BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to enter into an
agreement with SWA Group of Houston, Texas to perform additional planning and
design services related to a Downtown Hotel and the completion of the Downtown Plan,
including 3-D renderings of that plan.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 1st day of
August, 2023.

Dear Chris,
SWA is excited to offer this proposal for Professional Design Services forthe referenced project
(the "Project"). This agreement is by and between the City of Beaumont ("Client") and SWA's
Houston office for the Project located in Beaumont, Jefferson County, Texas. SWA understands
that the objectives of this assignment are threefold: to prepare additional presentation
materials that convey the Waterway's characteristics and features to the broader community in
a competing format; to prepare a high-level, order of magnitude cost estimate for the waterway
for general budgeting purposes; and, to provide on -going coordination from time to time, as
requested by the Client.
1. SCOPE OF SERVICES
SWA will perform the following tasks, and generally in these steps and sequence:
A. WATERWAY PRESENTATION
1. The Downtown Plan Animation will create a dynamic and immersive experience. This
will be a 2 to 3-minute video that incorporates both Fly-Thru and Multi -media
elements to clearly illustrate the conceptual design, spatial character, and
programming envisioned for Beaumont Waterway. The video will be based on the
Conceptual Downtown Plan previously prepared by SWA. Through the Fly-Thru,
viewers will be taken on a digital journey, seamlessly navigating the digital model
from both ground -level and birds -eye perspectives. This will showcase the unique
character of the Waterway and its key open spaces, and provide a sense of scale
and context. Complementing the Fly-Thru, the Multi -media animation serves to
further enhance the vierwers understanding by annimating key components of the
plan in a visually engaging manner and experience of "being there".

Deliverables:
a. 2 -- 3 minute fly-thru with animation of key moments on the Waterway.
b. Short, example clips of similar plan animations from other projects (sent with
this proposal as an attachment).
Fee Estimate: $34, 350.

B. WATERWAY ORDER OF MAGNITUDE COSTING
1. Working with a forensic civil / structural engineer, SWA will prepare a high-level,
order of magniture cost estimate for the Waterway, between Neches and Main
Streets. The estimate will be based on the Conceptual Downtown Plan previously
prepared by SWA and focus on the public realm / ROW improvements of the Plan.
Estimates will not be prepared for any private improvements. The estimate will be
developed through key componenents, including identification of anticipated cost
categories, estimated quantities for each cost category, estimated unit costs (2023
values) and extensions thereof to arrive at subtotal of all cost categories and rollup
for total project cost. The estimate will include construction contingencies and an
estimate of soft costs.
SWA will retain the services of a Civil / Structural Engineer to provide associated cost
inputs to the estimation. Fees for the Engineer are included in this agreement. The
contribution of SWA to the project shall be limited to areas of design and aesthetics and
SWA does not assume responsibility for the work of others in the production of design
recommendations and documents or the sufficiency thereof necessary to the execution
of the work.
Deliverables:
a. Summary high-level cost estimate for the Waterway in present 2023 value.
Fee Estimate: $9, 850.

C. ON -GOING COORDINATION
At the Client's request and direction, SWA will make preparations for and attend /
participate in conferences, meetings and presentations. It is assumed that these
services will be supportive and are not expected to require extensive time and
resources.

IL SCHEDULE
For Scope of Work items I. A and I. B, SWA will complete and deliver these items in 30
days from being give a notice to proceed. For Scope of Work item I. C, the Client has
identified a service period of two to three months.
III. EXCLUSIONS TO SCOPE OF SERVICES
Client shall provide the following information or services as required for performance of
the work. SWA assumes no responsibility for the accuracy of such information or
services and shall not be liable for error or omissions therein. Should SWA be required
to provide services in obtaining or coordinating compilation of this information, such
services shall be charged as Additional Services.
a. Topography and boundary surveys.
b. Legal descriptions of properties.
c. Existing site engineering and utility base information.
d. Overhead aerial photographs at controlled scale.
e. Drone imagery.
f. As -built documentation.
g. Archaeological investigations.
h. Engineering, including but not limited to traffic, hydrologic, civil, structural and
electrical except as included in the scope of services.
i. Illustrative renderings and illustrations not explicitly included on the scope of
services.
j. Schedule extensions.
k. Revisions to design documents.
I. Meetings and site visits beyond the stated schedule.
m. Venue and equipment rental for community charrettes and other public meetings.
n. Detailed design, Bidding and / or Construction Phase services.
o. Development and design guidelines associated with private property(s).
IV. FEES AND TERMS
Fee for Professional Services shall be an hourly, not -to -exceed fee of $64,050. using
SWA's 2023 billing rates (see Exhibit B).
We estimate Project Expenses at $2,350. for reimbursed, out-of-pocket costs, which are
in addition to the professional fee. Expenses include travel, over -night accommodations

in Beaumont (if approved in advance) and printing / plotting of collateral materials used
for the Project. SWA will submit progress invoices with accrued time and expense
charges each month, payment for which shall be paid within thirty days from receipt.
