Mrs. Engman presented the staff report. Randall A. Creel of Soutex Surveyors & Engineers, has
requested approval of the Replat of Lots 8-11, Block 33, Arlington Addition into Tract 8-A
Addition, Beaumont, Jefferson County, 'I"exas. The property is located at 810 Madison Avenue.
The purpose of the plat is to combine all lots into one. Combining the lots will give the property
owner the right to place an accessory struCtUre where they would like, subject to setback
requirements and easements.
Slides of the subi ect property and proposed plat were shown.
The Planning staff recommended approval of the request with the following condition:
1. NO StrUCtUre or appurtenances shall be placed within the easement property. The City will
not be responsible for any surface restoration wheir sewer repairs or taps are necessary
within the city of Beaumont utility eascment.
Fifty (50) notices were mailed to property owners within two hundred (200) feet of the subject
property. Zero (0) rcsponses were received iii favor and zero (0) were rcceived in opposition.

Mrs. Engman presented the staff report. Aaron Ward of Faust Engineering and Surveying, Ine.,
has requested Preliminary Plat approval of Faith Estates Section 1. The development is located
south of Plant Road and west of Helbig Road. The 8.26 acre development is a thirty-three (33) lot

residential subdivision in the R-S (Rcsidcntial Single -Family Dwelling) zoning District. Grace
Lane and Peace Street will have 60' right-of-ways with no less than 3 8' in pavement width. Favor
Street will have a 50' right-of-way with no less than 28' in pavement width. Both Grace Lane and
Favor Street will access Plant Road. Water and sewer will be provided by extension of City
utilities.
"the preliminary plat of Faith J__.'states was reviewed by Planning Commission previously Oil
September 19, 2022. This plat was approved with conditions at the time, however, between
approval of the preliminary plat and the time construction drawings were received, revisions had
been made by Faust Engineering. Those changes 'included the width of the right-of-way for Favor
Street to be reduced from 60' to 50" and the removal of Lot 1, Block I of the Woodlands Meadows
Section One from the platted area. With such changes made, the plat must be reviewed again by
the Planning Commission.
As Grace Lane and Peace Street will extend less than two hundred (200) feet beyond Favor Street,
a temporary cul-de-sac waiver has been requcsted by Faust Engineering. Section 26.03.002(8)(B)

master plan shows that Grace Lane and Peace Street will be extended to cormect Section 2 of Faith
Estates subdivision in the future.
Faust Engineering has proposed Favor Street to have a 50' wide right-of-way and pavement width
of 3 8 " reducing down to 2 8' from Plant Road to Peace Street; as such they request a waiver to the
minor collector street requirement for said portion. of Favor Street. Section 26.03.002(4) states,

Planning staff recommended approval of the request with the following conditions:
1. The applicant shall submit to Engineering a revised master plan and master drainage plan.
2. All abbreviations, reserves.,, easements and relative information must be defined on the
plat adhering to Centerpoint Energy requirements.
Brief discussion followed concerning the purpose of the applicant returning to the Commission
for approval of the preliminary plat.
A representative of the applicant was present. Richard Faust of Faust Engineering & Surveying,

Mrs. Engman presented the staff report. Faust Engineering & Surveying, Inc. is requesting
Preliminary Plat approval for Spring Wood, Section 4. The project is located within the City of
Beaumont at the northwest end of Alexis Street, northwest of RFD Road. The development is a
4.63-acre., sixteen (16) lot, single family, residential subdivision. Rachel Lane, a residential street,
will have a 50' right-of-way and 28' wide pavement. The extension of Alexis, a minor collector,
will have a 60' right-of-way and 38' wide pavement. Utilities will be provided by extension of
City of Beaumont water and sewer.
The water line at the end of Rachel Lane and Alexis Street should remain on the same side of the
roadway and not cross over. The S-abdivision Ordinance, Section 26.03.011 states, "Utilit))

Mayor Mouton called the Joint Public Hearings of January 23, 2023 to order at 3:15 p.m. and
explained the purpose of the Joint Public Hearing process. Mayor Mouton then turned the meeting
over to Acting Chair Makin to conduct the Joint Public Hearings.
4) PZ2021-321: Request to revoke PZ2021-321, a Specific Use Permit to allow an
auton-iotive shop in an NCIeighborhood Commercial) District.
Applicant: City of Beaumont Planning Division
Location: 1109 Harriot Street
Mrs. Engm an presented the staff report. In 0 cto b er of 2021, City C o Ll nel I approved a Specific Ilse
Permit to allow an automotive shop at 1109 Harriot Street subject to the following conditions:
1. Maximum of eleven (11) vehicles to be on the property at any given time, including
customer and employee parking.
2. All auto repair must be conducted inside the shop.
For many years, this property was the location of Eagle Auto Services, a service station. , 1~hat
business no longer appears in the City Directory after 20 10. Since that time the property bas not
been occupied consistently and as it is now zoned NC (Neighborhood Commercial) District,
requiring a Specific Use Permit for an automotive shop. Complaints were received due to vehicles
parked on the right-of-way, blocking the Nriew of traffic for the intersection of Harlot and Park
Streets. The property was found to be in violation as not only was no Certificate of Occupancy on
file for the current auto shop, but a Specific Use Permit was needed.
Since the approval of the Specific Use permit, the property has remained in violation of both
conditions for every inspection. Code Enforcement filed charges for the excess imniber of vehicles
and no Certificate of Occupancy. In Febi-tiary of 2022 the business owner was placed on a 90-day
probation for excessive vehicles. In May, both items were brought before the judge at which time
the property owner was fined, but violations have continued.
Section 2 8.04.001 (h) of the Zoning Ordinance states, "A spec�fic use perinif incty be revoked or

The Planning Staff recommended revocation of the Specific Use Permit based on the fact that the
property has remained in violation after multiple warnings by mail, telephone and in person.
"I'wenty-one (21) notices were mailed to Property owners within two hundred (200) feet of the
subject property. Zero (0) responses were received in favor and (2) were received in opposition.
One notice stated that the property was sold. Mrs. Engiiian read the second letter in opposition
which was a property owner across the street from 1109 Harriot Street. The property owner
expressed coneerns relating to wrecker's crossing their property and the property appearance of a
junkyard rather than a mechanic shop. Mrs. Eligman was unable to read the remainder of the
notice as it was illegible,
Brief discussion followed regarding violations imposed upon the property owner and payment of
fines, along with confirming the occupant of the property and owner of the property.
The business owner was present. Victor Olivares of 3685 Blossom Drive, through his interpreter,
addressed the Comm -fission. Mr. Olivares stated that he has owned the business for eight years. He
further stated that he has phoned his clients instructing thein to pick up their vehicles, brit they will
not pick them up nor pay for the repairs. This is in violation of his business policy, but lie is Hesitant
to tow the vehicles from his property because lie feels that it i sn " t right to do so. He also stated that
lie is not accepting any vehicles for repair until the current vehicles are removed fron-i the property.
Brief discussion followed regarding the delay in obtaining a Certificate of Occupancy. Mr.
Olivares stated that the business did not pass multiple inspections which resulted in a delay in
obtaining the Certificate of Occupancy.

Victor Cantu of 4625 Prairie Street, Beaumont, Texas on behalf of his mother, Delores Cantu of
4625 Prairie Street, Beaumont, Texas, addressed the Commission. He stated that Delores Cantu is
the property owner and managcs the property. He further stated that she was -Linaware of the tenant
issues and suggested that it could possibly be due to a language barrier. Mrs. Engnian explained
that there are two interpreters among the Planning staff, with additional interpreters available
within City Hall staff should those in the Planning Department be unavailable. Mrs. Cantu is
concerned that the current violations will affect her ability to obtain Specific Use Permits for future
tenants. Mrs. Cantu also stated that Mr. Olivares has been a tenant for ci ;lit years. She ftirther
stated that prior to the current tenant, she and her husband operated a mechanic shop at that same
location for approximately twenty ycars. without any problems with the City. Mrs. Cantu then
stated that she is unaware if the tenant has paid imposed fines.
The occupant was given an opportunity
to speak in rebuttal. Mr. Olivares stated that the imposed
fines were paid.
Mayor Pro -Tern 1urio stated that the propefty is located within his District. He ffirther stated that

lie has received many complaints relating to the number of vehicles oil the property and lie
personally has seen approximately twenty to twenty-five vehicles in different states of repair.
The public hearing on this item was closed.
Commissioner Quraishi moved to approve the request for revoke PZ2021-321, a Specific Use
Pert -nit to allow an automotive shop in an NC (Neighborhood Commercial) District, as requested
in PZ2021-32 1.
Commissioner Javed seconded the inotion. The inotion to approve carried 6:0.
5) PZ2022-5 10: Request for a Specific Use Permit to allow the expansion of a church in a
GC-MD-2 (general Commercial -Mu I tipl e- Fam i ly Dwelling-2) District.

Mrs. Engman presented the staff report. erick Leger, oil behalf of New Faith Holiness Church,
Inc., requests a Specific Use Permit to expand the church located at 5250 Helbig Road. The GC-
MD-2 zoning district requires a Specific Use Permit for all proposed land uses. Mr. Leger intends
to install a premanufactured building for a fellowship hall and increase the size of the parkIng lot.
Section 28.04.006 of the City's landscaping ordinances states, "cin increirtse in the size of an

1. Construction plans must meet all requiremcnts by Water Utilities for any water and

STAFF REPORT
Applicant, Brian Dunigan,, is requesting to abandon a portion of the Lucas Drive right-of-way
that abuts the rear property line ofG22 W. Lucas Drive. He intends to use the abandoned area
to install a driveway for a drive -through to service Charlee and the Cookie Factory at 622 W.
Lucas Drive, Suite B. |nOctober ofZO2]LeSpecific Use Permit was approved toallow anew
driveway onthe property with conditions. Some ofthose conditions included the driveway
must be rn|n|nmurn often (10) feet in width and to install a six (6) foot privacy fence along the
p[operty|lne. Approval of the request will give Mr. Dunigan real property to accommodate
the new drive -through and adhere to the conditions set forth by the Specific Use.Permit.
Planning staff recommends approval of the request with the following conditions:
1. If approved, applicant shall obtain an appraisal and Title Commitment for the property
to be abandoned at their expense. Appraisal and Title Commitment must be submitted
to the Planning office along with proof that payment has been arranged prior to the
item being placed on City Council's, agenda.
2 If approved, applicant shall provide metes and bounds of the proposed abandonment
produced by a licensed surveyor.

My name is Ronnie Wallace current owner of
property located at 5750 S. M.L. King Jr Pkwy. I would like to
respectfully like to request to change the use of building from bar to a
church. I recently started our ministry and was looking for property to
buy when I had the thought of just converting the building that I
owned into what I need it for. The hours of operation will be from 8;00
am no later than 12:00 am. The property will remain intact with no

water; as such they propose to have a portable bathroom onsite for customers and employees.

homes (nthis location. We are constructing the Tiny Homes onpre-bought trailers designed for this
purpose. We are NOAH certified and the work isinspected and audited at each stage of construction.
The Tiny Home units will be built at this location but sold and picked up by the customer. It isapull
behind unit (with a truck, etc.) We wi I I have two or three homes on the site for viewing but primarily will
custom build toorder.
The container homes will beprimarily built onthe dieni"ssite, but the one |nthe shop istoshowcase
what we can do. The Tiny Houses and the Container house will be displayed on the corner of Calder and
Center 3t.,inside the fenced area. There is a porta potty for the worker's use and a clumpster for waste.
There is no running water on site, hence the porta potty.
Hours ofOperation are 8am-5pm.|fthere are deadlines to be met, there could beextended work hours.
There is an office in the warehouse where meetings will be held. There will be one office person on site
for the day to day operation. There will also be 4-5 workers in the warehouse depending on tasks for the
day. There will be a minimum of I person and a maximum of 6 people in the shop on any given day.
Noise levels will be maximum 100 decibels due to use of table saw. Circular saw, dd1i hammer and nail,
nail gun, and hand tools are well below these decibels. Hearing protection will be provided for the safety
of the workers.

This letter is to confirm Cross Development's desire to apply for a Special Use Permit at 6255
Concord Rd, Beaumont, TX 77 708. The proposed development for a portion of this p roper-ty will be a
Caliber Collision auto repair shop. The following are the specifics of the Caliber Collison to be built and
operated at this location.
• Business Name —Caliber Collision
• H ours of Operation — M ond ay to Friday 7:3 0 AM — 5,30 PM, Closed on Saturdays and Sundays
• It is planned to have 15-20 employees on a regular basis.
The business will operate as an auto repair shop with the following functions:

0 Repair preparation, including vehicle disassembly and procurement of new parts
0 Autobody repair, including sheetmetal/dent repair, auto glass replacement, and hall damage
repair
0 Painting, including sanding, blending, masking, spray painting, and polishing

The proposed business will serve the autobody repair needs of the surroUnrding area in a manner
that considers the aesthetics of the surrounding community as well as the comfort of its residents in the
following ways-
• The auto repair shop will not he detrimental to the health, welfare, and safety of the
surrounding area as all work is completed within the shop. All chemicals and fumes are to be
disposed of on site and contained within the work area.
• The business provides a site layout and design that is harmonious with the surrounding area.
Caliber Collision auto repair shops are known for their aesthetic appeal as well as the tidiness of
their shops. The proposed building will meet and exceed the existing appearance of the
community.
• The proposed facility does not negatively impact existing uses in the area and ill the City through
impacts on public infrastructure such as roads, parking facilities, and water a n d sewer systems,

ability of existing infrastructure and services to adequately provide services. The business will
utilize existing infrastructure, not requiring additional road cuts', or water/sewer/or storm water

- The repair shop will minimize negative impacts on existing uses in the area and in the City
through the minimization of noise, glare, fumes, dust, smoke, vibration, fire hazard or other
injurious or noxious impact. In compliance with special condition 9 in Section 28.04.008 of the
code of ordinances, all autobody repair will be done in an enclosed building. The development
will also only operate during business hours that are harmonious with the surrounding area and
therefore will have minimal impact onthe community.
* This proposed site will have approximately 84parking spaces, meeting the parking conditions of
parking group 19\nsection 2-8.04.DO2ofthe Code ofOrdinances.

church holds weekly services on Sunday, Monday, and Wednesday.
According to the Citv's Comprehensive Plan, this property is located within the "'Conservation
andRevitaUzatjon"orea. Suchareasare, "bu8topareas where o significant portion of the
area is experiencing influences such as incompatible, land uses, dilapidatedstructures, o
deteriorating or'poor public infrastructure, and odecline in population and in the number of
housing units and businesses. Immediate actions are needed boprevent continued
deterioration and to reverse and repair those conditions."
