Richardson, Planning Director SUBJECT: Consider a request for a zone change from RS (Residential Single Family Dwelling) to GC -MD (General Commercial -Multiple Family Dwelling) District for a lot located at Baldwin and Concord. FILE: 1388-Z STAFF REPORT Mr. Larry Engelmann owns and lives in the residence at 3990 Baldwin, He wishes to refurbish and sell used cars at his home. The selling of new and used cars is a permitted use in a GC -MD District. Mr. Engelmann made this identical request a year ago and the City Council denied the zone change. This property was annexed into the City in 1946. The Clara Baldwin Addition (10.8 acres, 40 lots) was platted in 1950. There are 40 homes in this subdivision. Original zoning in 1955 along Concord was R-3 (Modified Two -Family and Multiple Dwelling) until 1981 and 1982, when the R-3 zoning was removed along Concord. This residence is located on Baldwin but the lot abuts Concord Road, just southeast of Concord's intersection with East Lucas Drive. There are commercial uses and a shopping center located to the north and west of the subdivision. Concord and East Lucas are arterial streets and the Comprehensive Plan shows this area as a "Community Center". However, this single family subdivision is a completely developed stable residential neighborhood. it is adjacent to another residential neighborhood consisting of the Acorn Grove, Renfro and Horn Additions. Changing this lot would allow commercial encroachment into the subdivision with homes in the RS district adjacent to and facing the commercial lot. Granting a GC -MD district is not in compliance with the objectives, policies and proposals of the Comprehensive Plan regarding residential land use. In anticipation of the Concord Road improvements, staff has taken a tentative look at possible future land uses in the immediate area. For the last eighteen years I have been associated with automobile repair, body re -conditioning and sales/leasing. It has long been a fervent desire to pass this love of cars on to teenage boys, who on their own could never learn about cars. I do not mean to sound so "honorable" but never the less it is my intention. 3990 Baldwin is a property facilitated and located.in and around other commercial properties which already provide services to this Forth Beaumont Community. I intend to provide moderate to low cost transportation to this community of people, who may otherwise be forced to pay higher "Big Dealer" prices or may have no private transportation at all. WATER: There is a 2" water line in the Baldwin right- of-way and an 8" line in Concord. GENERAL INFORMATION/PUBLIC UTILITIES continued SANITARY SEWER SERVICE: There is a 6" sanitary sewer in the Baldwin right- of-way and a 6" in Concord. Fire protection is from Station No. 2, Wilson at Ironton. ADEQUACY OF SERVICE: Services and utilities are adequate.
