Moore Mayor Pro -Tern Andrew Cokinos Councihnember Lulu Smith Councilmember Guy Goodson Councilmember John Davis Councilmember-at-Large Becky Ames Councilmember Bobbie Patterson Also present: Stephen Richardson, Planning Director; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Maria Trapp, Planning Technician; and Nancy Nicholas, Recording Secretary APPROVAL OF THE MINUTES Commissioner Bundy made a motion to approve the minutes of the March 17, 1997 Regular Meeting. Motion was seconded by Commissioner Chisum. Motion to approve carried 6:0. r � , planning Conunission April 21, 1997 JOINT PUBLIC HEARINGS Mayor Pro -Tern Cokinos called the Joint Public Hearings of April 21, 1997 to order and explained the purpose of the joint hearing process and then turned the meeting over to Commissioner LaBiche, who acted as Chairman for the meeting. He explained the policies and procedures for the hearing process. Mayor Moore arrived. 1) File 1354-Z: Request for a zone change from GC -MD (General Commercial Multiple - Family Dwelling) District to LI (Light Industrial) District for a 1.03 acre tract of land. Location:1075 MLK Parkway (former Mariposa). Applicant: Beaumont Warehouse & Transportation, Inc., J.F. Deshotel Mr. Richardson told the Commission the property is surrounded by heavy commercial and industrial uses and also vacant land and railroad tracks. The applicant owns all of block 22. The west six lots are already zoned LI. The property is used for the storage of plastic in an existing metal warehouse. The lots zoned GC -MD and are used for employee parking and loading and unloading of materials. Mr. Richardson recommended approval of this request. Thirteen notices were mailed to property owners within 200 feet. The Planning Division received no responses in favor and none in opposition. Acting Chairman LaBiche asked for comments in favor or in opposition. R. F. Deshotel, owner of the property addressed the commission and council. He explained the reason for wanting to change zoning was because of loading and unloading and parking for employees. Acting Chairman LaBiche closed the public hearing and asked for a motion on the request A motion by Commissioner Lucas was made to approve the zone change as requested in File 1354-Z. Commissioner Hallmark seconded the motion. Motion to approve carried 6:0 2 Planning Commission April 21, t997 2) File 1355-Z: Request for a zone change from RS to RM-M for the property on Bennett Road. Location: 4115 Bennett Road. Applicant: Patricia Taylor Mr. Richardson told the commission that rezoning the property would constitute spot zoning in that all of the surrounding tracts are zoned RS and developed with single family residences and would not be compatible with the neighborhood. Mr. Richardson recommended denial of this request. Sixteen notices were mailed to property owners within 200 feet. There were no responses in favor and two in opposition. Commissioner Lucas asked for the basis of opposition from property owners. Mr. Richardson replied that one person would like to keep the area single family residential and the second person objected to a residential care facility. The applicant stated that she wanted to put four handicapped apartments on the property . Commissioner Nisby wanted to know if the only access to this property was Bennett Road? Applicant replied that it was. He also asked if there was a vacant house next to the property. Ms. Taylor stated it was vacant. The house in question is owned by the Brown's. Councilman Goodson asked what kind of zoning classification would allow for duplex housing. Mr. Richardson stated that duplex housing was permitted with a special use permit in a RS and would only allow two units. The specific use permit application would then come before the commission. Councilman Goodson then asked if it would be possible to leave the existing house and have a duplex behind it. Mr. Richardson stated that would constitute three units and would still have to be rezoned to RM-M. Councilmember Smith inquired as to the amount of acreage and if the house was on both lots. Mr. Richardson stated property in question to be .47 acres. The applicant stated the house is virtually in the middle of both lots. Mayor Moore asked for clarification on details as to leaving the existing structure and then adding additional units in the back under the present zoning. Mr. Richardson stated the property would have to be replatted and have additional access to the rear of the property. Plaming Conunission April 21, 1997 One person spoke in favor of the zoning request. Three persons spoke in opposition of the zoning request. Mayor Moore explained that the neighbors need to be aware of what a person wants to accomplish in the neighborhood. Commissioner Bundy commended Ms. Taylor for her efforts in wanting to help the handicapped and a very worthwhile endeavor on her part. Commissioner Lucas recommended that Ms. Taylor meet with Mr. Richardson to develop a more concrete plan. Acting Chairman LaBiche closed the public hearing A motion to deny the request for a zoning change at 4115 Bennett Road as requested in File 1355-Z was made by Commissioner Bundy and was seconded by Commissioner Chisiun . The motion carried 5:1. Mayor Moore asked that the reason for the denial of the zone change be made clear to the applicant. Acting Chairman LaBiche stated that although the request was denied as submitted, it did not prevent her from developing her plan further by working with the city and appearing before the commission at a later date to reapply with a more concrete plan and possibly more support from the community. Commissioner Nisby offered the motion in regard to Ms. Taylor developing her property, that the one year time limit to bring another request before the Planning Commission, be waived. Commissioner Chisum seconded the motion. Motion to approve carried 6:0 . 3) File 1356-Z: Request a zone change from RS (Residential Single Family Dwelling) to RM-M (Residential Multiple Family Dwelling -Medium Density) District and an amended specific use permit to allow the expansion of an existing social service facility. Location: 4590 Concord Road Applicant: Norma Crane The applicant wishes to add a new one-story office building containing 2,592 square feet and 18 new parking spaces on a .0299 acre tract located ease of and abutting the main building. The proposed site plan shows traffic for all parking will be funneled through the existing parking lot onto Concord. 4 planning Commission April 21, 1997 The applicant is requesting a modification to the required landscaping along the north side of the new parking area. Five large trees exist just north of the property line. The Planning Director recommended approval of the request and the modification of the landscaping requirements. Twenty two notices were mailed to property owners within 200 feet. The Planning Director received one response in favor and none in opposition.. Commissioner Hallmark asked if the application is approved, does it guarantee the surrounding area will not have a parking entrance cut from the Travis Street side. Mr. Richardson said that it did. Mayor Pro-Tem Cokinos stated to everyone that he appreciated the work they do for senior citizens. The applicant addressed the Commission and Commissioner Chisum inquired about home health care on site and Mrs. Crane stated that there is no treatment on site. Three persons spoke in favor of the zone change. Acting Chairman LaBiche closed the public hearing. Commissioner Chisum made a motion to approve the zone change and amended specific use permit with a modification of the landscaping requirement as requested in File 1356-Z . The motion was seconded by Commissioner Bundy. Motion to approve carried 6:0. 4) File 1357-P: Request for a specific use permit in the NC (Neighborhood Commercial) District to allow a retail refreshment stand. Location: 1390 Brock man at Avenue "A" Applicant: Claude Conner The applicant wishes to lease the property to an individual who wished to sell sno- cones, hotdogs, and other food items. A specific use permit is required for such a facility in a NC district. The Planning Director recommended approval of the request. Twenty five notices were mailed to property owners within 200 feet. The Planning Director has received one response in favor and none in opposition. Planning Conwimion April 21, 1997 CommissionerNisby asked applicant if he were certain that only food items would be sold. Applicant assured council that this was understood and he was also cleared by the health department. Acting Chairman LaBiche closed the public hearing. Commissioner Lucas made a motion to approve the application for a specific use permit at 1390 Brockman as requested in File 1357-P and was seconded by Commissioner Nisby. Motion to approve carried 6:0. 5) File 1358-P: Request for a specific use permit for the Dishman Elementary School to be constructed by the Beaumont Independent School District. Location: 34.49 acre tract of land on the north side of Walden Road. Applicant: Beaumont Independent School District BISD will be building this new elementary school to serve the needs of the southwest part of the City. BISD has stated that there will be 750 students and 60 faculty members. Additional parking spaces will not be needed. Councilman Smith asked if there was enough acreage for a new street and for the number of school children. Mr. Richardson stated that the school will occupy 31 acres. Mr. Richardson recommended approval of this request. Thirteen notices were mailed to property owners within 200 feet. There has been one response in favor and none in opposition. Mr. David Sepulvada with Brooks & Sparks, Consulting Engineers addressed the Commission. Acting Chairman LaBiche asked him about the number of students. Mr. Sepulvada stated that the 850 students and 100 faculty and support staff was based on an ultimate build out of the school. Commissioner Nisby expressed concerned about the drainage ditch. Mr. Sepulvada stated that there will be a fence along the drainage ditch to the east and also to the north, so that the students will not have access to this area. Acting Chairman LaBiche closed the public hearing. 2 Planning Commission April 21, 1997 Commissioner Bundy made a motion to approve the specific use permit as requested in File 1358-P and Commissioner Lucas seconded the motion. Motion to approve carried 6:0. Commissioner Chisum asked that the audience be reminded that Planning and Zoning recommendation were only that and City Council has the Final vote on any considerations. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED. 7
