STAFF REPORT
The Port of Beaumont requests a Rezone to a 2.76-acre portion of property located at 412
Emmett Avenue and properties adjacent to the north and west and 1353-1399 Park Street from
C-M(Commercial ' Manufacturing) toP[}(Port Development) District. They intend todevelop
the site to accommodate truck queing,, cargo storage and workforce development to increase
efficiency of operations and adjust to the growing infrastructure needs associated with moving
good and services toand from the Port. This request aligns with the |n1er|oca|agreement
between the Port of Beaumont and the City of Beaumont executed by Resolution No. 23-015 in
January of2O23.
Staff recommends approval of the request.

RESOLUTION NO. 23-015
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAU MONT:
THAT the City Manager be and he is hereby authorized to execute an Interlocal
Agreement with the Port of Beaumont Navigation District, to exchange land pursuant to
the authority, under the provisions of, and In accordance with Chapter 791 of the Texas
Governmont Code and to increase the efficiency of operations and adjust to the growing
infrastructure needs associated with moving goods and services to and from the Port of
Beaumont. The Agreement is substantially in the form attached hereto as Exhibit "A" and
made a part hereof for all purposes.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.

'This Interlocal Agreenient the "Agreement") made and entered into by and between
the Port of Beauniont Navigation District of Jefferson County, "I"exas (tile "Port")"), acting herein
by and through its President of the Board of Con-imissioners, and the City of Beauniont,
Texas., a ii-iunicipal corporation (the "City"), acting by and through its Mayor.

ECITALS:
WHEREAS, the Port is a navigation district of the State of 'Texas, authorized under
Section 59, Article XVI of the Texas COIIStitLltion and the City is a hon-ic rule mullicipality
acting pursuant. to the Charter of the City of Braun-iont, Texas and
WHEREAS, and the Interlocal. Cooperation Act, Chapter 791 of the Texas
Govemnient Codc authorized units of local government to contract with one or more units of
local govern lent to perforni govertunent functions and services; and
WHEREAS,this Agreenient is entered into pursuant to the authority, Linder the
provisions of, and in accordance with Chapter 791 of the Texas Gover nnient Code, for the
performance of governmentcal functions and services; specifically, the exchange of real
1)roperty located within the City and Port District, and for such other and further acts of
cooperation as the parties may subsequently agree to by the execution of a separate and
specific agreenient. ratified by the governing bodies of each contracting party, specifically the
City Council of the City of Beauniont and the Port Board of Con-Imissioners; and
WHEREiAS, City and the Port have investigated and deten-nined that it would be
advantageous and beneficial to both the City and the Port and its inhabitants for the City for
the exchange of property to support econoinic growth.
WHER-EAS, the City and the Port deeni it. to be in the best intcrest of both entifics to
enter into this Agreement relative to the exchange of real property and for such additional
services as the parties may subsequently agree to by the execution of separatc and spec ific
agreements, and in consideration of the inutual covenants contained herein, the City and the
Port agree as follows.
NOW, THEREFORE, the Port and City, in consideration of the recitals set forth
above, which are incorporated into this Agrecinent as if fully set forth below, and in
consideration of such other agreements as contemplated, agree as follows:
1. By action of the Port Board of Commissioners on Deceinber 19, 2022, the Port hereby
approves to deed approxiniately 6.710 acrcs of real property adjacent to the City's
River 1`4ront Park to the City, except that 2.641 acres of real property correspondiiig to
the locatiODS of the rail tracks own by the NSF, Union Pacific, Kansas City
Southern or the Port shall be retained by the Port to provide rail access easements to
BNSF', Union Pacific and/or Kansas City Southern Railroad Icading to the Port t i
Property") as described and shown on N.Nfarranty deed and property drawing as
Attachment A hereto.
2. By action of the Beatiniont City Council on Deceniber 6, 2022, the City hereby
approvcs to abandon or otherMse convey approximately 1.819 acres of real Property
consisting of Sabine 11,ciss Avenue fi-oni Blanchette Street to Eniniett Street ("Sal ine
Pass Avenue Property") adjacent to the Port of Beatimont. as described and shoNvIl oil
property drawing attached as Attachnient B hereto.
3. The City agrees to abandon all City roadways, alleyways and easements (except
for City Nvater, storm and sewer inains,, if any adjacent to, or through, Port owned
property bordered by Buford, Carroll, Schwarner and Poll Streets, including
portions of Lamar, Stewart, Powell, Le per and Herring Streets and Herring Alley
as shown oii Attachnient C (Future Storage Lot) hereto, provided that Port illects
Cit)r requirements of property ownership of both sides of the City streets to be
abandoned.
4. The Cite agrees to one Port owned property shown on Attaclullent C (Future
Storage Lot) and Attache -lent D (Truck Staging Areas) hereto as Port District
2"Oning.
5. In the exercise of their respective roles and responsibi. I i ties under this Agreement,
the Port and the Cit)r each act in an independent capacity, and no party is to be
considered the officer,, agent, or employee of the other.
6. Any notice given hereunder by either party to the other shall be in writing and 111ay
be affectexi by personal delivery in writing or by certified mail, return receipt

the rights herein granted and the obligations herein assuilled. Any oral

effect except in a subsequent modification in writing signed by both parties.
8. This Agreement shall be govenied by mid C011SULIC(Cd jil accordance with the laws
of the State of Texas. No assignment of this Agreement or of any right accrred

herewider shall be inade, in whole or in part, by either pai-ty without the prior writtell
conseiit of the other party. Venue shall be in Jefferson County, Texas.
9. The undersigned officer and/or agents of the parties hereto are the properly
authorized officials of the party presented and have the necessai-Y authority to
execute this Agreeni ent on behal f of the parties hereto and each party hereby certi fies
to the other that aiiy necessary resolutions extending said authority have been duty
passed and approved and at-e now in full force and effect.
