SUBJECT: To consider a request for a Variance to the required street frontage to be
reduced from 50'to 49.87'.

STAFF REPORT
Access Surveyors, on behalf of Kendra and Justin Williams, requests a Variance for the required
street frontage for a proposed minor plat. The property is zoned Residential Single -Family (R-S)
and therefore requires a street frontage of5O' The applicant requests the required street
frontage bereduced from 5O'to49.87' The intent ofthis Variance 1stotake one (1)lot and
divide it into three (3) single family lots.
Our rn|nirnurn lot requirements for lots within the R'S zoning district are 50' in width by lOD' in
depth. Therefore, this lot is less than the required minimums set forth in City ordinances within
Section 28.J3.C24District Area and Height Regulations. Please see Lots 2 and 3ofthe
proposed plat located in your packets for a visual reference of the aforementioned.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary
met -
A) That the granting ofthe Variance will not becontrary tothe public interest;
8\ That literal enforcement ofthe ordinance will result in unnecessary hardship
because of exceptional narro�vness, shallowness, shape topography or other
extraordinary or exceptional physical situation or hardship physical condition unique
tothe specific piece ofproperty inquestion. "Unnecessary handsh|p"shall mean
physical hardship relating tothe property itself as distinguished from o hardship
relating to convenience, financial considerations or caprice, and the hardship must
not result from the applicant orowner's actions; and
C\ That by granting the Variance, the spirit of the ordinance will be observed and
substantial justice will be done.
