FILE: PZ2023-219 STAFF REPORT Troy Hatch is requesting approval for a Rezoning from GC -MD (General Commercial — Multiple -Family Dwelling) to C-M (Commercial — Manufacturing) for the property at 5190 Forsythe Street. Mr. Hatch, owner of Hatch's Towing & Recovery, L.L.C., recently purchased the property. The property was being used as a Vehicle Storage Facility (VSF), but had not been permitted for that use. Mr. Hatch assumed the use was legal. Unfortunately, a Vehicle Storage Facility is not permitted in GC -MD zoning for storage of more than ten, (10) vehicles. When applying for the required Certificate, of Occupancy, Mr. Hatch discovered several issues with the property, first and foremost the zoning which would not allow him to store the number of vehicles he planned. The property to the north was rezoned to C-M in 2001 and is currently used as a VSF. Property to the west is zoned H1 (Heavy Industrial). The proposed VSF would be required to meet all existing Zoning Ordinance Requirements. Planning staff recommends approval of the request. Please note that final occupancy approval is subject to review and acceptance of submitted plans and field inspections to verify compliance with applicable codes. Exhibits are attached.
