SUBJECT: Request for a zone change from RS (Residential Single Family Dwelling) to RM-M
(Residential Multiple Family Dwelling -Medium Density) District.

STAFF REPORT
The Planning Director recommends denial of the zone, change because the proposal is, not in
compliance with the Comprehensive Plan and the change would create a "spot zone" in a
single family neighborhood.
Mrs. Taylor owns the house at 4115 Bennett Road, She has asked for the zoning change in
order to develop her property for medium density multiple family uses or as a residential care
facility for handicapped persons.
This was a rural area when annexed into the City in 1957. Original single family zoning for
the subject tracts and those in the neighborhood was applied in 1964. There has been sparse
residential development since that time along Bennett.
All of the properties in the immediate area are developed as single family homes, some in very
good condition and some in poor physical condition. The Comprehensive Plan. shows this as
a "neighborhood growth unit."
The RM-M district would allow multiple family construction up to a density of 18 units per
acre. The RS district permits eight units or homes per acre.
Bennett Road is a narrow (18' pavement) residential street with open ditch drainage. Itisnot.
a major street.
Changing the tract to RM-M would create a "spot zoning" situation in that all of the
surrounding tracts are zoned RS, and the development on those surrounding tracts is single
family on large lots. The RM-M district would allow uses not compatible with this
neighborhood.

This is an application being made to change RS Zoning to RM-M
Zoning. This request is being made to enable handicapped citizens
to live in a more structured environment. This land may be used by
handicapped citizens as single-family dwellings, garden apartments,
condominiums and townhouses. It is our proposal to meet the basic
needs of a balanced, orderly, convenient, economical and attractive
residential area.
Since the RM-M zoning functions as a buffer or transition between
major streets, we are of the opinion that this will be advantageous
to handicapped citizens. Recreational, religious and educational
areas are located in this area. Parkdale Mall, several churches of
various denominations, and elementary schools and high schools are
in adjacent areas.
