SUBJECT: Consider the request by abutting property owners to abandon certain utility easements
which were dedicated by the plat and replat of the undeveloped Ferguson
Development Park Addition in the Charles Williams Survey, Ab. #59, Beaumont,
Jefferson County, Texas.

STAFF REPORT
Cinemark USA, Inc. and others have acquired a portion of the recorded but undeveloped
Ferguson Development Park (Jefferson County Map Records, Volume 13, Page 49) and the
Replat of Tracts 11 and IV, Ferguson Development Park (Jefferson County Map Records,
Volume 13, Page 62). Some of this property is being combined with some of the tracts in the
abutting Cinemark Addition Replat (Jefferson County Map Records, Volume 15, Page 297),
and is being sold for commercial development.
Jerry B. Duty, Senior Vice President of the Beaumont Title Company is the applicant, acting
as agent for Cinemark USA, Inc. He has also submitted signatures of those other abutting
owners representing Ferguson Management, Inc., Clearwater Pacific, L.L.C. and Telco., Inc.
The following easements have been requested for abandonment:
(1) The 20' wide "electric" easement lying 10' along either side of the common side lot
line between Tract 11 and Tract IV, as shown on the replat of Tracts 11 and IV,
Ferguson Development Park, containing 0.146 acres, more or less-,
(2) The 20' wide "electric" easement lying along the rear or west lot lines of Tracts II and
IV, as shown on the replat of said two tracts, containing 0.519 acres, more or less;
(3) The 20' wide "electric and gas" easement lying 10' along either side of the common
side lot line between Tract IV and Tract VI, as shown on the Replat of Tracts II and
IV, said Ferguson Development Park and as also shown on the original plat of Tracts
I through VII, said addition, containing 0.159 acres, more or less,
(4) The 20' wide "electric and gas" easement lying along the west lot line of said Tract
No. VI, as shown on the original plat of Ferguson Park, containing 0.106 acres, more
or less; and

(5) The 20'wide "electric and gas" easement which extends 422,28'along and across the
south part of Lot VI, said original plat, said easement situated 100' north of the south
property line of Tract VI, abutting a 100' wide drainage easement (DD#6) which
extends across the south 844,56'of the addition, containing 0.194 acres, more or less.
The drainage easement is platted and dedicated in Tracts VI and VIL
This information was sent out to all interested parties. No objections were received. There
are no utilities lying within the subject easements. The Ferguson subdivision was never
developed.

Cinemark USA, Inc. and property owners abutting said easement wish and apply through Agent
(Beaumont Title Company) for abandonment by the City so that subject property can be
developed in such a fashion which would at this time overlap said easement.
However, upon abandonment of the easement, the subject property could be marketed as desired
without said overlap.
