The variance will not be contrary to the public interest. It is only
technical in nature, since the survey reports measurements rounded
to the hundredth of a foot. The Area & Height Regulations table lists
minimurn lot widths to the nearest whole foot.
The literal enforcement of the ordinance will prevent the landowner
from subdividing the property, which was the original intent when
purchasing the land. The legal description of record described a
1 OOx320 tract, but upon resurvey, the south line was only 99.75 feet.
This is the reason for the variance request.
The spirit of the ordinance will still be observed when considering
E
significant figures of the lot width requirements 49.8aT. as
surveyed = 50a^E-",' as required). Substantial justice will be done,
since the variance will help the land owner and there will be no loss
or harm to the public.
