Aaron Ward of Faust Engineering and Surveying, Tile., has requested Preliminary Plat approval
of Faith Estates Section 1. The development is located south of Plant Road and west of Helbig
Road. The 8.26 acre development is a thirty-three (33) lot residential subdivision in the R-S
(Residential Single -Family Dwelling) zoning District. Grace Lane and Peace Street will have 60"
right-of-ways with no less than 38' in pavern crit width. Favor Street will have a 50' right-of-way
with no less than 28' in pavement width. Both Grace Lane and Favor Street will access Plant
Road. Water and sewer will be provided by extension of City utilities.
The preliminary plat of Faith Estates was reviewed by Planning Commission previously on
September 19, 2022. This plat was approved with conditions at the time, however, between
approval of the preliminary plat and the time construction drawings were received, revisions had
been made, by Faust Engineering. Those changes included the width of the right-of-way for
Favor Street to be reduced from 60' to 50' and the removal of Lot 1, Block 1 of the Woodlands
Meadows Section One from the platted area. With such changes made, the plat must be
reviewed again by the Planning Commission.
As Grace Lane and Peace Street will extend less than two hundred (too) feet beyond Favor
Street, a temporary cul-de-sac waiver has been requested by Faust Engineering, Section
26.03.002(g)(B) states, The Planning coinnfission inay ivaive teny)o]-cagy cul-de-sac
reqwi-enients for dead-end streets u)hen the street is less than tivo hundred (200) feet in length
Additionally, the preliminary master plan shows that Grace Lane and Peace Street will be
extended to com-iect Section 2 of Faith Estates subdivision in the future.
Faust Engineering has proposed Favor Street to have a 50' wide right-of-way and pavement
width of 38' reducing down to 28' from Plant Road to Peace Street; as such they request a
waiver to the minor collector street requirement for said poi-tion of Favor Street. Section
26.03.002(4) states, "..A street serving more than sixty-four (64), but less than four hunctred
fifty (450) chi)elling linits, shall be a minor collector street ivith a right-of-way of no less than
sixty (60) feet and a thiat, -six-foolface of cw-h to face of curb. "
The Planning Staff recon-imends approval the waivers and approval of the requests with the
following condition .
1. The applicant shall submit to Engineering a revised master plan and inaster drainage plan.
2. All abbreviations, re ewes, easements and relative information must be defined on the
plat adhering to Centerpoint Energy requircments.

Attached for consideration is a Preliminary Plat for Faith Estates, Section I. Section 1 will
contain 8.26 acres ofa 31.32 acre composite tract. Said composite tract being all of Tract [TrocL
11, and Tract 111, as descr r ibed in Clerk-s File No. 2018034594 of the Jefferson County Official
Public Records.
Section lwill create Blots and lreserve tracts fronted ontwo proposed roads, Grace Lane and
FavorStreet. Ath1rdpropose dmadnome d Pea ce Street wiUse rveasansxtensionforf uture
sections of Faith Estates. Water service will be looped, having two access points on the Mart
Road water main. Sanitary Sewer service will be extended from an existing main on Plant Road.
Storm Sewer service has been coordinated with the City Engineering Department. The HOA will
maintain a detention basin system that will tie-in to Drainage District No. GfacUit/es.
As a part of our preliminary plat,, we are requesting the Planning Commission waive two items
moving forward with this preliminary plat:
l. We are requesting the Planning Commission waive temporary cul-de-sacs at the end of
Grace Lane and Peace Street.
2. VVeare requesting the Planning Commission waive the right ofw/ayncquirementfor
Favor Street from Plant Road to proposed Peace Street. The City of Beaumont has
requested that a variance be considered for the placement of a 36 foot wide concrete
paved minor collector street within a 50 foot right of way. The original subdivision,
Woodland Meadows Section One, was prepared in 1982 and the City of Beaumont
Subdivision Ordinance had different requirements for rights of way and pavement
widths. The property was platted with two (2) 50 foot wide rights of way providing for
future development. The entrance on the west side of the development provides for the
widening of the 50 foot right of way to an 80 foot right of way. This will provide for a 35
foot pavement width and a median to divide roadway entrance into the property. Tile
second entrance (east entrance) is constrained by the original right of way width of 50
feet, as the properties on each side of the right of way (Lot lG, Block Z, and Lot l , Block
3, of Woodland Meadows Section One) are owned by individuals with residences on
these tracts and this right of way cannot be widened. The City of Beaumont is stating
that the east entrance to the development should be configured as a minor collector.
Since there are constraints on the existing right of way provided on the Woodland

Meadows Section One subdivision plat, we are requesting the variance for the width of
the right of way, We are proposing the right of way on Favor Street be set at 50 feet
from proposed Peace Street to Plant Road. To help with traffic flow near Plant Road, the

variance will allow for multiple entrances into the subdivision of sufficient width to
provide safe entrances and exits from the property.

The conditions upon which the request for avariance is based are unique tothe
property for which the variance is sought and are not applicable generally to other
property. The proposed right of way is limited due to the way Woodland Meadows
Section One was platted, under previous City Ordinances, in which 58 foot right ofways
were established for future development access.
Because of the particular physical surroundings, shape or topographical conditions of
the specific property involved, a particular hardship to the owner would result, as
distinguished from a mere inconvenience, if the strict terms of these regulations are
enforced. As stated previously, our client is limited to the 50 foot right-of-way that was
platted for Woodland Meadows Section One and it cannot be expanded, as there are
owners on each side. Our client would not be able to construct the second entrance to
the subdivision, which could change traffic flow for the subdivision and force higher
traffic at the west entrance.
The variance will not in any significant way vary the provisions of the zoning ordinance,.
zoninS map,, or comprehensive plan. This variance would only allow the 50 foot right of
way tobeused.
