HomeMy WebLinkAboutRES 23-350RESOLUTION NO. 23-350 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, ORDERING AND DECLARING THE NOVEMBER 2023 CHARTER AMENDMENTS, AS APPROVED BY THE VOTERS OF THE CITY OF BEAUMONT, ADOPTED. WHEREAS, on November 7, 2023, the City of Beaumont held an election on the adoption of amendments to the City's Home Rule Charter; and, WHEREAS, on November 21, 2023, the City Council canvassed the votes of said election; and, WHEREAS, Texas Local Government Code Section 9.05 (b) provides that an amendment to a charter does not tape effect until the governing body of the municipality enters an order in the records of the municipality declaring that the amendment is adopted; and, WHEREAS, pursuant to notice of a public meeting held in compliance with the Texas Open Meetings Act, the City Council of the City of Beaumont, Texas, convened into a regular meeting of the City Council on this the 21st day of November 2023, for the purpose of entering an order into the records of the city and declaring that the amendments to the City Charter are adopted; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCI, OF THE CITY OF BEAUMONT, TEXAS, THAT; Section One: Findings. The foregoing recitals are hereby found to be true and correct and are hereby adopted by the City Council and made a part hereof for all purposes as findings of fact. Section Two: Proceedings. That an election was duly called and held on November 7, 2023, and final votes were canvassed on Noven-ber 21, 2023, on the question of the adoption of aunendnients to the City of Beaumont Home Role Charter, where it was determined that all legal votes were properly counted. Section Three: Immediate Adoption of Amendments. It is hereby ordered that the amendments passed and approved by the voters as stated in Measures B, C, D, and E, attached herein as Exhibit A, are hereby adopted and that the corresponding measure language is hereby incorporated into the City of Beaumont's Charter. Section Pour: The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Four 13 (4) or more members of the City Council shall constitute a quorum for the transaction of 14 business, All meetings of the City Council shall be held in a public place in the City of 15 Beaumont. The City Manager shall be the chief administrative officer 26 of the City and shall be responsible to the City Council for the administration of all City affairs 27 placed in their charge by or under this Charter. The City.Manager shall have such im lied 28 authority.as to properly cany out the fiinctions of chief administrative officer for the Cijy and in 29 addition to those implied powers, shall have the following specific responsibilities and duties: 30 (1) Appoint and remove all heads of departments and all subordinate officers and 31 employees of the City except as otherwise provided by this Charter and except as he may 32 authorize the head of a department or office to appoint and remove subordinates in such 33 department or office. The decision of the City Manager or other appointing officer shall 34 be final and there shall be no appeal therefrom to any other office, body or court 35 whatsoever. 36 (2) Prepare the budget annually and submit it to the City Council and be responsible 37 for its administration after adoption. 38 (3) Prepare and submit to the City Council as of the end of the fiscal year a complete 39 finance report for the preceding year. 40 (4) Keep the City Council advised of the financial condition and future needs of the 41 City and to recommend to the City Council for adoption such resolutions as he may deem 42 necessary or expedient. 43 (5) Supervise the preparation of agendas for all meetings of the.City Council. The 44 agendas shall be re aced in accordance with Rules and Procedures adopted by the City 45 Council and as provided for in this Charter. 46 (6) Oversee the purchasing of all merchandise materials,.supplies and services as 47 budjzeted and shall put in place such rules and regulations governing contracts requisitions 48 and transactions of business between City departments and vendors of goods and services 49 in compliance with all State procurement laws. 50 (7) Supervise City communication with the public and the news media including 51 outreach initiatives to the citizens and ergpublic through various media venues. 52 (8) Except as otherwise provided for in this Charter the City Manager shall direct and 53 supervise the administration of all departments, offices and public utilities of the City and 54 shall investigate or cause to be investigated as appfo riate an com laints concerning the 55 administration of the City, 56 (9) Al2point, suspend or remove any City em to ce except as otherwise provided b 57 this Charter. The CAy Manager may authorize any employee who is subject to the Ci 58 Manager's direction and supervision to exercise these _powers with respect to subordinates 59 in that employee's department, office or agency. 60 (10) Direct and supervise the administration of all departments, officers, a_nd_ag_encie 61 of the City, except as otherwise provided by this Charter or by law, 62 (11) Establish persotmel policies and procedures to be adopted by City Council and 63 make said policies available to all City ernplo 64 (12) The Cily Manager shall have the a-uthority to create and revise the City'. 65 organizational chart. 66 (13) Perform such other duties as may be prescribed by this Charter or required of him 67 by the City Council not inconsistent with this Chatter. 68 69 Section 4 -- INTERFERENCE BY CITY COUNCIL PROHIBITED: Neither the City Council 70 nor any of its committees or members shall dictate the appointment of any person to, or removal 71 from, office or employment of discipline by the City Manager or any of his subordinates or in any 72 manner interfere in the appointment or removal or discipline of employees raider the City 73 Manager's authority.
