Richardson, Planning Director SUBJECT: Request to abandon a 20' x 237' general utility easement in Block 43, Van Wormer Addition, said easement retained in 1990 when the alley in Block 43 was abandoned. FILE- 564-OB STAFF REPORT The property owner of Block 43, Van Wormer Addition has made the request for this abandonment so that this vacant industrial block can be developed. This block is bounded by the recently opened M.L.K. Jr. Parkway on the east, Victoria on the west, Crockett on the south and Bonham on the north. All pre-existing structures on the tract have been removed. The 20'x 237'(more or less) utility easement extends from M.L.K. to Victoria. Lots 1, 12 and parts of Lots 2 and 11 were taken for M.L.K. right-of-way. M.L.K. is at grade in this block. M.K. C. Energy Investment, Inc., represented by Larry Crosby, owns all of Lots 3 -6, 7- 10 and the remaining parts of Lots 2 and 11. If this request is approved, it should be subject to the City of Beaumont receiving written information from Entex Gas Company that an agreement to relocate the 6" gas pipeline has been reached and that all costs for relocation have been paid before this request is forwarded to City Council for final action. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES That 20'x 237', more or less, general utility easement in Block 43, Van Wormer Addition, said easement extending from the west right-of-way line of M.L.K., Jr. Parkway west 237I, more or less, to the east right-of-way line of Victoria Street, said easement having been retained by the City of Beaumont, Jefferson County, Texas when the alley in said block was abandoned by the City of Beaumont on April 24, 1990, by Ordinance No. 90-28. ANALYSIS A letter explaining the request was sent to various city departments, DD#6 officials and the utility companies servicing Beaumont. Apparently only Entex Gas Co. is using the easement at the present time. They have a 6" STL natural gas pipeline lying across the abandoned alley. The gas company is presently negotiating with officials of M.K.C. Energy Investment, Inc. The applicant will be required to pay for any relocation of the gas pipeline.
