Richardson, Planning Director SUBJECT: Request to abandon utility easements that were retained by the City when the alleys in Blocks 66 and 67, Van Wormer Addition and a portion of Victoria Street were abandoned. FILE: 566-OB STAFF REPORT Mr. Gary Sitton of Sitton Oil and Marine Co., Inc., plans to purchase property bound by Fannin, M.L.K. Parkway and the KCS Railroad Co. railroad right-of-way from Heisig Storage and Transfer, Inc. The property is now vacant and zoned for industrial use, but the easements crossing the tract prevents planned new construction and development. The alleys, in Blocks 66 and 67 of the Van Wormer Addition were abandoned by city ordinance on January 22, 1924. That portion of Victoria Street (formerly Rachford Street) lying between Blocks 66 and 67, Van Wormer Addition, was abandoned by a city ordinance on June 26, 1958. Information regarding this application was sent to interested city, county and utility company departments and offices, The Planning Division has received no objections to this request. There are no utilities or services situated in the easements. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being the 20' wide general utility easements lying in and across Blocks 66 and 67, Van Wormer Addition, said easements being retained by the City when the two alleys in Blocks 66 and 67, said addition, were abandoned by the City of Beaumont by ordinance on January 22, 1924; also being abandoned is the 60 ft. wide general utility easement lying between Blocks 66 and 67, Van Wormer Addition, same lying between the south line of Fannin Street and the north line of the KCS Railroad Company right-of-way, said easement being retained by the City when a portion of Victoria Street was abandoned by the City of Beaumont by ordinance on June 26, 19% Sitton Oil & Marine Co., Inc. The water tower that this easement was retained for has now been totally removed which facilitated the completion of flLK Project and would no longer serve any useful purpose.
