SUBJECT: Request to abandon a 20' wide general utility easement in Block 28, Cartwright
Terrace Addition,
STAFF REPORT
The Planning Director recommends approval of the request to abandon the 20' wide utility
easement located within the abandoned part of the 20' wide alley in that portion of Block 28,
Cartwright Terrace Addition, which lies north of the 100' wide Santa Fe Railroad right-of-
way.
SETCO General Contractors, represented by Tom Adams, General Partner, own all of Lots
1, 2, 3, 15 and 16, Block 28, Cartwright Terrace Addition, said lots abutting the easement,
The company has made the request in order to be able to construct an addition to a tenant's
building and property located at 745 South Fourth Street.
The Planning Division sent out information to interested parties describing the request. There
is a 6" sanitary sewer in the easement between Lots I and 16, This sewer line stubs out from
an 8" line in Forsythe. The 6" sewer serves the abutting property owners and will be
abandoned by Water Utilities to the owner, SETCO, according to S. A. Webb, Water Utilities
Director. At the time of the writing of this report, no comments regarding other utilities or
services were forthcoming.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
Being a 20' wide utility easement situated in Block 28, Cartwright Terrace Addition, said
easement having been retained by the City when abandoning a 20' alley right-of-way lying in
the north part of said Block 28, Cartwright Terrace Addition, on March 5, 1957, said 20'
wide easement abutting Lots 1, 2, 3, 15 and 16, said Block 28, and extending from the Santa
Fe Railroad right-of-way north to Forsythe Street, containing 0,0724 acres, more or less.

Our tenant located at 745 South 4th Street needs additional room
for expansion. If we can't provide him room for expansion he
will have to find another location.
The only way to provide the space he requests is to build a
building over the existing right of way. This addition will also
allow us to provide an entrance to his facility off Forsythe
Street. At present he can enter only from 4th Street which
contributes to the traffic congestion on 4th Street. We will
also provide additional off street parking which is desperately
needed.
Presently, the utilities to our buildings come from 4th Street.
If required, we will grant an easement between the buildings at
75 and 745 South 4th.
