Richardson, Planning Director '14�_ SUBJECT: Request to consider changes to Article 111, Section 30-33,Special Conditions; Article II, Section 30-25(b), District urea and Height Regulations; Article 111, Section 30- 26(g), Specific Use Permits -Time Limits; Article 111, Section 30-29(a), Planned Unit Development Standards and Requirements -General Plan; Article 111, Section 30- 30(d), Non Conforming Uses -Exemptions; Article IV, Section 30-40(f), Changes, Amendments and Specific Use Permits -Time for Action; Article II, Section 30-14, District Regulations, to delete CSC, Community Shopping Center, District Regulations; Article II, Section 3,0-24 (b), Permitted Use Table NOTE: This item was tabled until the February 17, 1997 Joint Hearing. City Council has appointed a Zoning Development Committee to work with Staff on the proposed changes. The first meeting of this committee is to be lield on February 13, 1997. Staff will provide the Planning Commission and City Council with an update of this rnecting. FILE: 561-OB STAFF REPORT If it is the desire of the Planning Commission, 561 -OB will need to be tabled again to some future date. The proposed changes, as presented at the October 21, 1996 Joint Hearing, are on the following pages. Deletions are indicated by a line running through the sentence. Additions are indicated by shading. The proposed changes are described as follows: GC -MD (General Commercial -Multiple -Family Dwelling) District A. Specific Use Permit Amend the Zoning Ordinance by adding a Special Condition 23 to read as follows: "Property of one acre or more in size which is rezoned to GC -MD after (effective date of this section) may not be developed for any use without obtaining a Specific Use Permit. The size of the property shall be determined by including all contiguous property under single ownership," This change is recommended in order to help the Planning Commission and City Council in their decision making process when considering the appropriateness of zone change requests for GC -MD zoning. In addition these changes would limit the potential impact that larger developments could have on surrounding properties, B. Amending the "District Area and Height Regulations" by defining a minimum per unit lot area requirement (2,450 sq, ft.) for multi -family uses in a GC -MD District, The purpose of this change is to clarify the maximum allowable density for multi -family uses in a GC -MD District, If someone wishes to develop residential at the maximum allowable density, RM-H zoning would be required. 2. Administrative A. Amending the time limit for specific use permits from two years to one year and to require that all conditions of approval be met prior to the issuance of a certificate of occupancy. A person would have one year to commence or be substantially underway with his development. Before a certificate of occupancy is issued, all conditions of the specific use permit must be approved. This change would no longer let an individual operate under his specific use permit before meeting all the conditions of the specific use permit. B. Amending the PUD regulations by deleting the required 3/4 City Council favorable vote if the Planning Commission did not recommend the general plan required for a PUD development, This would provide City Council more flexibility in approving PUDs. C. Amending the specific use regulations by deleting the ability of one specific use permit in a RCR District to change to another without City Council approval, There has been concern over granting specific use permits in a RCR District if there is the possibility of it changing to another use that might be more objectionable than the original use. This proposed change would require any change in use to get approval of City Council. D. Amending the approval process of specific use permits whereby if no action is taken within 60 days of the public hearing, the specific use permit would be automatically denied. Presently, if action is not taken within 60 days, a specific use permit is automatically approved. This proposed change would make the "no action" rule the same for specific use permits as it is for zone change requests, E. Deleting the Community Shopping Center District Regulations. This action is recommended in order to simplify the Zoning Ordinance, There is no property zoned CSC. This district has not been used for years, if ever. All currently developed shopping centers that would qualify for this zoning classification are zoned GC -MD. 3. Permitted Use Table A. Amending the Permitted Use Table by adding or deleting some uses now permitted by right or with a specific use permit in certain zoning categories. These recommended changes reflect clarifications of uses, additions to permitted uses or deletions of permitted uses. B. Amending the Permitted Use 'Table by deleting the CSC (Community Shopping Center) District. The deletion of the CSC District is being proposed as a "housekeeping" measure. There are no properties zoned CSC. The district has been used infrequently in the past. The last property with that zoning was on part of the property where the new Wal-Mart store now sits. That property was rezoned to GC -MD in 1994. The proposed amendments to the Permitted Use Table are highlighted on the attached table. These recommended changes reflect a clarification of uses, additions to permitted uses or deletions of permitted uses. In the right hand margin of the Permitted Use Table, you will note that a (1) or a (2) has been placed by each of the proposed amendments, The (1) denotes when the SIC Group has been expanded for clarification purposes (Note: May result in addition/deletion or specific use requirement change). The (2) denotes an addition, deletion or change from a permitted use to a specific use permit requirement. PROPOSED CHANGES TO THE ZONING ORDINANCE 1.
