP electric & internet via Wi-Fi at the location. There will be a 4" sewer corurect'ion for each RV at designated location within the 5' grass area. The site will have an 8' fence oil all sides (except at Fannett Road) and provide cameras, lighting and security systems for monitoring and safety. All permanent structures will be constructed with a minimum of 18" inches above the Base Flood elevation or be flood Proofed to 18" inches above the Base Flood Elevation. In addition, all electrical hook-ups will be at least 18" inches above the Base Flood elevation, All sewer hook- ups will be designed so they can be completely scaled in case of a flood. We would like to start the project as soon as January 2024 with ground breaking and construction. As a business owner next to the property and a longtime resident of the City of Beaumont, I will ensure that the RV Park will be built in a manner that will improve the neighborhood's appearance and provide a comfortable and luxurious stay for our clients in order for them to come back to Beaumont and contribute to the City's and businesses revenue during their stay.
