AN ORDINANCE CANVASSING THE RETURNS OF THE SPECIAL ELECTION OF THE
CITY OF BEAUMONT HELD ON THE 7TH DAY OF NOVEMBER 2023, FOR THE
PURPOSE OF VOTING ON CHARTER AMENDMENT PROPOSITIONS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR REPEAL.
WHEREAS, the City Council of the City of Beaumont, in session, duly called for a
special election to be held on the 7th of November 2023, and the election returns of the votes
cast in said election were canvassed for the following propositions.
WHEREAS, after duly canvassing said returns, the City Council finds that the votes cast
at said election for the Charter propositions are as follows:

PROPOSITION A
Shall the City Charter of the City of Beaumont be amended to increase City Council terms from
two (2) years to four (4) year staggered terms with a three -term limit totaling twelve (12) years
per office?
FOR: 4,141 46.41% AGAINST: 4,781 53.59%
PROPOSITION B
Shall the City Charter of the City of Beaumont be amended to require the City Council to Bold
such regular meetings as necessary to efficiently conduct the affairs of the City?
FOR: 7,610 85.28% AGAINST: 1,314 14.72%

Shall the City Charter of the City of Beaumont be amended to clarify the authority of the City
Manager and City Council's role?
FOR: 7,376 83.47% AGAINST: 1,461 16.53%
PROPOSITION D
Shall the City Charter of the City of Beaumont be amended for consistency and compliance with
State Law?
FOR: 7,494 85.25% AGAINST: 1,297 14.75%
PROPOSITION E
Shall the City Charter for the City of Beaumont be amended to delete repetitive and umiecessary
provisions?
FOR: 7,179 81.68% AGAINST: 1,610 18.32%
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:

That the results of said City special election be and the same are hereby declared to have been as
herein set out, and Charter Proposition A failed; and Charter Propositions B, C, D and E passed.

The City Council of the City of Beaumont fiirther finds that notice of said special election was
duly and properly given as required by law, and that said election was duly held and returns
thereof were duly made by the proper officials of said election and in all things according to law.
Section 4.
That if any section, subsection, sentence, clause, or phrase of this ordinance, or the application of
same to a particular set of persons or circumstances, should for any reason be held to be invalid
or adjudged unconstitutional by a court of competent jurisdiction, such invalidity shall not affect
the remaining portions of this ordinance, and to such end the various portions and provisions of
this ordinance are declared to be severable; and the City Council of the City of Beaumont, Texas,
declares it would have passed each and every part of the same notwithstanding the omission of
any such part thus declared to be invalid or unconstitutional, or whether there by one or more
parts.
Section 5.
That all ordinances or parts of ordinances inconsistent or in conflict herewith are, to the extent of
such inconsistency or conflict, hereby repealed.
The nneeting at which this ordinance was approved was in all things conducted in strict
connpliance with the Texas Open Meetings Act, Texas Goverm-nent Code, Chapter 551.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 21 st day of
November 2023.
