PLANNING COMMISSION
March 3, 1997

A Regular Meeting of the Planning Commission was held on March 3, 1997 with the following
members present:
Chairman Laurie Leister
Vice Chairman Marva Provo

Commissioner Dohn LaBiche
Commissioner Bill Lucas
Commissioner Cleveland Nisby
Commissioners Absent: Commissioner Bessie Chisum
Also present: Stephen Richardson, Planning Director; Murray Duren, Senior
Planner; Tyrone Cooper, First Assistant City Attorney and Jill Cole,
Recording Secretary.
Commissioner Bundy made a motion to approve the minutes of the Joint Public Hearings held
February 17,1997. Motion was seconded by Vice -Chairman Provo. Motion to approve carried
7:0.

REGULAR MEETING
1) Preliminary Plat -Manion Court: Consider the preliminary plat of Manion Court, Lot
A and Lots 1-11 out of the A. Huston Survey, Abstract No. 33, Beaumont, Texas. Land
totals 2.683 acres.
Applicant: Carroll & Blackman, Inc. for Nichols Development Company
Mr. Richardson informed the Commission that the residential subdivision is located at
the west end of Manion Drive.
The proposed subdivision will contain 11 residential lots and one out parcel. Manion
Court will be a private drive and entered through a locked gate.

There were objections by the Fire Marshal, the City Engineer and the Traffic Engineer
concerning the pavement width and the right-of-way radius of the cul-de-sac. The plat,
as submitted, showed a pavement radius of 25' instead of the 33.5' required. In
addition, the right-of-way radius was 35' instead of the required 50'.
Upon review of staff's recommendation, the developers have revised their plans to
provide for a pavement radius of 33.5' as required and are showing a right-of-way
radius of 43.5' instead of the 50'. Therefore, the developer is requesting a variance to
the 50' radius requirement so that Lot 11 will have adequate depth for development.
Tins request has been reviewed by all concerned parties and they have all agreed to the
variance.
Mr. Richardson recommended approval of the preliminary plat subject to the granting
of the variance of the right-of-way requirement for the cul-de-sac from 50' to 43.5;
Correct Note No. 4 of the FIRM Panel on the final plat; and Final approval by City
Council of Major Streets and Highway Plan as recommended by the Planning
Commission.
Discussion followed between staff and Commission regarding the Manion Street
extension , the variance for the cul-de-sac and the configuration of Lot No. 11.
Chairman Leister asked for the applicant's comments.
Joe Pattie with Carroll and Blackman, Inc., addressed the Commission.
Conunissioner Bundy made a motion to approve the Preliminary Plat of Manion Court
subject to the granting of the variance of the right-of-way requirement for the cul-de-
sac from 50' to 43.5 ; Correct Note No. 4 of the FIRM Panel on the final plat; and
Final approval by City Council of Major Streets and Highway Plan as recommended
by the Planning Commission. Commissioner LaBiche seconded the motion. Motion
to approve carried 8:0.
OTHER BUSINESS
Mr. Richardson briefed the Commission on the progress of the Zoning Development
Committee. The last meeting was held February 27, 1997.
Basically, it has been narrowed down to three options that would given to the
developer. First there would be a GC -MD district as we currently have; second would
be an option whereby there would be the GC -MD district with a specific use permit
required prior to development. This is similar to staff's recommendation but without
the acreage requirement and it would be optional, The third option is that staff be

asked to develop a GC -MD district with additional requirements for landscaping,
buffering, and building heights, with the uses being the same under the current GC -MD
district.
The Committee's idea is that we provide the developer with options so that when they
are in an area where they will meet a lot of opposition, then they would have other
districts that they could request that might soften the impact of new development.
The next meeting of the Zoning Development Committee is scheduled for Thursday,
March 13, 1997.
