Home My WebLink AboutORD 23-002 ORDINANCE NO. 23-002 ENTITLED AN ORDINANCE ABANDONING ALLEYWAYS LOCATED IN BLOCKS 1, 2, 3, AND 4 OF THE CALDER ADDITION, AND THE RIGHT- OF-WAY ABANDONMENT OF THE 600 BLOCK OF FORREST STREET IN BEAUMONT, JEFFERSON COUNTY, TEXAS. WHEREAS, Barbra Wilson along with most of the adjacent property owners would like to request the abandonment of the alleyways in Blocks 1-4 of the Calder Addition and a portion of Forrest Street right-of-way from the south right-of-way line of North Street to the north right-of-way line of McFaddin Avenue, Beaumont, Jefferson County, Texas as shown in Exhibit "A," attached hereto; and, • WHEREAS, the City Council has considered the purpose of said abandonment and is of the opinion that the alleyways are no longer necessary for municipal street purposes, with the exception of the retention of a sewer line easement, and the abandonment of said alleyways are in the best interest of the City and should be granted subject to the following condition: • 1. All alleyways and street to be abandoned will be retained as us utility and access easements. 2. Pavement for abandoned portions of Forrest Street will no longer be maintained by the City of Beaumont. 3. Streets lights in abandoned portions of Forrest Street must be removed or transferred into a private account. 4. Any gate installed to restrict access to the alleyways and abandoned street must be at least 12' wide with Know padlocks for fire access. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the alleyways in Block 1-4 of the Calder Addition and a portion of Forrest Street right-of-way from the south right-of-way line of North Street to the north right-of- way line of McFaddin Avenue, Beaumont, Jefferson County, Texas, as shown in Exhibit "A," attached hereto, be and the same is hereby vacated and abandoned and that title to such property shall revert to and become the property of the persons entitled thereto by law. The meeting at which this ordinance was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
