Richardson, Planning Director SUBJECT: Request to rezone a tract of land from C-M (Commercial -Manufacturing) to CBD (Central Business District) located at 1310 Pennsylvania at Blanchette and Park. FILE: 1353-2 STAFF RE, PORT The Planning Director recommends approval of the zone change from C-M to CBD. This change will be in complete compliance with the Comprehensive Plan and the change will not create any non -conforming land uses as a result. The applicant wishes to open a work release program -- residential correctional rehabilitation services center in a 5,200, sq. ft. vacant office building attached to the north end of the Delta Career Institute building on property fronting along Blanchette, Park and Pennsylvania. The property (1.79 acres) is owned by John McCrey. The building is leased to Ken Webb who will sub -lease the 5,200 sq. ft. to Bannum, Inc., Largo, Florida. The chairman of Bannum is Arnold R. Rich and the applicant is David A. Lowry, President and Executive Director of Bannum. Bannum, operates residential community correction centers under the auspices of the United States Department of Justice, Federal Bureau of Prisons. Bannum's staff are not peace officers and do not carry weapons or wear uniforms. The subject property is now zoned C-M and residential uses are not permitted in the district. Residential uses are permitted in the CBD, however. PUBLIC NOTIFICATION Notices Mailed to Property Owners: 22 Responses in Favor: Responses in Opposition: LEGAL DESCRIPTION FOR ORDINANCE PURPOSES ON PROPERTY DESCRIBED AS FOLLOWS: Lots 735, 738, 739 and 740, Block 74, Beaumont Towns,ite; Tracts D, E, F and G, Tax Plat "S", Noah Tevis Survey and Lots 1, 2, 3 and 4, Bryan Addition, Beaumont, Jefferson County, Texas, containing 1.79 acres, more or less. ANALYSIS Under the regulations of the permitted use table of the zoning ordinance, most social service activities are permitted in the commercial and industrial districts. However, "residential care" combined with social services is not permitted in the C-M District, If the property is rezoned to CBD, the proposed use will be permitted. In addition, the use would also be subject to special condition no. 19. This condition is printed in the ordinance as follows: Section 30-33 (b) 19. Residential Care Uses: Compliance with the following conditions is, required. At least fifteen (15) days prior to the issuance of a building permit and/or a Certificate of Occupancy, written documentation must be submitted to the Building O,fficial outlining the type, size, location, characteristics and proposed activities of the facility. The names, addresses and phone numbers of the operators, general operation information, a site plan and a list of the licenses and grants the facility will operate under must also be submitted. b. The owners of the property within two hundred (200) feet of the proposed facility's property lines must receive a written notice of compliance with the ordinance no less than ten (10) days prior to the issuance of the building permit and/or the Certificate of Occupancy. The notice will contain a copy of the written documentation submitted to the Building Official as required in Special Condition (19) (A). A processing fee of one hundred twenty-five dollars ($125.00) shall be paid to the City. C. A facility must be licenses, certified, or accredited by an agency of the county, state or federal government prior to providing services and the issuance of a Certificate of Occupancy. Approval of a specific use permit by City Council may be used in lieu of a license, d. A facility must provide twenty-four (24) hour on -site supervision of its residents or clients. e. The sign will state the type of land use and the name, address and phone number of the agent or agency responsible for the proposed facility. The CBD and the C-M District were created as two of the several new districts in 1981 when the "new" zoning ordinance was adopted. The City has from time to time extended the CBD to accommodate economic development in different parts of the downtown area. These included changes which helped institutiona➢, professional and industrial land use concerns. The Comprehensive Plan does, show the subject property as being in the Central Business District. This area as shown on the plan includes land in several different zoning, districts. The land uses now existing on the 1.79 acres are commercial, professional and institutional. There are no manufacturing concerns on the subject property. This is a logical extension of the CBD and will be in compliance with the Comprehensive Plan. Bannum will be submitting a proposal to the Department of Justice to locate this Federal program at 1310 Pennsylvania, Beaumont, TX. Bannum will provide housing and related services to' those persons from Beaumont and the immediately surrounding area who are returning to their homes, family, and friends. Our residents will sleep at the facility and go to work daily, returning to the facility after work. Then, as long as they are honoring their agreement to qualify for the program, they can go visit their family and friends if they wish. They would then return to the facility in the weekday evening at their individual curfew time. Many residents would be allowed to check out on Friday and would not return again until their Sunday night curfew. Bannum will monitor each resident's movement in the community by periodic on -site and telephone verification of their employment, educational pursuits, family visits, or other whereabouts. Bannum will assist the resident to find employment if they are not employed by making referrals to local employment agencies and local employers which have expressed interest in employing these residents. since this is a period of transition for these persons, Bannum simply assists them in re-establishing employment and family ties, locating suitable housing and preparing to function normally within the community to which they are returning. Bannum also makes referrals to local community agencies as appropriate. [AE IV E- 0 1--FB 1 -2 1397 CITY OF BEAUMONT EXECUTIVE OFFICE L E- IS 6-3 - X Rannum's personnel monitors the program on a 24-hour basis, but there are no locks, bars, or other physical restraints. Bannum will employ a professional staff to include social workers to monitor and guide the residents through this period of transition. If a resident violates his agreement to remain in the program, by missing curfew, by unexcused absence from work, etc., or if the resident fails to return to the facility or decides to leave the facility without our permission, we cannot and will not stop them. in these cases we simply report the resident to the appropriate Federal authorities. Penalties include a return to incarceration. # Bannum's staff are not peace officers, are not permitted to carry weapons of any kind, and are not authorized to physically restrain any person. Bannum's staff do not wear uniforms or possess any other form of identification or powers than any other citizen of Beaumont. The subject property is currently zoned CM. We would like to request to change the zoning to CBD, The subject's current use is not indicative of Commercial Manufacturing. It is now part of the greater downtown Beaumont area and should be considered as the Central Business District, "Commercial Manufacturing is designed for intensive commercial uses and those selected manufacturing uses which are compatible with commercial development.'" Historically there may have been a need for manufacturing in this particular section of downtown but currently on the subject property there is no manufacturing activity nor is there any on property bordering the subject. On the subject property there is currently an office building housing the Delta Career Institute. It is bordered on the South by the American Legion Post 33 and to the West by another office building. 30 feet North of the subject is the CBD.
