Joint Public Hearings of the Planning Commission and City Council were held on February 17,
1997 with the following members present:

APPROVAL OF THE MINUTES
Commissioner Bundy made a motion to approve the minutes of the February 3, 1997 Joint
Public Hearings. Motion was seconded by Commissioner Dykeman, Motion to approve carried
6:0.
JOINT PUBLIC HEARINGS
Mayor Moore called the Joint Public Hearings of February 17, 1997 to order and explained the
i ? purpose of the joint hearing process and then turned the meeting over to Chairman Leister. She
explained the policies and procedures for the hearing process.

1) File 1350-Z: Request for a zone change from RS (Residential Single Family Dwelling)
to LI (Light Industrial) District.
Location: 2585 Wescalder Road
Applicant: Steve and Billee Bush
Mr. Richardson said that the zone change request was from RS to LI (Light Industrial)
District or a more restrictive district.
The applicants own the home at this address. The property is L-shaped with a portion
fronting on Wescalder and a portion fronting on Victory, a private drive.
It is the intent of the applicants to operate a small business on the subject property once
they retire. Since a portion of their property is now zoned LI, it is their desire to rezone
the rest of their property to LI.
Approximately five acres of land in this area is already zoned Light Industrial. This is
the location of an old oil and gas processing facility. This property was zoned LI in
1964. A major portion of this industrially zoned property is now occupied by Jack's
Cars and Trucks. The vast majority of the property in this area is zoned RS and the
developed properties are mostly single family residential.
Mr. Richardson recommended denial of the zone change request to LI or a more
restrictive commercial district. Staff feels that it would be an encroachment upon
existing single family development and would not be in compliance with the policies
and proposals of the Comprehensive Plan.
Fifteen notices were mailed to property owners within 200 feet. The Planning Division
received no responses in favor and four in opposition.
Chairman Leister opened the public hearing and asked for the applicant's comments.
Billee Bush, the applicant, addressed the Commission and Council. Mrs. Bush and her
husband own the Chevron service station on Calder across from St. Elizabeth Hospital.
They have been there almost eight years and do all major automotive repairs. She
presented floor plans and elevations of the building they would like to build if the zone
change is granted. She understands the concerns of disturbing the residential area, but
she feels that the area is remote enough not to present a problem.
Chairman Leister asked for comments in favor or in opposition.

Richard Mathews, 2515 Wescalder, spoke in opposition to the request because he feels
that it will disturb the neighborhood. Mr. Matthews presented a petition with 11
property owner signatures from the immediate neighborhood.
Wade Graham, 2810 Wescalder, spoke against the zone change request. He said that
the noise from Jack's Cars and Trucks was disturbing enough.
Mrs. Frost, property owner at the corner of Wescalder and Victory; has two other
houses in the neighborhood. She complained about Jack's Cars and Trucks and the
appearance.
Bill White, 2785 Wescalder, spoke in opposition. He said that Jack's looks like a junk
yard.
Frances Shelton, rents one of houses in the neighborhood and also owns a lot in the
area. She expressed concerns about increased traffic from the business and the danger
it would present to her child riding her bicycle.
David Gates, 2455 Wescalder, addressed concerns about increasing traffic.
Mary Fasulo, 2405 Wescalder, spoke in opposition.
Rose Mary Fryar, 2425 Wescalder, complained about the current condition of the road
and with an increase in traffic from the proposed business, feels that it would
deteriorate further.
Rebuttal by Billee Bush.
Discussion between Councilman Goodson and Mr. Richardson regarding zoning
districts and permitted uses followed.
Councilman Goodson asked if the 20% Rule would be in effect. Mr. Richardson said
that would be determined after the meeting.
Chairman Leister closed the public hearing.
Further discussion between the Commission and staff regarding zoning categories.
Commissioner Bundy made a motion to deny the zone change to LI or a more
restrictive district as requested in File 1350-Z. Commissioner LaBiche seconded the
motion. Motion to deny carried 6:0.

2) File 561-OB: Changes to the following sections of the Beaumont Zoning Ordinance:
1. GC -MD
a. Article III, Section 30-33, Special Conditions, to add sub -section (b)
(23) to require a specific use permit for certain properties or
developments in the GC -MD District.
b. Article II, Section 30-25 (b), District Area and Height Regulations,
to amend the allowable density for multiple family developments in
a GC -MD District.
2. ADMINISTRATIVE
a. Article III, Section 30-26 (g), Specific Use Permits -Time Limits, to
amend time limits.
b. Article III, Section 30-29 (a), Planned Unit Development Standards
and Requirements -General Plan, to remove or amend the required
three-quarter (3/4) City Council vote in order to approve a PUD
general plan that was disapproved by the Planning Commission;
C. Article III, Section 30-30 (d) 3, Non -Conforming Uses -Exemptions,
to delete this section which allows one specific use permit to be
changed to another without obtaining another specific use permit in
the RCR District;
d. Article IV, Section 30-40 (f), Changes, Amendments and Specific
Use Permits -Time for Action, to delete the automatic approval
process of a specific use permit if City Council takes no action within
sixty days.
e. Article II, Section 30-14, District Regulations, to delete CSC,
Community Shopping Center, District Regulations.
3. PERMITTED USE TABLE
Article II, Section 30-24 (b), Permitted Use Table, to add or delete
uses now permitted by right or with a specific use permit in certain
zoning categories and to delete the CSC (Community Shopping
Center) District.
W. Richardson reminded the Commission that this item was tabled at the November
18th Joint Hearing until today°s meeting. During that time, Council appointed a
Zoning Development Committee to assist Staff with these changes.

The first meeting of this Committee was held on February 13, 1997. The purpose of
the initial meeting was to identify the problems with the current Zoning Ordinance.
The "specific use permits in GC -MD Districts" issue was discussed at this meeting.
The Committee discussed three possible solutions:
1. Staffs initial recommendation whereby for any new zoning to GC -MD and the
property is one acre or more in size, a specific use permit would be required
before development.
2. Creating a new zoning district - "R-GC-MD" . This district would permit all
the current uses in GC -MD but would have more restrictions on dealing with
landscaping, buffering and traffic flow.
3. Creating an opportunity for an individual to apply for a specific use permit on
a voluntary basis when wishing to develop property in a GC -MD District.
This would happen when an individual realizes that he or she would meet a lot
of opposition from surrounding property owners.
The next meeting of the Committee is to be held February 27.
At the advice of the City Attorney's office, Mr. Richardson recommended that the
Planning Commission table the item indefinitely. Once a recommendation is
forthcoming, the new changes will be readvertised.
Commissioner Bundy made a motion to table File 561-OB indefinitely until further
information can beprovided. Commissioner Hallmark seconded the motion. Motion
to table carried 6:0.
