Mrs. Engman presented the staff report. Access Surveyors, on behalf of Kendra and Justin Williams,
requests a Variance for the required street frontage for a proposed ininor plat. The property is zoned
Residential Single -Family (R-S) and therefore requires a street frontage of 50'. The applicant requests
the required street frontage be reduced fron-i 50' to 49.87". The intent of this Variance is to take one
(1) lot and divide it into three (3) single family lots.
Our minimun-i lot requi rements for lots within the R-S zoning district are 5 0 " in width by 100' in depth.
Therefore., this lot is Icss than the required ii-iininiums set forth in City ordinances within Sectioll
28.03.024 District Area and Height Regulations. Please see Lots 2 and 3 of the proposed plat located
in your packets for a visual reference of the aforementioned.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary for
approval have been met:
A) That the granting of the Variance will not be contrary to the public interest;
B) "that literal enforcement of the ordinance will result in unnecessary hardship. because of
exceptional narrowness, shallowness, shape topography or other extraordinary or
exccptional physical situation or hardship physical condition unique to the specific piece of
property in question, "Unnecessary hardship" shall mean physical hardship relating to the
property itself as distinguished from a hardship relating to convenielicc, financial
considerations or caprice, and the hardship must not result from the applicant or owner's
actions; and
C) That by granting the Variance, the spirit of the ordinance will be observed and substantial
justice will be done.
Slides of the subject property and site plan were shown.
Eleven (11) notices, were mailed to property owners within two hundred (200) feet of the subject
property, Zero (0) responses were received in favor and one (1) was received in opposition. There
were no notes to the opposition for the owner of a neighboring property.
Brief discussion followed concerning the location of a neighboring property, structures situated on the
subject property, and subject property easements & setbacks.
The public hearing Naas opened on this item.
Justin Williams, 150 Remington Circle, Lumberton, Texas, addressed the Board. He stated he
represents ownership of the subject property. The structure he removcd from the property was a garage
used for automotive repairs by a former owner. He added that sorneone is currently residing in the
home located on Lot I with the intention of the renter purchasing the home. Newly constructed honks
will be erected on Lots 2 & 3.

n-iotion. A roll call vote was taken. Chairman Timaeus-Aye, Board Mcn-tber Beaver -Aye, Board
Member Hilliard -Aye, Board Member Rowe -Aye, Board Member Sorrell -Aye. The motion to approve
passed 5 -0 0.

am writing this letter in order to apply for a variance for the above -mentioned address. The,
current lot is an oddly shaped and with the current required setbacks, there is not enough room to
build a new home. The property is approx. 8,200 sq ft without any setbacks. With the setbacks,
there will be approximately 2,700 sq ft in a triangular shape of buildable area.
This homeowner- has been approved to receive a new home from the GL 0 with
appiroxmately 1400 sq ft. with attached porch and an ADA approved ramp. For us to build the
new home,, we are requesting a build line variance.
The rear build line is 25' and we would like to request the b-uild line be moved back 20'
to where there would only be a 5' rear build line. Also, we would I Ike to request to build the rear
concrete stoop over the rear wild litic.
If we were to be granted this variance, then we would have a greater chance of fitting a
new home on the lot with the allocated bedrooms the GLO has set forth for this homeowner.

REF: VARIANCE APPLICATION FOR ROOF EXTENSION
Dear Planning Commission,
WMC — Wire Mesh Corporation is a Company focused on the manufacture of Wire and Mesh for the
Co nst ru ctio n Sector. With out' 9 Production Plants around US we loop for a cco m p lish a I I of our custom er's
orders.
Part of our growth Strategy includes the relocation of Wire equipment to our Plant in Beaumont located
in 220 Avenue A,, Beaumont TX 77701. This, to increase our control of Production Schedules and internal
Processes.
For that reason., its required to build an 'open -air" Roof attached to the existing Hall to cover the area due
to the new arrangement of the existing Equipment. The extension is planned to be composed by Steel
Columns and Roofno walls are required.
Unfortunately., the Projected Roof extension covers the 25' Setback from the property Line required in
the Zoning Codes. (see image below).

In that sense., we are applying for a Variance, answering the following requested conditions:
a) That the granting of the variance will not be contrary to the public interest.

b) That the granting of the variance will not be contrary to the public interest. That literal
enforcement of the chapter will re s ult in unn ecesso ry hardship because of excep tion al a rro wn ess,
shallowness, shape, topography or other extraordinary or exceptional physical situation or
physical condition unique to the specific piece of property In question. ("'Unnecessary handicap
[hardship]"' shall mean physical hardship relating to the property itself as distinguished from a
hardship relating to convenience, financial considerations or caprice, and the hardship must not
resultfrom the applicant's or property owner's own actions.)
