BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute an Interlocal
Agreement with Jefferson County Drainage District No. 6 for the proposed Evalon Street
8'x8' Box Culvert and Cavity Emergency Repair Project.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551,

This Agreement is entered into between the Jefferson County Drainage District No. 6, a
special district of the State of Texas (hereinafter called "DISTRICT") and the City of Beaumont,
a home rule city of the State of Texas (hereinafter called "CITY") under authority of the Interlocal
Cooperation Act, Chapter 791 of the Texas Government Code.
WHEREAS, the DISTRICT' and the CITY are working together to make an emergency
repair to the drainage infrastructure in Beaumont, Jefferson County, Texas, in the subdivision
known as Calder Place, under Evalon Street between 21" and 22" d Streets.
WHEREAS, an approximately 40 foot section of the 8'X8' Concrete Box Culvert under
Evalon Street has partially collapsed, is currently covered and secured by steel plates and is in need
of repair.
THEREFORE, the DISTRICT and the CITY agree as follows-,

1. The CITY will perform all labor and associated services included but not limited to,
surveying, design, geotechnical review, as necessary, site plan development, plans and
specification development, utility relocation, property owner notifications, construction
management and any/all other work associated with the repair to the existing 8'X8'
Concrete Box Culvert,
2. The CITY will secure Engineering services to design a structural repair to the wall of the
box culvert. The DISTRICT agrees to reimburse the CITY for fifty percent (50%) of their
cost, in an estimated amount not to exceed $6,725.
3. The CITY will obtain a proposal from a qualified contractor on an emergency basis for the
repair work. The proposal will be on a time and materials basis with a not to exceed amount.
The DISTRICT agrees to reimburse the CITY for fifty percent (50%) of the repair costs, in
an estimated amount not to exceed $189,645.00.
4. The CITY will provide the DISTRICT with construction plans, bid proposals, and progress
payments made to the contractor related to the Evalon Strect.8'X8' Box Culvert Emergency
Repair.
5. ,'The CITY agrees to allow the DISTRICT representatives to observe construction on an
(informal basis as construction progresses.
6. On a monthly basis or greater, at its convenience, the CITY will invoice the DISTRICT for
fifty percent (50%) of the costs to date. The invoice must be itemized and will include all
back-up documentation that justifies the invoice amount, such as contractor invoices. If a
contractor is used, documentation must be provided to the DISTRICT to prove the
contractor was hired using a documented procurement practice. All Contractors must be '
checked for disbarment and proof of verification must be provided. The DISTRICT will
reimburse the CITY for fifty percent (50%) of the total costs invoiced up to the estimated

Based on our review of the plans and job site, Brystar is pleased to offer this budget
estimate based on our time and materials rates for an emergency repair. Brystar shall
provide all necessary supervision, labor, equipment, materials, and insurance to complete
the work as proposed.
