Jennifer Smith with Tegrity Homes, onbehalf ofBrandieWhite, brequesting aVariance for the property
located at341O Duke Street. The property is zoned Residential 3|nQ|e Fam|k/(RS) and therefore requires
arear building setback of25'and apavement setback of2'. The applicant |srequesting the rear yard
setback to be reduced from 25' to 5" and the pavement setback to be reduced from 2' to 0'. Please see
the site plan located in your packets for a visual reference of the aforementioned.
34lODuke Street has ameasurement of73'atits maximum depth, and ameasurement of
approximately 197" at its maximum width. Due to the shape of the lot, it is limited in buildable space
with strict adherence to the, required setbacks. The existing home is situated over the property line. If
the Variance is granted, the proposed home will be built within the boundary lines of the property.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary for
approval have been met:

B) That literal enforcement of the ordinance will result in unnecessary hardship because of
exceptional narrowness, shallowness, shape topography or other extraordinary or
exceptional physical situation or hardship physical condition unique to the specific piece of

property itself as distinguished from a hardship relating to convenience, financial
considerations or caprice, and the hardship must not result from the applicant or owner's,
actions; and

Board of Adjustments
I am writing this letter in order to apply for a variance for the above -mentioned address. The
current lot is an oddly shaped and with the current required setbacks, there is not enough room to
build a new home. The propes ty is approx. 8,200 sq ft without any setbacks. With the setbacks,
there will be approximately 2,700 sq ft in a triangular shape of buildable area.
This homeowner has been approved to receive a new home from the GLO with
approximately 1400 sq ft. with attached porch and an AD A approved ramp. For us to build the
new home, we are requesting a build line variance.
The rear build line is 25' and we would like to request the build line be moved back 20'
to where there would only be a 5' rear build line. Also, we would like to request to build the rear
concrete stoop over the rear build line.
If we were to be granted this variance,, then we would have a greater chance of fitting a
new home on the lot with the allocated bedrooms the GLO has set forth for this homeowner.
