Richardson, Planning Director SUBJECT: Consider a request for a specific use permit to allow a residential care facility in an RCR (Residential Conservation and Revitalization) District at 23,90 Broadway. FILE: 1364-P STAFF REPORT Mrs. Judith Rich wishes to open a 24-hour supervised residential care facility to care for up to 15 elderly and disabled persons in an existing two-story house at the northeast corner of Broadway and Eighth Street. The proposed use requires a specific use permit and is also subject to the provisions of special condition No. 19, administered by the building official. The application is in compliance with seven of the eight conditions necessary for approval (Section 30-26 E). If this application is approved, shrubbery should be planted along the west property line from the handicap parking space to the driveway. Exhibits are attached. Responses in Opposition LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being Lots 15 and 16, Block 22, Averill Addition to the City of Beaumont, Jefferson County, Texas, containing 0.3 acres of land, more or less. 1?64--P Dear Planning Commission and City Council; It has been brought to our attention that New Beginning Private Home needs a certificate of occupancy before operations activities can begin. This small business will be family owned and operated. We foresee this home being a great asset to the elderly in our community, giving them the opportunity to live in a homelike environment. New Beginning Private Home will seek a personal care home license upon obtaining a certificate of occupancy. A personal care license will enable us to accept up to 15 residents to reside in the home, and provide 24 hour care services to the elderly and disabled. New Beginning Private Home will be staffed according to the needs of our patients. The primary use of the land will be for the purpose of a personal care home. In regards to the eight zoning ordinance requirements, New Beginning Private Home as a business will not diminish, or impair property values within it's vicinity. There are many businesses surrounding the proposed location. Businesses in the area include: home health agencies, business offices, dry cleaning services, ect. Adequate utilities and drainage are provided. There is an adequate amount of parking space for the safe, and convenient movement of vehicular and pedestrian traffic without adversely affecting the public or adjacent developments. Measures have been taken to control offensive orders and noises. There is sufficient landscaping and screening to ensure harmony and compatibility with adjacent property. Screening includes fencing and trees. We would appreciate your consideration in this matter and our cooperation as to the necessary requirements. That the proposed use is in accordance with the Comprehensive Plan. x x ANALYSIS continued This application for residential care (SIC Code #8361) is in compliance with the conditions for approval. Comments on conditions 1, 4, 7 and 18 follow: The residential facility for up to 15 disabled and elderly clients will be a compatible land use in this neighborhood of mixed residential, office and retail service uses. Apartments are situated to the south, vacant offices and shops to the west, offices and a laundry to the north and a home health agency to the east. The residents will have 24-hour supervision by the owner or her employees, This facility will need to acquire a license from the appropriate licensing agency. City health, fire and building codes will also be in effect. When this property was rezoned from R-3 to RCR in 1989, as a result of the "Old Town Rezoning Study', the house was used as a property management and investment company and continued as such until recently. 4. New parking spaces and space for the handicapped will be provided at the rear of the house accessed from an existing driveway on Eighth Street. There is also a driveway on Broadway which ends at a portecochere in front of the house. There are no parking signs on Broadway and 8th Street, 7. The property is landscaped with large mature live oaks, shrubs, ground cover and other trees. No additional fences or screening buffers are required because of the commercial zoning and land uses to the north and because of an existing business to the east. The applicant has asked for modification of the landscaping regulations of Section 30-3 1, regarding the possible need to further landscape the property at the rear in the area of the new parking spaces. If this application is approved, shrubbery should be planted along the west property line from the handicap parking space to the driveway. The proposed residential use will occupy a large house that was once commercial and is now vacant.
