Myranda Craft, on behalf of Esther Auzenne, homeowner, requests a Variance to the property located at
l5lSBg|eStreet. The property is zoned RS (Residential Single Family Dwelling) district and therefore
requ\resaZ5'bui|dingset back f romthe rearpnzpedyUno. The appUoanLrequest iherearyardsetback
to be reduced from 25' to 5"6-" to accommodate a set of stairs toward the rear of the home.
Additionally, aconcrete pad will beinstalled etthe bottom ofsaid steps. Ms. Craft requests the
pavement setback tobereduced from 2'to6"ioaccommodate such. Please see the site plan located in
your packets for avisual reference ofthe aforementioned.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary for
approval have been met:
A) That the granting of the variance will not becontrary tothe public interest;
B) That literal enforcement ofthe ordinance will result inunnecessary hardship becauseof
exceptional narrowness, shallowness, shape topography or other extraordinary or
exceptional physical situation orhardship physical condition unique iothe specific piece of
property inquestion. "Unnecessaryhardship" shall mean physical hardship relating tothe
property itself as distinguished from a hardship relating to convenience, financial
considerations or caprice, and the hardship must not result from the applicant or owner's
actions; and
Q That by granting the variance, the spit -it of the ordinance will be observed and substantial
justice will bedone.
