Chairman Nejad moved to approve the nuntites of the Joint Public Hearings held on November
215 2022. Commissioner Javed seconded the motion. The motion to approve the minutes carried

1) PZ2022-370: Request foci approval of a eplat of Lot 59, Neches Terrace Addition into Lots
1, 2, and 3, Highway 105 Addition No. 1, Beaumont, Jefferson County, Texas.
Applicant: Access Surveyors
Location: 8525 Highway 105
Mrs. Josey presented the staff report. Blythe Hu ill of Access Surveyors, L.L.C., has requested
approval of a ePlat of Lot 59, Neclies Terrace Addition into Lots 1, 2 and 3, Highway 105
Addition No. 1, Beaumont, Jefferson County, Texas. The lots on Tollvar Road do not inect the
mininium lot with requirement, but were approved for a Variance by the Board of Adi ustment on
November 3, 2022. The purpose of the plat is to create two (2) new buildable lots at the rear of
the property along Tolivar Road. All utilities are present and available to all lots.
Slides of the subject property, and proposed plat were shown.
The Planning staff recommended approval of the request.
Eight (8) notices were mailed to Property owners within two hundred (200) feet of the subject
property. Zero responses were received in favor and zero were received in opposition.
The applicant was present. Mitch Brackin, of Access Surveyors, L.L.C., 11025 Old Votil Road,
representing Kendra Williams, addressed the Commission. He stated that he had no additional
information to provide regarding the request.
The public hearing on this item was opened and closed without comment.
Commissioner Quraishi moved to approve the request for a eplat of Lot 59, Neches Terrace

Mrs. Josey presented the staff report. Scott Brackin & Amy Lea of Access Surveyors, L.L.C.,
have requested approval of a eplat of Lot 18, Block D, Mayfair 2"d Addition into Lots 18A and
18B, Mayfair 2 nd Addition, Beaumont, Jeffers011 COLInty, Texas. The property is located at 1755
Amelia Street. The purpose of the plat is to divide the property into two (2) buildable lots. All
utilities are present and available to both lots.

Planning staff recommended approval of the request.

Mayor Mouton called the Joint Public Hearings of December 19, 2022 to order at 3:30 p.m. and
explained the purpose of the Joint Public Hearing process. Mayor Mouton then turned the
meeting over to Chairman Nejad to conduct the Joint Public Hearings.
3) PZ2022-472: Request for a Specific Use Permit to allow a vehicle storage facility in a GC -
MD (General Commercial -Multiple Family Dwelling) District.
Applicant: Obay Naser
Location: 1035 Grand Street
Mrs. Engpian presented the staff report. Obay Maser requests approval of a Specific Use Permit to
operate a vehicle storage facility located at 1035 Grand Street. Mr. Laser has been operating with
Hawk Towing Set -vice for three (3) years and is relocating his business to be in conjunction with
an existing automotive repair shop. A total of four (4) employees, to include two (2) drivers, one
mechanic, and one office personnel. Section 28.04.008(15) Special Conditions states, "in ci GC-

City of Beaumont Police Department requires all towing services to be registered with the City, III
addition to bearing proof of being licclised and permitted as a tow truck pursuant to state statutes.
In order to be considered on the City's To Rotation list, the towing service must have a physical
location and be ftilly registered with the City, including adhering to all requiren-ients as set forth ill
Section 6.09 Tow Trucks, Towing Companies and Tow Truck Operators of the City's Ordinanecs.

Staff recommended approval with the following conditions:
1. The applicant shall be in conformance with all City of Beaumont Police requirements.

3. Inoperable vehicles shall not be located outside of private property.
4. If applicable, any lighting installed on the property shall deflect away from neighboring
residences.
Twenty-five (25) notices were niailed to property owners within two hundred (too) feet of the
subject property. One response was received in favor and one was received ill opposition. Ms.
Enginan stated the letter of opposition noted that the area looks like a jUnkyard that will
depreciate the value of the property.
The applicant was present. Obay Maser, 1035 Grant Street, addressed the Commission. He
stated that anything that they do will be in accordance with Police Departineiit rules. He also
stated that lighting will directed inside the storage lot. Mr. Naser stated that lie understood and
had no objections to the proposed conditions.
Brief discussion followed concerning fencing location, discussion with neighbors regarding the
vehicle storage facility, and hours of operation.

Coninlissioner Jabbar moved to approve the reiest for approval of a Specific Use Perlilit to

1. The applicant shall be in confonnance with all City of Beaumont Police requirements.

SUBJECT: To consider a request for Preliminary Plat approval of Faith Estates, Section 1,
Beaumont, Jefferson County, Texas.

STAFF RE PORT
Aaron Ward of Faust Engineering and Surveying, Inc., has requested Preliminary Plat approval
of Faith Estates Section 1. The development is located south of Plant Road and west oelbig
Road. The 8.26 acre development is a thirty-tlu-ec (33) lot residential sub divi"sion in the R-S
(Residential Single- Fain ily Dwelling) zoning District. Grace Lane and Peace Street will have 60'
right-of-ways with no less than 38' in pavement width. Favor Street will have a 50" right-of-way
with no less than 28' in pavement width. Both Grace Lane and Favor Street will access Plant
Road. Water and sewer will be provided by extension of City utilities.
'I"he preliminary plat of Faith Estates was reviewed by Planning Commission previously on
September 19, 2022. This plat was approved with conditions at the time, however, between
approval of the preliminary plat and the time consti-Liction drawings were received, revisions had
been made by Faust Engineering. Those changes included the width of the right-of-way for
Favor Street to be reduced from,60' to 50' and the removal of Lot 1, Block I of the Woodlands
Meadows Section One from the platted area. With such changes made, the plat must be
reviewed again by the Planning Commission.
As Grace Lane and Peace Street will extend less than two hundred (200) feet beyond Favor
Street., a temporary cul-de-sac waiver has been requested by Faust Engineering. Section
26.03.002(8)(B) states, The planimig con7nnssion inay waive ten7po)-aty cid-de-sac

Additionally, the preliminary master plan shows that Grace Lane and Peace Street will be
extended to connect Section 2 of Faith Estatcs subdivision in the future.
Faust Engineering has proposed Favor Street to have a 50' wide right-of-way and pavement
width of 38' reducing down to 28' from Plant Road to Peace Street; as such they request a
waiver to the minor collector street requirement for said portion of Favor Street. Section
26.03.002(4) states, "...A street serving inore than sixty-four (64), but less than four hundred
fifty (450) dwelling units, shall be a niinor collector street with a tight- oflivaj) of no less than

The Planning Staff recommends approval the waivers and approval of the rcquests with the
following condition:
1. The applicant shall submit to Engineering a revised master plan and master drainage plan.
2. All abbreviations., reserves, easements and relative information niust be defined on the
plat adhering to Centerpoint Energy requirements.

Section lwill create 33lots and lreserve tracts fronted ontwo proposed �ds.,Grace Lane and
Favor Street. Athird proposed road namedPeace Street will serve asanextension for future
sections of Faith Estates. Water service will be looped, having two access points onthe Plant
Road water main. Sanitary Sewer service will be extended from an existing main on Plant Road.
Storm Sewer service has been coordinated with the City Engineering Department. The HOA will
maintain e detention basin system that will 1|e'|n to Drainage District No. 6 facilities.
As a par{ of our preliminary plat, we are requesting the Planning Commission vvakz two items
moving forward with this preliminary plat:
l. VVeare requesting the Planning Commission waive temporary cul-de'sacsatthe end of
Grace Lane and Peace Street.
2. VVeare requesting the Planning Commission waive the right ofway requirement for
Favor Street from Plant Road to proposed Peace Street. The City of Beaumont has
requested that a variance be considered for the placement of a 36 foot wide concrete
paved minor collector street within a 5Ofoot right ofway. The original subdivision,
Woodland Meadows Section One, was prepared in 1982 and the City of Beaumont
Subdivision Ordinance had different requirements for rights ofway and pavement
widths. The property was platted with two (2) 50 foot wide rights of way providing for
future development. The entrance on the west side of the development provides for the
widening of the 50foot right of wayto an 80 foot right of way. This will provide for a 36
foot pavement width and a median to divide roadway entrance into the property. The
second entrance (east entrance) is constrained bythe original right ofway width of5O
feet as the properties on each side of the right of way (Lot lG, Block 2, and Lot l , Block
3,ofWoodland Meadows Section One) are oyvnedbyindividuals with residences on
these tracts and this right ofway cannot bewidened. The City nfBeaumont |sstating
that the east entrance to the development should be configured as a minor collector.
Since there are constraints onthe existing right ofway provided on the Woodland
Meadows Section One subdivision plat, we are requesting the variance for the width of
the right ofway, VVe are proposing the right ofway onFavor Street beset et5Ofeet
from proposed Peace Street to Plant Road. To help with YraDlo flow near Plant Road, the
paving width for the first 120 feet of Favor Street will be 36 feet. The granting of this
variance will allow for multiple entrances into the subdivision of sufficient width to
provide safe entrances and exits from the property.
In surnmary, regarding the right of way variance request:

The conditions upon which the request for avariance isbased are unique tothe

Section One was platted, under previous City Ordinances, in which 50 foot right of ways
were established for future development access.
Because of the particular physical surroundings, shape ortopographical conditions of
the specific property involved, aparticular hardship to the owner would result, as
distinguished from a mere inconvenience, if the strict terms of these regulations are
enforced, As stated previously, our client is limited to the 50 foot right-of-way that was
p\attedforVVood\andMeedovvsSect\onOneanditcannotbeexpanded,as\hereane
owners on each side, Our client would not be able to construct the second entrance to
the subdivision, which could change traffic flow for the subdivision and force higher
traffic at the west entrance,

In October of 2021, City Council approved a Specific Use Permit to allow an automotive shop at
1109 Harriot Street subject to the following conditions:
1. Maximum of eleven (11) vehicles to be on the property at any given time, including
custon-ier and employee parking.
2. All auto repair must be conducted Insidc the shop.
For many years, this property was the location of Eagle Auto Services, a service station. That
business no longer appears in the City Directory after 2010. Since that time the property has not
been occupied consistently and as it is now zoned NC (Neighborhood Commercial) District,
requiring a Specific Use Permit for an automotive shop. Complaints were received due to
vehicles parked on the right-of-way, blocking the view of traffic for the intcrscetion of Harr'lot
and Park Streets. The property was found to be in violation as not only was no Certificate of
Occupancy on file for the current auto shop, but a Specific Use Permit was needed.
Since the approval of the Specific Use permit, the property has remained in violation of both
conditions for every inspection. Code Enforcei-nerit filed charges for the excess min-iber of
vehicles and no Certificate of Occupancy. In February of 2022 the business owner was placed
on a 90-day probation for excessive vehicles. In May, both items were brought before the judge
at which time the property owner was fined, but violations have continued.
Section 2 8.0 4.001 (h) of the Zo ning Ordinance states, "A sime ific use Perin it n 7 a)) b e i -e i�o ked on

STAFF REPORT
Derick Leger, on behalf of New Faith Holiness Church, Inc., requests a Specific Use Permit to
expand the church located at 5250 Hc1big Road. The GCMD-2 zoning district requires a
Specific Use Pen -nit for all proposed land uses. Mr. Leger intends to install a premanufactured
building for a fellowship hall and increase the size of the parking lot. Section 28.04.006 of the
City's landscaping ordinances states., "an increase in the size of an existing parking lot by

section." The hours of operation will be Wednesdays from 6:30am to 9:00pm, Thursdays from

Stafff reconn-nends approval of the request with the following conditions:
1. Construction plans must meet all requirements by Water Utilities for any water and
sanitary sewer improven-tents,, including any requirements of the City's backflow,
pre-treatment, and/or F.O.G. pro grain.
2. Construction plans shall be in compliance with Section 28.04.006 Landscaping and
screening requirements
3. Construction plans must meet all Building Codes requirements.
Please note that final occupancy approval is subject to review and acceptance of submitted plans
and field inspections to verify compliance with applicable codes.
