HomeMy WebLinkAbout02/07/2023 MIN BEAUMONT TEXAS MINUTES OF THE CITY OF BEAUMONT COUNCIL MEETING Albert"A.J."Turner Jr.,At-Large ROBIN MOUTON, MAYOR Randy Feldschau,At-Large Taylor Neild,Ward I CITY COUNCIL MEETING Michael Getz,Ward II Audwin Samuel,Ward III FEBRUARY 7, 2023 Chris Durio, Mayor Pro Tem Tina Broussard, City Clerk Kenneth R.Williams, City Manager Sharae Reed, City Attorney The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on February 7,2023, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING * Invocation Pledge of Allegiance Roll Call • Proclamations, Presentation and Recognition • Public Comment: Persons may speak on the Consent Agenda and Agenda item No. 1 Mayor Mouton called the council meeting to order at 1:30 p.m. Father Joseph Ibiwoye with Our Mother of Mercy Catholic Church gave the invocation. Diageo Guerra, Student Government President with Blanchette Elementary School led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Mouton, Councilmembers Turner, Feldschau, Samuel and Neild. Absent: Mayor Pro Tem Durio and Councilmember Getz. Also, present were Kenneth Williams, City Manager; Sharae Reed, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions "Black History Month Honoring Barbara Lynn Owens" - February 2023 — Proclamation read by Mayor Mouton; accepted by Barbara Lynn Owens "Recognition" - Student Government of Blanchette Elementary School along with two of their teachers "Recognition" - Chucks Sandwich Shop — Owners Charles "Chuck" and Debra Lafayette Mayor Mouton read the announcement regarding Executive Session being held at the conclusion of Public and Councilmember Comments. Public Comment: Persons may speak on the Consent Agenda and Agenda Item No. 1 None Minutes—February 7,2023 CONSENT AGENDA (Items placed on the Consent Agenda are considered routine in nature and are considered non-controversial. The Consent Agenda can be acted upon in one motion. A consensus of the Council is required to remove any item for discussion and separate action.) A. Approval of the January 31, 2023, City Council Meeting Minutes B. Approve the purchase of two sets of eDraulic rescue tools for the Fire Department - Resolution 23-048 C. Amend Resolution 21-303 for the purchase of two vehicles for use by the Fire/EMS Department - Resolution 21-303-A D. Authorize the City Manager to execute an Industrial District Agreement with Allegiant Industrial Island Park - Resolution 23-049 E. Authorize the City Manager to execute all documents necessary, including the Interlocal Agreement outlining sharing local license plate data between the Beaumont Police Department and the Houston High Intensity Drug Trafficking Area-Resolution 23-050 F. Authorize the Mayor to execute a waiver granting permission for the Jefferson County Mosquito Control District to operate aircraft at a low altitude over the City of Beaumont for mosquito control purposes - Resolution 23-051 G. Approve a resolution accepting maintenance of the street, storm sewer, water, and sanitary sewer improvements in Willow Creek Country Club Estates Subdivision Section X-E - Resolution 23-052 H. Authorize the settlement of the lawsuit styled Robert Cooley v. City of Beaumont - Resolution 23-053 Councilmember Feldschau moved to approve the Consent Agenda. Councilmember Neild seconded the motion. AYES: MAYOR MOUTON, COUNCILMEMBERS TURNER, FELDSCHAU, SAMUEL AND NEILD NAYS: NONE MOTION PASSED AGENDA 1. Consider amending Ordinance 23-005 to add and approve designating Sunday, April 30, 2023, with the hours of 12:00 p.m. to 5:00 p.m., to the early voting dates for the May 6, 2023, City of Beaumont General election joint with the Beaumont Independent School District and the Port of Beaumont; and approving a Runoff Election, if necessary, on June 10, 2023. Council passed Ordinance 23-005 on January 24, 2023, to call the May 6, 2023, City of Beaumont General joint election to order. The amendment is to add and approve Minutes—February 7,2023 designating Sunday, April 30, 2023, with the hours of 12:00 p.m. to 5:00 p.m., to the early voting dates, with a runoff election, if necessary, on June 10, 2023. Approval of ordinance. Councilmember Turner moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING ORDINANCE NO. 23-005 FOR THE PURPOSE TO ADD AND APPROVE HOURS OF 12:00 P.M. TO 5:00 P.M.,TO THE EARLY VOTING DATES FOR THE MAY 6, 2023, CITY OF BEAUMONT GENERAL ELECTION JOINT WITH BEAUMONT INDEPENDENT SCHOOL DISTRICT AND THE PORT OF BEAUMONT AND APPROVING A RUNOFF ELECTION,IF NECESSARY,ON THE 10TH DAY OF JUNE 2023. Councilmember Feldschau seconded the motion. AYES: MAYOR MOUTON, COUNCILMEMBERS, TURNER, FELDSCHAU, SAMUEL AND NEILD NAYS: NONE MOTION PASSED Ordinance 23-012 COMMENTS Public Comments (Persons are limited to three minutes) Jeanette Price 8035 San Bruno St. Beaumont TX Stated that she's the founder and CEO of Blind Girl Magic and an advocate on behalf of the blind community at the local and national level with the Federation of the Blind, she stands before Council to ask for the support of the city because she is now a new author along with seven (7) out of sight women, all blind women of color,they lost sight but gained vision in the process, stated that the name of her book is "The Write to Heal", the subtitle states "It's not about the sight loss but vision gained", presented the Mayor and Councilmember Turner with a copy of her book, announced that she will be having a book signing on Saturday, February 11, 2023, at 2:00 p.m., at Lamar University in the Theater Room, tickets will be $10.00, thanked the City for always supporting her throughout her journey, also thanked Councilmember Turner for the Beep Ball Tournament and for his volunteer work Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS MAYOR PRO TEM DURIO - ABSENT COUNCILMEMBER GETZ- ABSENT COUNCILMEMBER NEILD - STATED THAT IN THE LAST FEW YEARS COUNCIL HAS SPENT A LOT OF TIME DISCUSSING FIRE AND HIRING ISSUES AND CONCERNS,STATED THAT IN HIS BUSINESS ONE OF THE THINGS THAT HE'S LEARNED THAT SEEMS TO WORK WHEN YOU'RE TRYING TO SOLVE A PROBLEM IS TO GET ALL THE Minutes—February 7,2023 STAKEHOLDERS IN ONE ROOM TOGETHER AND TALK ABOUT IT AND TRY TO STRATEGIZE, SEEMS LIKE THAT'S THE PART THAT'S BEEN MISSING WHEN TRYING TO GET THE 2021 PLUMBERS CODE DONE, STATED THAT HE SPOKE TO MAYOR PRO TEM DURIO AND HE'S IN AGREEMENT WITH HIM, COUNCILMEMBER NEILD PROPOSED THAT COUNCIL MOVE FORWARD WITH AN IN COUNCIL WORK SHOP IN THE PUBLIC WITH ALL THE PARTIES PRESENT TO TRY TO GET THIS PLUMBERS CODE ISSUE RESOLVED COUNCILMEMBER SAMUEL- NONE COUNCILMEMBER FELDSCHAU - ENCOURAGED THE COMMUNITY TO CONTINUE TO PRAY FOR ALLISON GETZ, SHE'S HAD A ROUGH WEEK COUNCILMEMBER TURNER- IN MAYOR PRO TEM DURIO'S ABSENCE COUNCILMEMBER TURNER ANNOUNCED THAT THERE WILL BE A COMMUNITY CLEANUP ON SATURDAY, FEBRUARY 11, 2023, AT SOUTH PARK WITH PASTOR KENNEDY ANDREWS, THEY ARE REQUESTING TRASH TRUCKS AS WELL AS GARBAGE BAGS AND GLOVES, THANKED MAYOR MOUTON FOR RECOGNIZING A LEGEND LIKE BARBARA LYNN, IT'S IMPORTANT TO GIVE PEOPLE THEIR FLOWERS WHILE THEIR STILL HERE INCLUDING CHUCK'S SANDWICH SHOP, STATED HE EATS THEIR OFTEN, THANKED THE YOUTH THAT WERE IN ATTENDANCE FROM BLANCHETTE ELEMENTARY SCHOOL, COMMENTED ON THE YOUTH ADVISORY COUNCIL AND THEIR TRIP TO DALLAS,TX, FORA CONFERENCE,THANKED JANETTA PRICE FOR ALL THAT SHE DOES AND ENCOURAGED HER TO CONTINUE TO BE AN ADVOCATE CITY MANAGER WILLIAMS - NONE CITY ATTORNEY REED - STATED THAT SHE HAD THE OPPORTUNITY TO SPEAK AT ROTARY ON FEBRUARY 1, 2023, THANKED THE MAYOR FOR ATTENDING,IT WAS HER HONOR TO BE THEIR GUEST SPEAKER FOR BLACK HISTORY MONTH CITY CLERK BROUSSARD - NONE ASSIST.
